Description: Mixed Age Level

Noncompliance Area: During an onsite follow up visit on 8/18/25, cert rep observed Staff #1 and #2 out of ratio with a total of 9 children in a mixed age group: 1 infant, 7 young toddlers and 1 older toddler.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff: child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: Certification rep reviewed emergency plan delivery document and observed a copy of the emergency plan and subsequent plan updates was not sent to the county emergency management agency.

Correction Required: The operator shall send a copy of the emergency plan and subsequent plan updates to the local municipality and to the county emergency management agency.

Description: Age and Training

Noncompliance Area: Certification rep reviewed staff #1 record and observed 7 hours of 12 clock hours of childcare training not obtained, staff #3, 9 hours of 12 clock hours of childcare training not obtained. Staff #4, 12 hours of 12 clock hours of childcare training not obtained and staff #5, 9 hours of 12 clock hours of childcare training not obtained.

Correction Required: A staff person shall obtain an annual minimum of 12 clock hours of child care training.

Description: Fire safety - 1 yr.

Noncompliance Area: Certification rep reviewed staff #1, #2, #3, #4 and #5 record and observed completion of fire safety was not in record.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Description: Health and Safety Training - Pediatric First Aid and CPR

Noncompliance Area: Certification rep reviewed staff #2 record and observed Pediatric First Aid and CPR Training in record is not from an approved PQUAS certified trainer.

Correction Required: Staff person(s) shall complete professional development in the topics of 3270.31(f)(1 -- 10), 3280.31(f) (1-10), or 3290.31(g) (1-10) within 90 days of hire. Staff person #-2 will have until 7/2/25 to complete the required training. Until such time as the required training has been completed, staff person #2 must be supervised, when interacting with children, by an AGS or primary staff person who has completed the required training related to this citation. If there are no staff available to supervise staff person #2, staff person #2 may not work in a child-care position at the facility.

Noncompliance Area: Certification reviewed staff #1 record and observed State Police Criminal Clearance is for Volunteer purposes not Employment. Cert rep reviewed staff #5 record and observed staff #5 did not have an NSOR clearance in record.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). SAFETY PLAN: The operator is required to submit to the Children and Youth Agency a plan of supervision or alternate arrangement as required by the Child Protective Services Law. LACKING REQUIRED HIRING DOCUMENTS: Facility Person # -- may not work in a child care position at the facility. PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #--- may not work in a child care position at the facility.

Noncompliance Area: Certification rep observed tweezers, soap and gloves missing in the first aid kit of the toddler classroom.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.
