Noncompliance Area: An anonymous caller reported to the DOH that the facility/school had closed only for one day and that there were sick children in the classroom at school, and who were not being advised to get tested.

Correction Required: An operator who observes an enrolled child with symptoms of a communicable disease or infection that can be transmitted directly or indirectly and which may threaten the health of children in care shall exclude the child from attendance until the operator receives notification from a physician or a CRNP that the child is no longer considered a threat to the health of others. The notification shall be retained in the child's file. Diseases and conditions which require exclusion are specified in 28 Pa. Code Chapter 27 (relating to communicable and noncommunicable diseases).

Noncompliance Area: A hard plastic red chair in room 14 was observed cracked at the arm rest and back.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child`s size, age and special needs.

Noncompliance Area: Staff person #2 was observed sleeping room 21, preschool class, while the children napped.

Noncompliance Area: A written plan identifying the means of transporting a child to emergency care and staffing provisions were not posted in room 16/17 and room 25.

The light switch covering on the wall in the bathroom next to the toddler area was observed cracked. Holes were observed in the wall in room 25 and screws were observed protruding out of the wall, posing a hazard. A ceiling tile was observed hanging in the large indoor play space. Dirty rugs were observed in rooms 13 and 14.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility`s outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: On 3/1/17, Certification rep observed a video on the director's cell phone that showed, on 2/16/17, a staff person hitting a child on the leg, arm and head area with a drumstick musical instrument. Cert rep also observed on the video the staff person forcefully grabbing a child, picking up and forcefully sitting the child down closer to staff person.

Correction Required: A facility person may not use any form of physical punishment, including spanking a child.

Noncompliance Area: On 3/1/17, Certification rep observed a video on the director's cell phone that showed, on 2/16/17, a staff person was heard threatening to throw a child in the trash if child did not quiet down.

Correction Required: A facility person may not single out the child for ridicule, threaten harm to the child or the child`s family and may not specifically aim to degrade the child or the child`s family.

Noncompliance Area: On 3/1/17, Certification rep observed a video on the director's cell phone that showed, on 2/16/17, a staff person was heard threatening to throw a child in the trash if child did not quiet down.
