Noncompliance Area: At the time of the inspection the record of the following staff persons were lacking current valid health assessments: Staff person #1 and staff person #4

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Description: Emergency info/agreement updated 6 mos

Noncompliance Area: At the time of the inspection the record of child #1 had both emergency contact information and the financial agreement which had not been review and updated by parents in over 6 months' time.

Correction Required: A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Description: General Health and Safety/Trash removed once a day

Noncompliance Area: At the time of the inspection (10:00 AM) the Surface of the outdoor play space had trash spread about upon it.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children. Trash shall be removed from the facility at least once per day.

Regulation: 3270.31(e)/3270.192(2)(iii)

Description: Age and Training/Exp, educ., training at facility

Noncompliance Area: At the time of the inspection the record of staff person #1 had a total of 10 clock hours of child care training for the current 12-month cycle.

Correction Required: A staff person shall obtain an annual minimum of 12 clock hours of child care training. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Regulation: 3270.31(f)

Description: Health and Safety Training

Noncompliance Area: At the time of the inspection the record of staff person # 4 (first date of providing care 8/25/25) did not contain the required health and safety training.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10.

Regulation: 3270.32(a)/3270.192(4)

Description: Comply with CPSL/CPSL information

Noncompliance Area: At the time of the inspection the following CPSL violations were observed: the record of staff person #4 was lacking a current compete and valid PA State police clearance, and the record of staff person #5 was lacking An acceptable FBI clearance.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person # 4 and # 5 may not work in a child care position at the facility.

Regulation: 3270.33(a)/3270.192(2)(ii)

Description: Each staff person meets quals/Exp, educ., training prior to facility

Noncompliance Area: At the time of the inspection the record of staff person #4 was lacking the proof of education and experience to qulaify them for the position they were identified to be serving at the facility.

Correction Required: A staff person or a substitute staff person shall meet one of the applicable staff qualifications for the position in which the person is performing. A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Regulation: 3270.76/3270.77(a)

Description: Building Surfaces/No peeling paint or plaster

Noncompliance Area: At the time of the inspection there were several areas of peeling paint on the first floor of the facility in the child care space.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Regulation: 3270.121(a)

Description: Review policies and procedures

Noncompliance Area: Written parental information to be given to parents at the time of enrollment did not include the facility's policies on supervision in accordance with 55 PA Code 3270 regulations related to supervision of children.

Correction Required: The operator shall review with the parent, at the time of application, the facility's general daily schedule, hours for which care is provided, fees, responsibilities for meals, clothing, health policies, supervision policies, night care policies, dismissal policies, transportation and pick-up arrangements. Amend the parent information/handbook to include written supervision policies in accordance with 55 PA Code 3270 regulations related to supervision of children. Submit a copy of the amended parent information/handbook for verification of compliance.

Regulation: 3270.123(a)(5)

Description: Designated release persons

Noncompliance Area: One child's record contained agreements that did not specify the persons designated by a parent to whom the child may be released. (child #4)

Correction Required: An agreement shall specify the persons designated by a parent to whom the child may be released. Update the agreement to specify the persons designated by a parent to whom the child may be released. Submit a copy of the updated agreement.

Regulation: 3270.124(b)(6)

Description: Insurance coverage information

Noncompliance Area: One child's emergency contact information did not include health insurance coverage and policy number information. (child #4)

Correction Required: Emergency contact information must include health insurance coverage and policy number for a child under a family policy or Medical Assistance benefits, if applicable. Obtain and submit a written copy of the missing health insurance information for the identified child. Ensure that all children's records contain emergency contact information as specified in these regulations.

Regulation: 3270.131(a)

Description: Health information

Noncompliance Area: One child has been enrolled in the facility for more than 60 days and their record did not include a health report in accordance with this regulation.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility. Obtain and submit a current up-to-date health report that contains the required contents for the identified child. Ensure that all children's health reports contain the required contents as specified in these regulations.

Regulation: 3270.131(e)(3)

Description: Dismissal policy

Noncompliance Area: One child has been enrolled for more than 60 days and their record did not include written verification of current up-to-date immunizations. (child #5)

Correction Required: The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in child care group settings). In accordance with the Department of Health regulations, the child cannot return to care until written verification of current up-to-date immunizations have been obtained and submitted. Submit a copy of the current up-to-date immunizations for the indicated child. Ensure that children's records include current up-to-date immunizations within 60 days following the first day of attendance at the facility.

Regulation: 3270.14/3270.21

Description: Pertinent Laws & Regulations/General Health and Safety

Noncompliance Area: The facility's emergency plan did not include a statement about the continuity of operations emergency preparedness and response planning as outlined in 45 CFR § 98.41(a)(1)(vii), including the Robert T. Stafford Disaster Relief and Emergency Assistance Act.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Amend the facility emergency plan to include a statement about the continuity of operations. Submit a written copy of the amended emergency plan.
