The following children's emergency contact forms were not updated at least every 6 months: Child #1 (previous 7/31/24, current 9/9/25), Child #2 (previous 11/14/24, current 9/9/25) and Child #5 (previous 10/29/24, current 9/10/25).

Correction Required: The parent shall update in writing emergency contact information once in a 6-month period or as soon as there is a change in the information. A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: A renewal inspection occurred at the facility on 10/21/25. A review of staff files was conducted. Regulation requires staff to participate in an updated health assessment every 24 months. Both Staff #1 and #2 did not participate in an updated health assessment every 24 months (previous 8/23/23, current 10/2/25).

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Description: Fire safety - 1 yr.

Noncompliance Area: A renewal inspection occurred at the facility on 10/21/25. A review of staff files was conducted. Regulation requires staff to participate in fire safety training on an annual basis. Staff #3 did not participate in fire safety training on an annual basis (previous 2/22/24, current 9/19/25).

Correction Required: Staff persons shall participate, at least annually, in fire safety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Description: Comply with CPSL/CPSL information

Noncompliance Area: An unannounced inspection occurred at the facility. A review of staff files was conducted. To be hired correctly as a provisional hire, the CPSL requires staff to apply for the FBI clearance and be supervised until all completed clearances are received. Staff #1 was hired incorrectly as a provisional hire as this staff did not apply for the DHS FBI clearance and was working unsupervised with children at the time of this inspection.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a child care position with regular contact and routine interaction with children at the facility until the missing clearances are on file.

Noncompliance Area: An unannounced monitoring occurred at the facility. A physical site review was conducted. The waddler classroom has an established capacity of 3 children. At the time of this inspection, the waddler room contained 4 children. The capacity for the waddler classroom was exceeded by 1 child.

Correction Required: The capacity established for an indoor space may not be exceeded.

Regulation: 3270.31(e)(4)(i)

Description: Age and Training

Noncompliance Area: A renewal inspection occurred at the facility. A review of staff files was conducted. Regulation requires staff to participate in and complete updated pediatric first aid and CPR prior to the current certificate expiring. Staff #1 had pediatric first aid and CPR dated for 5/25/22, this training expired on 5/25/24 and this staff did not complete updated training until 6/27/24. Staff #1 did not participate in pediatric first aid and CPR prior to their current certificate expiring.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Noncompliance Area: A renewal inspection occurred at the facility. A review of staff files was conducted. Staff person #3 has not completed the following required pre-service training within 90 days of their date of hire (see LIS code sheet): pediatric first aid and CPR. Staff #3 completed pediatric first aid and CPR on 6/27/24.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10. Staff persons shall complete professional development in pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire.

Description: Staff evaluations

Noncompliance Area: A renewal inspection occurred at the facility. A review of staff files was conducted. See the code sheet for the date of hire. Regulation requires a written annual evaluation to be completed on staff. The following staff have been employed with the facility for over a year and the files did not contain an annual written evaluation: Staff #1 and Staff #2.

Correction Required: A director is responsible for written evaluation of staff persons on a regular basis, a minimum of one evaluation every 12 months.

Regulation: 3270.52/3270.113(a)(2)

Description: Mixed Age Level/Supervision on and facility premises

Noncompliance Area: A renewal inspection occurred at the facility. A physical site review was conducted. In the butterfly class, 1 staff was observed to be working with a mixed age group of 5 children. The youngest child was an infant. This classroom was out of ratio and to maintain appropriate staff:child ratios would have required a second staff person.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level). The requirement for supervision on and off the facility premises includes compliance with the staff:child ratio requirements in §§ 3270.51--3270.55. The Legal Entity/Director will establish a supervision and mixed age ratio policy. The policy will include how the facility will demonstrate their knowledge and ability to adequately supervise children while always maintaining appropriate ratio and during times when mixed aged children are group together. The policy must address the process of determining proper staff:child ratio when mixed aged children are grouped together. The policy will be submitted to the Northeast Regional office for approval. Once approved the policy will be reviewed by all staff. Staff will sign off as an understanding of the policy and mixed aged ratios.

Noncompliance Area: A renewal inspection occurred at the facility. A review of the facility's fire safety system testing log was completed. Regulation requires the fire safety system to be tested at least every 30 days. The following tests did not occur at least every 30 days: 3/1/24-4/5/24 5/3/24-6/3/24 7/1/24-8/1/24 8/1/24-9/3/24 9/3/24-10/7/24.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Regulation: 3270.14/3270.21

Description: Pertinent Laws & Regulations/General Health and Safety

Noncompliance Area: Staff person #1 was observed to be caring for children unsupervised. Staff person #1 has not completed the following pre-service trainings required prior to caring for children unsupervised: Pediatric First Aid/ CPR and Health and Safety Training Update.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pediatric first-aid and pediatric CPR training is completed, staff person #1 must be supervised, when interacting with children, by an AGS who has completed the required training related to this citation. If there are no staff person(s) available to supervise staff person #1, staff person #1 may not work in a child-care position at the facility.

Regulation: 3270.106(a)

Description: Clean, age appropriate

Noncompliance Area: There was no key to indicate which rest equipment was assigned for use by a specific child. The rest equipment was not individually labeled otherwise.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.
