Description: Supervised at all times /Staff assigned to specific children

Noncompliance Area: Staff person #1 did not supervise child #1 when this staff person left this child alone in the bathroom for approximately 15 minutes after returning to the classroom with the 3 other children who had been using the bathroom (had been a group of 4 children using the bathroom, including child #1). Staff person #1 was unaware that child #1 was missing from the classroom for those 15 minutes.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Noncompliance Area: Staff persons #1, #2, and #3 were caring for a group of 11 toddlers. Staff persons #1 and #2 each identified being responsible for 5 of the children. Staff person #3 did not have a group. Only 10 of the 11 children were accounted for in the primary care groups.

Description: Promote development

Noncompliance Area: Staff person #1 was over child #1 (preschooler) and held the child down while the child was flat on their back. The child reportedly had ahold of staff person #1's lanyard and was pulling it towards the staff person's neck. Staff person #1 reported being worried the child was going to throw metal toys and was protecting both the staff and the other children in the room.

Correction Required: Daily activities shall promote the development of skills, social competence and self-esteem. Daily experiences shall recognize the child as an individual and give some choice of activities that respect personal privacy, lifestyle and cultural background.

Noncompliance Area: The emergency contact information on file for child #1 did not include a complete address for a listed release person.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Noncompliance Area: The previous mandated reporter training on file for staff person #2 expired on 5/7/2025, and an updated training was not completed until 5/21/25. The child abuse clearance on file for staff person #3 was for "volunteer" purposes.

Noncompliance Area: According to the log on file at the time of inspection, manual tests of the fire detection system took place on 5/30/25 and subsequently more than 30 days later on 6/30/25.

Noncompliance Area: Staff persons #3 and #4 were working with children unsupervised on the morning of June 6th, 2025. Staff persons #3 and #4 are currently under a supervision plan and may not work with children unsupervised at this time.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Staff person #3 and #4 may not be permitted to work alone with children and must work within the vicinity of a permanent employee until the supervision plan is lifted. Conditions at the facility may not pose a threat to the health or safety of the children.

Description: Supervised at all times /Staff assigned to specific children

Noncompliance Area: On the morning of 10/13/23, two young toddlers (child 1 and child 2) were able to leave the childcare space and enter into the attached office. The toddlers closed the door to the office and were unsupervised in the space from 9:03am to 9:13am. Prior to the incident, staff person 1 was observed on video leaving the office door open before exiting the room at 9:01am. Upon exiting the room, the staff person did not transfer the supervision cards to staff person 2 (who was responsible for the toddlers). During the supervision lapse, staff person 2 was observed conversing with the other staff in the room and was not actively supervising the children in the room. Staff person 3 discovered the children were not in the room after stepping into the room to cover a bathroom break.

Description: Mixed Age Level

Noncompliance Area: The facility self-reported ratio non-compliance that took place on the morning of 10/2/23. From 8:49 am until 9:10 am, staff persons 1 and 2 were caring for more than 8 infant and toddlers in room 2. From 8:49-9:03, two staff were caring for 9 children. From 9:03-9:07, two staff were caring for 10 children. From 9:07-9:10, two staff were caring for 11 children.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level). When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20.

Noncompliance Area: Pieces of mulch were observed on the toddler playground. The mulch appears to have washed over the retaining wall. Mulch was also observed along the edge of the toddler area (within reach) on the nature playground.

Correction Required: Pea gravel and other materials with a diameter of less than 1 inch may not be used in spaces where infants or toddlers receive care. Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.
