Description: Exemption documentation from parent/guardian

Noncompliance Area: During the renewal inspection on 11/07/24 the file reviewed for child #1 did not contain exemption from immunization letter documented by parent.

Correction Required: Exemption from immunization for religious belief or strong personal objection equated to a religious belief shall be documented by a written, signed and dated statement from the child's parent or guardian. The statement shall be kept in the child's record.

Description: Emergency plan

Noncompliance Area: During the renewal inspection on 11/07/24 the emergency plan drill log reviewed did not reflect annual drills. Last drill documented was dated 06/06/23.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Regulation: 3270.107

Description: Refrigerator

Noncompliance Area: During the renewal inspection on 10/31/23 the refrigerator on 2nd floor did not have an operable thermometer.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45° F or below. An operating thermometer shall be placed in the refrigerator.

Regulation: 3270.124(b)(6)

Description: Insurance coverage information

Noncompliance Area: During the renewal inspection on 10/31/23 the emergency contact forms reviewed for child #1, child #2, child #3, child #4 and child #5 did not include health insurance coverage.

Correction Required: Emergency contact information must include health insurance coverage and policy number for a child under a family policy or Medical Assistance benefits, if applicable.

Description: Exam communicable disease/Health assessment, TB test

Noncompliance Area: During the renewal inspection on 10/31/23 the health assessment reviewed for staff #1 did not include confirmation that staff is free from communicable diseases and able to work in childcare setting.

Correction Required: An adult health assessment must include an examination for communicable diseases and the results of that examination. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Regulation: 3270.151(a)

Description: 12 months prior to service and every 24 months thereafter

Noncompliance Area: Two staff person's records did not contain a health assessment completed within the past 24 months.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. Obtain and submit a current up-to-date health assessment for the identified staff persons. Ensure that staff health assessments are completed within the required timeframes as specified in this regulation.

Description: Building Surfaces

Noncompliance Area: The inside ramp on the first floor had frayed and torn surfacing which presented a tripping hazard.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Make necessary repairs. Ensure that surfaces are kept in good repair.

Regulation: 3270.76/3270.80(b)

Description: Building Surfaces/Non-skid surfaces

Noncompliance Area: Several of the inside stairs nonskid carpet squares were either missing or in disrepair.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Inside stairs shall be equipped with nonskid surfaces. Install nonskid surfacing for the steps where they are missing and repair/replace those in disrepair.

Noncompliance Area: The written plan of daily activities was not posted in the 2nd floor group space.

Correction Required: The written plan of daily activities shall be posted in the group space. Post the written plan of daily activities in each child care space.

Noncompliance Area: Two children's records did not contain a signed agreement in accordance with this regulation. (#1 and #2)

Correction Required: An agreement shall be signed by the operator and the parent. Obtain and submit a signed agreement for the indicated children that includes both the operator and parent's signature as specified. Ensure that the parent receives the original and that a copy of the original and subsequent agreements are contained in the child's record. Revise and submit written policies and procedures regarding agreements to ensure that they are completed for all enrolled children.

Noncompliance Area: The agreement in two children's records did not include services to be provided to the family and child. (#1 and #2)

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in 3270.124(f) (relating to emergency contact information). Amend the child's agreement to include this information and submit a written copy of the amended agreement for verification of compliance. Ensure that all children's agreements include services to be provided as specified in this regulation.

Noncompliance Area: One child's agreement did not specify the date of the child's admission. (#3)

Correction Required: An agreement shall specify the date of the child's admission. Specify the date of admission on the child's agreement and submit a copy of the properly completed agreement for verification of compliance. Ensure that all agreements include the date of the child's admission.

Noncompliance Area: Children were observed being cared for in the first floor classroom and their emergency contact information was not present in the classroom.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space. Ensure that emergency contact information is present in all child care spaces in which children are receiving care.

Noncompliance Area: One staff person's records did not contain a health assessment completed within 12 months prior to the date of hire. There was no health assessment in the staff person's record. (#1)

Noncompliance Area: Surfaces in the facility were in need of repair and presented a visible hazard: (1) the door on the 2nd floor was off track and leaning over (2) broken tissue holder in bathroom (3) 1st floor cubby not secured.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Make the necessary repairs and ensure that facility surfaces are kept in good repair and free from visible hazards.

Noncompliance Area: Two children's records contained a health report completed more than 60 days (3 months) following the first day of attendance at the facility. (#1 and #2)

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility. Revise and submit written policies and procedures to ensure that children's initial health reports are completed and provided within the required timeframe as specified in this regulation to ensure ongoing compliance.

Noncompliance Area: The facility's current certificate of compliance was not posted in a conspicuous location used by parents. The posted certificate of compliance expired 1/30/2018.

Correction Required: The facility's current certificate of compliance and a copy of the applicable regulations under which the facility is certified shall be posted in a conspicuous location used by parents, with instructions for contacting the appropriate regional day care office posted at the same location. Post a copy of the facility's current certificate of compliance as specified.

Noncompliance Area: Surfaces in the facility were in need of repair and/or presented a hazard; several window blinds in the upper level windows were in disrepair and the cubby in the main room was not secured and presented a potential hazard.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Replace or repair the window blinds and secure the cubby so that is does not present a hazard.

Noncompliance Area: Staff person #1 has a foreign degree that has not been evaluated by an agency recognized by the US Department of Education.

Correction Required: Training is acceptable when the accrediting agency is recognized by the United States Department of Education or the Council of Postsecondary Accreditation and acceptable to the Department of Education.A facility person's record shall include acceptable verification of experience, education or training is a transcript or a diploma or a letter signed by a representative of the experiential, educational or training entity.

Noncompliance Area: The facility has some emergency contact information written on cards. However, complete emergency contact information ( including parent signatures for 1st aid and emergency medical care) are not in every child care space nor is iot available when children leave the facility for walks or if they had to emergency evacuate.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.When children leave the facility on walking and riding excursions, emergency contact information specific to each child on the excursion shall accompany a staff person on the excursion.

Noncompliance Area: Child #1, a preschooler, last had a physical in their record dated 11/30/15.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.A child`s record shall contain initial and subsequent health reports.
