Regulation: 3290.113(a)

Description: Supervised at all times

Noncompliance Area: At the time of the inspection the children in the facility were being supervised alone by staff person #2

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. The requirement for supervision on and off the facility premises includes compliance with the staff:child ratio requirements in §§ 3290.51-3290.52 (relating to maximum number of children; and staff:child ratio). TIERED LIS: Children must be supervised at all times. The legal entity must arrange for all facility staff to receive a minimum of two hours of training regarding supervision of children. The legal entity must receive DHS approval of the training content prior to scheduling the training. The legal entity must submit documentation in a format approved by DHS proving that the facility procedure for counting children is followed at all times e.g., a checklist. The legal entity will confirm continuing compliance by sending copies of the documentation to the Regional Office of Child Development and Early Learning on a weekly basis for a period of three months after DHS approves the documentation format.

Noncompliance Area: At the time of the inspection the records of both staff person #1 and staff person #2 were lacking current valid health assessments.

Correction Required: A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Description: Consent for emergency medical care required prior to admission/Consent for administration of minor first-aid required prior to admission

Noncompliance Area: At the time of the inspection the record of child #1 was lacking both of the required written parental consents for minor first aid as well as emergency transportation.

Correction Required: A child's record must contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission. A child's record must contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Description: Immediate access

Noncompliance Area: At the time of the inspection the male adult who answered the door told the certification representative to wait outside, the second adult (staff person #2) did tell certification representative they had to wait outside. Certification representative did not gain entry to the facility for a period of at least 10 minuets.

Correction Required: A staff person shall provide to agents of the Department immediate access to the facility, the children and the files and records.

Description: Health and Safety Training - Pediatric first aid/CPR

Noncompliance Area: At the time of the inspection the record of staff person #1 did not contain proof of the required pediatric first aid.

Correction Required: Staff person shall complete professional development in the topic of pediatric first aid and pediatric cardiopulmonary resuscitation.

Description: Comply with CPSL/CPSL information

Noncompliance Area: At the time of the inspection the following CPSL violations were observed: The record of staff person #1 was lacking a disclosure statement, and proof of the mandated reporter as well as a child abuse clearance that was dated 2011. The staff record of staff person #2 was lacking a disclosure statement, Pennsylvania State Police Clearance , Child Abuse Clearance, FBI Clearance as well as proof of the mandated reporter training.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person # 2 and staff person #1 may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Description: Written record

Noncompliance Area: At the time of the inspection the facility had no written record of the fire drills nor did they demonstrate the operability of the interconnected fire detection system.

Correction Required: A written record is maintained on file at the facility indicating the specific time of day of the drill, the hypothetical location of the fire, the evacuation time, and the names of the facility persons and the number of children who participate in the fire drill.

Noncompliance Area: At the time of inspection, there was not a posted Daily Activities Plan in the childcare space.

Correction Required: A written plan of daily activities and routines, including a time for free play shall be established for each group. The plan shall be flexible to accommodate the needs of individual children and the dynamics of the group.

Description: Written emergency plan posted

Noncompliance Area: At the time of inspection, facility did not have a written plan posted in a conspicuous location which identifies the means of transporting a child to emergency care and facility staffing provisions in the event of an emergency.

Correction Required: A written plan shall be conspicuously posted which identifies the means of transporting a child to emergency care and the facility staffing provisions in the event of an emergency. The plan must accompany a staff person who leaves the facility on an excursion with children.

Description: General Health and Safety

Noncompliance Area: At the time of inspection, facility's Shaken Baby Syndrome, Abusive Head Trauma and Child Maltreatment policy did not address potential signs/symptoms of Shaken Baby Syndrome/Abusive Head Trauma or strategies for staff in coping with distraught children and prevention and identification of child maltreatment. Facility's Emergency Plan did not address Continuity of Operations.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: At the time of inspection, provider did not have documentation that the facility's Emergency Plan was reviewed as required annually.

Correction Required: The operator shall review the emergency plan at least annually and update the plan as needed. Each review and update of the emergency plan shall be documented in writing and kept on file at the facility.
