Description: General Health and Safety/Locked or inaccessible - in original container

Noncompliance Area: During the renewal inspection on 7/13/2026, toxics were in the downstairs bathroom cabinet. The cabinet was unlocked and the bathroom is used by children. In the living room on the main floor, there was an unlocked cabinet. That also had various cleaning supplies that would be accessible to the children. In the playroom, there was toxics on a shelf that was accessible to children. Toxics in all three areas were cleaning supplies, such as Lysol. In the kitchen, there were knives with sharp serrated edges accessible in an unlocked draw. The children have access to the kitchen since they eat in there.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children. Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Description: System in compliance/Operator or designated staff responsibility

Noncompliance Area: During an allocated unannounced inspection on 9/26/2025, it was observed that the first floor smoke detector was not interconnected with basement, second floor and third floor smoke detector.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The operator or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met.

Description: Updated toddler/preschool health report: every 12 months

Noncompliance Area: Child 1, who is a preschooler, had an outdated health assessment on file. Please see LIS for date of admission and date of birth.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Noncompliance Area: The regulations were not accessible to parents electronically.

Correction Required: The operator shall provide the parent of each child enrolled in the facility with information on how to access the regulations in this chapter electronically.

Noncompliance Area: The emergency plan was not posted in a conspicuous location.

Correction Required: The emergency plan shall be posted in the facility at a conspicuous location.

Description: Ammunition locked and separate

Noncompliance Area: During the renewal inspection on 7/9/2025, it was observed that the facility had a handgun and ammunition. The handgun, while in a locked cabinet, had ammunition in it. As a result, as least some of the ammunition was not in a separate, locked cabinet.

Correction Required: If the facility is located in a residence, ammunition shall be contained in a locked area separate from weapons and firearms.

Description: Clean, age appropriate

Noncompliance Area: Cots that the children sleep on were not labeled.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the parent and the operator. The rest equipment must be labeled with the child's name and used only by the named child while enrolled in the program.

Regulation: 3290.106

Description: Refrigerator

Noncompliance Area: The small refrigerator in the kitchen did not have a thermometer in it.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45° F or below. An operating thermometer shall be placed in the refrigerator.

Regulation: 3290.24(c)

Description: Training regarding plan

Noncompliance Area: Staff 1, who is beyond 90 days of hire, did not have proof on file that she was trained on the emergency plan. Staff 2 stated that she did review it with staff 1 but did not document the training.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training.

Description: Heat Source

Noncompliance Area: As per staff 2, children do eat in the kitchen sometimes. The stove is accessible to children. No gate or stove guard is present.

Correction Required: Hot water pipes and other sources of heat exceeding 110° F that are accessible to children shall be equipped with protective guards or shall be insulated to prevent direct contact.

Description: Locked

Noncompliance Area: The gun was in a safe. However, the safe was unlocked.

Correction Required: If the facility is located in a residence, weapons and firearms shall be contained in a locked cabinet.

Description: Designated release persons

Noncompliance Area: During renewal inspection conducted 7/13/2023 - 7/19/2023, fee agreements for Child #1 and Child #2 did not contain release person(s).

Correction Required: An agreement shall specify the persons designated by a parent to whom the child may be released.

Description: Comply with CPSL/CPSL information

Noncompliance Area: During renewal inspection conducted 7/13/2023, facility person #1 had volunteer PSP clearance dated 9/4/2021. Operator reports that a new PSP clearance was obtained last year on 8/25/2022; however, it was not in the file.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a child care position at the facility until appropriate clearance is on file.

Description: Ammunition locked and separate

Noncompliance Area: During renewal inspection conducted 7/13/2023 - 7/19/2023, ammunition was observed in the same locked cabinet with a firearm. A clip was observed in the firearm as well.

Correction Required: If the facility is located in a residence, ammunition shall be contained in a locked area separate from weapons and firearms.

Noncompliance Area: During renewal inspection conducted 7/13/2023, facility did not have evacuation route posted in the basement of the facility.

Correction Required: The operator or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that evacuation routes are posted in a conspicuous location on each floor of the facility.
