Noncompliance Area: The files for staff persons #5, #6 and #7 do not contain verification of training regarding the facility emergency plan at the time of initial employment / within one week of employment. The files do contain current training.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Noncompliance Area: The files for staff persons #1, 2, 3 and 4 contain current fire safety training that was conducted more than 12 months after the prior fire safety training.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Noncompliance Area: The most recent fire drill was conducted on 2/13/2020. The facility was closed from 3/13/20 to 8/24/2020 due to covid-19 mitigation. The facility has been operating since 8/24/2020 without conducting a fire drill.

Correction Required: A fire drill shall be held at least every 60 days. Facility persons and children in attendance shall participate in the fire drill. Facility persons and children shall exit the building, weather permitting.

Noncompliance Area: The file for child #3 does not contain a child service report completed in the previous 6 month period.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in 3270.124(f) (relating to emergency contact information).

Noncompliance Area: The file for child #2 does not contain an emergency contact and financial agreement updated within the previous 6 month period. The files for child #1, #3 and #4 do not contain emergency contacts updated within the previous 6 months.

Correction Required: The parent shall update in writing emergency contact information once in a 6-month period or as soon as there is a change in the informationA parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: The files for child # 2,3,4 and 5, all preschool aged, do not contain verification of a flu vaccination received during the previous 12 month period as required according to the ACIP schedule.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: In the preschool classroom medication box there were Rexall Anti Itch Lotion, Equate Children's Ibuprofen and Equate Children's Pain And Fever Relief, all lacking the name of the child for whom they were intended.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container.

Noncompliance Area: In the classroom there was a container of Clonazepam which stated 'discard after 4/10/19'.

Correction Required: Medication shall be stored in accordance with the manufacturer's or health professional's instructions on the original label.

Noncompliance Area: In the child care classroom in a childproof cabinet under the sink there was a spray bottle of yellow cleaning solution that was not labeled with the name of the contents. Staff identified the contents as Mr. Clean Disinfectant.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be stored away from food, food preparation areas and child care spaces.

Noncompliance Area: The files for child #1, #2, #3 and #4 contain current emergency contact and financial agreements that were reviewed more than 60 days after the previous review. The files are now current.

Correction Required: An operator shall notify local traffic safety authorities annually in writing of the location of the facility and the program's use of pedestrian and vehicular routes around the day care facility.

Noncompliance Area: The file for staff person #1, hire date 7/19/18, does not contain verification of a request for a criminal history clearance prior to starting in a child care position as required under the CPSL. The file does contain a completed criminal history clearance dated 8/17/18.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: The files for facility persons #1 and #2, identified as the facility lifeguards during swimming activity at Camp Sherwin, do not contain documentation of lifeguard credentials.

Correction Required: When children are swimming, supervision shall include one person certified in lifeguard training, as described in 3270.31(e)(4)(iii) (relating to age and training). A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: A health assessment including a TB test was not on file for facility person #2.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.
