Noncompliance Area: A renewal inspection was conducted at the facility on December 15, 2025, at the time of inspection a former staff person was identified as caring for children in the posted emergency care and staffing plan.

Correction Required: A written plan shall be conspicuously posted which identifies the means of transporting a child to emergency care and the facility staffing provisions in the event of an emergency. The plan must accompany a staff person who leaves the facility on an excursion with children.

Noncompliance Area: A renewal inspection was conducted at the facility on December 15, 2025, at that time the facility's emergency plan was reviewed and a former staff person was named and given responsibilities during an emergency.

Correction Required: The operator shall review the emergency plan at least annually and update the plan as needed. Each review and update of the emergency plan shall be documented in writing and kept on file at the facility.

Description: Above ground window opening restricted to 6"

Noncompliance Area: A renewal inspection was conducted at the facility on December 15, 2025, at the time of inspection, the safety tabs on the second-floor window were closed allowing the window to open more than 6 inches.

Correction Required: Windows or doors above the ground floor that open directly to the outdoors and are accessible to children shall be constructed, modified or adapted to limit the opening to 6 or fewer inches.

Description: Comply with CPSL/CPSL information

Noncompliance Area: Per the Allentown Health Bureau, an inspection was conducted on November 5, 2025 at that time Staff Person #1 was observed working unsupervised in a childcare position at the facility without all clearances on file. A complaint inspection was conducted between 11/10/25 and 12/15/25 and found that Staff Person #1's Child Abuse History clearance was dated 11/7/25, PA State Police clearance was dated 11/6/25, and National Sex Offender Registry (NSOR) verification was dated 11/7/25.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). As of 2/1/25 If staff are going to be hired under the 45-day provisional hire basis, the following conditions must be met; facility received the results of the applicant's PA Child Abuse History Clearance, NSOR Clearance, completed out-of-state clearances (if applicable), a signed disclosure statement, prior to employment and have received the result of the applicant's Pennsylvania State Police OR the FBI finger-print results prior to employment. Proof of submission must be on file for either the FBI or PA State Police Clearance. The employer, administrator, supervisor or other person responsible for employment decisions has no knowledge of information pertaining to the applicant which would disqualify him from employment based on CPSL. A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Correction Required: Windows or doors above the ground floor that open directly to the outdoors and are accessible to children shall be constructed, modified or adapted to limit the opening to 6 or fewer inches.

Description: System in compliance/Operator or designated staff responsibility

Noncompliance Area: On September 2, 2025, an initial inspection was conducted and at that time the designated staff person attempted to test the smoke detectors, and no audible alarms were heard.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The operator or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in § 3290.95(a) are met. Family Childcare Homes shall have a smoke alarm on each floor and in the basement that · When activated, the resulting alarm is audible to persons in the indoor child-care space with all intervening doors closed (35 P.S. § 1223.6(f.1)(1.1)(i)).
