Description: Comply with CPSL/CPSL information

Noncompliance Area: A renewal inspection occurred at the facility. A review of staff files was conducted. The CPSL requires clearances to be updated atleast every 60 months. The following staff did not update their clerance(s) at least every 60 months: Staff #1 (NSOR previous 1/9/20, current 7/3/25) and Staff #2 (NSOR previous 6/16/20, current 6/20/25).

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 and #2 may not work in a child care position with direct contact with children at the facility.

Description: No insects or rodents

Noncompliance Area: A renewal inspection occurred at the facility. A physical site review. In the Sunshine Room, rodent feces was observed in the corner, on the floor, near the sink.

Correction Required: Evidence of infestation of insects or rodents in the facility is not permitted.

Description: Heat Source/Building Surfaces

Noncompliance Area: A renewal inspection occured at the facility. A physical site review was conducted. In the infant room, a bottle warmer was found accessible to children. The bottle warmer contained a warning to keep out of reach of children and infants/toddlers were observed receiving care in this room at the time of the inspeciton. Staff indicated they had recently used the warmer to warm up a bottle.

Correction Required: Hot water pipes and other sources of heat exceeding 110° F that are accessible to children shall be equipped with protective guards or shall be insulated to prevent direct contact. Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: A renewal inspection occurred at the facility. A review of children's files was conducted. Regulation requires the emergency contact and agreement forms to be updated at least every 6 months. The following children's emergency contact forms were not update at least every 6 months: Child #1 (previous 8/25/23, current 4/16/24), Child #2 (previous 9/14/23), Child #4 (previous 10/6/22), Child #5 (previous 9/5/23, current 4/4/24), Child #6 (previous 9/5/23, current 4/4/24) and Child #7 (previous 10/30/23, current 8/5/24). The following children's agreement forms were not updated at least every 6 months: Child #1 (previous 9/6/23, current 6/2/24), Child #4 (previous 9/6/23, current 6/3/24), Child #5 (previous 9/15/23, current 4/5/24) and Child #6 (previous 6/3/24, current 4/4/24).

Correction Required: The parent shall update in writing emergency contact information once in a 6-month period or as soon as there is a change in the information. A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Description: Pertinent Laws & Regulations/General Health and Safety

Noncompliance Area: A renewal inspection occurred at the facility. A review of staff files was conducted. The OCDEL Announcement C-22-06 requires all current child care staff who completed the previous health and safety pre-service training modules prior to October 4, 2022 to complete the Pennsylvania Health and Safety Update 2022 by December 30, 2022. Staff # 1 did not complete this training until 2/14/23.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Regulation: 3270.31(e)(4)(i)

Description: Age and Training

Noncompliance Area: A renewal inspection occurred at the facility. A review of staff files was conducted. Regulation requires pediatric first aid training to be updated prior to the previous training experiencing. Staff #3 did not update their pediatric first aid/CPR training before the previous training expired (previous 6/10/22, current 6/28/24).

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Regulation: 3270.31(e)(4)(ii)

Description: Fire safety - 1 yr.

Noncompliance Area: A renewal inspection occurred at the facility. A review of staff files was conducted. Regulation requires staff to participate in fire safety training on an annual basis. Staff #5 did not participate in annual fire safety (previous 4/24/23 and current 5/3/24).

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Description: Health and Safety Training

Noncompliance Area: A renewal inspection occurred at the facility. A review of staff files was conducted. Staff person #5 and #7 have not completed the following required pre-service training within 90 days of their date of hire (see LIS code sheet): health and safety training. Staff person #2 has not completed the following required pre-service training within 90 days of their date of hire (see LIS code sheet): pediatric first aid/CPR.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)10.

This is evidenced by the trainings documented as follows: Staff #1 (previous 12/28/15, current 4/19/21), Staff #6 (pervious 9/6/16, current 9/21/21) and Staff #7 (previous 9/5/16, current 1/25/22).

Staff #1 did not update their child abuse clearance timely (previous 6/7/19, current 6/11/24). Staff #3 also did not update their clearances timely (state police 8/9/16 and 9/19/21, child abuse 8/30/16 and 9/22/21, FBI 8/12/16 and 9/28/21).

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Description: Staff evaluations

Noncompliance Area: A renewal inspection occurred at the facility. A review of staff files was conducted. The following staff evaluations were not conducted on an annual basis as required by regulation: Staff #4 (previous 8/14/23, current 9/1/24) and Staff #5 (previous 7/20/23, current 8/5/24).

Correction Required: A director is responsible for written evaluation of staff persons on a regular basis, a minimum of one evaluation every 12 months.

Description: Building Surfaces/No peeling paint or plaster

Noncompliance Area: A renewal inspection occurred at the facility. A physical site review as conducted. Dirty and dusty vents, ceiling tiles and light covers were observed in: Shining Stars, Bright Stars, Discovery Preschool and Sunflower 2. Peeling paint was found in the bathroom of Bright Stars. A hole was found in the bathroom of the Discovery Preschool. All areas listed were identified and addressed with the staff at the time of the inspection.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Description: Every 60 days

Noncompliance Area: A renewal inspection occurred at the facility. A review of the facility's fire drill log was conducted. Regulation requires fire drills to occur at least once every 60 days. The following drill lapsed occurring at least every 60 days: 2/9/24 - 4/16/24.

Correction Required: The Director or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that fire drills are conducted at least once every 60 days.

Noncompliance Area: Staff Person #1 resided outside of Pennsylvania in the 5 years prior to employment at the facility and did not have the state sex offender registry search on file. State Sex offender search completed for Staff Person #1 at time of inspection.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Description: Different times of day

Noncompliance Area: Per facility fire drill log, all fire drills conducted between July 2022 and July 2023 were conducted in the morning.

Correction Required: The Director or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that fire drills are conducted at different times of the day or night, or both, if applicable.
