Description: Infant sleep position

Noncompliance Area: At the time of the inspection, a child (age infant) was laying on their belly sleeping. Staff 1 stated that the child did not roll over.

Correction Required: Infants shall be placed in the sleeping position recommended by the American Academy of Pediatrics unless there is a medical reason an infant should not sleep in this position. The medical reason shall be documented in a statement signed by a physician, physician's assistant or CRNP and placed in the child's record at the facility.

Description: Health information

Noncompliance Area: At the time of the inspection, Child 1 did not have a physical on file.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Description: Exemption documentation from parent/guardian

Noncompliance Area: At the time of the inspection, child 2 did not have an updated shot record.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Description: Supervised at all times

Noncompliance Area: At the time of the inspection, Staff 1 stated that Staff 1 saw a mark on the child's hand but Staff 1and Staff 2 could not state how that mark was obtained. At the time of the inspection, Cert reps observed a child walk out from the far back room (by the kitchen area) through a door dividing the far back area and the infant area, through the infant area, through a half door, into the middle area by himself, out of the sight of the staff.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Description: Each child care space

Noncompliance Area: At the time of the inspection, it was stated by Staff 1 that Staff 1 did not have access to Child 1's emergency contact information when the children were outside.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.

Description: Mixed Age Level/Supervision on and facility premises

Noncompliance Area: At the time of the inspection, Staff 1 was alone with 1 young toddler, 1 older toddler, and 6 Pre-school age children.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level). The required staff:child ratios must be maintained at all times.

Description: Two facility persons present in facility

Noncompliance Area: At the time of the inspection, Staff 1 was alone in the facility with 1 young toddler, 1 older toddler, and 6 Pre-school age children.

Correction Required: At least two facility persons shall be present in the facility when two or more children are in care. At a minimum, one of the facility persons shall be a staff person.

Noncompliance Area: At the time of the inspection, the first aid kit in the last area of the large room was missing soap.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.

Description: Supervised at all times

Noncompliance Area: It was observed on 09/17/24 Staff #1 was unable to give critical oversight to all of the children due to the activity of the children in the room. 2 children were moving a shelf that looked to be separating the classroom area from the hallway. The two children then climbed on a landing of the window area using a chair by the shelf. Staff #1 went into the hallway/desk area to get the children. The two children continually moved away from the staff to prevent getting caught. 3 children remained sleeping in the classroom area behind the row of shelves preventing the staff from seeing and assessing the children while they slept.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Description: Clean, good repair, proper size

Noncompliance Area: At the time of the inspection, the tables and floors were not cleaned and had food left on it.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

Regulation: 3270.113(a)

Description: Supervised at all times

Noncompliance Area: At the time of the inspection, CR observed 3 infants in cribs and 1 preschooler sleeping on a matt in the back area of the front room, not supervised (no staff was present in that area).

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Regulation: 3270.113(e)

Description: Restraints prohibited

Noncompliance Area: During the inspection, it was observed that 2 pre-school age children were in highchairs from at least 12:44 to 1:14.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.

Regulation: 3270.151(a)

Description: 12 months prior to service and every 24 months thereafter

Noncompliance Area: At the time of the inspection, Staff 1 did not have a health assessment on file.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.
