| 2025-08-06 | Complaints- Legal Location | 3270.113(b) - No physical punishment | Compliant - Finalized |
Regulation: 3270.113(b) Description: No physical punishment Noncompliance Area: Based on interviews, Staff #1 lightly smacked a child's buttocks while in care. Correction Required: A facility person may not use any form of physical punishment, including spanking a child. |
Provider Response: (Contact the State Licensing Office for more information.) The child in question is the owner's son. He was being picked up for the day and the teacher was playing around with him and told him if he didn't listen to his mama she was going to "get his butt". This was in no way a disciplinary action and parent was present. Child was not "in care" when this happened as well as he was signed out for the day. Staff are advised to only play with the child when outside of center time as other people that may see that don't know that it is playful behavior. |

| 2025-08-06 | Complaints- Legal Location | 3270.113(c) - No ridicule or threaten harm | Compliant - Finalized |

Regulation: 3270.113(c) Description: No ridicule or threaten harm Noncompliance Area: Based on interviews, staff have sprayed children in the face using spray bottles. Based on interviews, Staff #1 threw a wet rag at a child and hit the child in the arm. Based on interviews, Staff #1 and #2 threw their shoes at the children for not listening but did not actually hit the children with their shoes. Based on interviews, Staff #1 threw an easy grasp ball at the children to get their attention but did not hit the children with the ball. Based on interviews, Staff #1 and #2 threw pillows and stuffies at the children. Correction Required: A facility person may not single out the child for ridicule, threaten harm to the child or the child's family and may not specifically aim to degrade the child or the child's family. |
Provider Response: (Contact the State Licensing Office for more information.) Our staff play around with the older school age children. The staff did not spray children in the face as a form of punishment. They were spraying children during water play and the children were chasing them around with water bottles as well spraying and playing. Throwing things to get attention has been addressed and will not happen as there are much better ways to get attention. The staff and children throw pillows and stuffies in the format of "pillow fights" as these items do not hurt. All of these things are done in a playful manner and never as a form of discipline. If a child doesn't like it, they say that and they are not involved. Staff have been advised not to play like this as it can be perceived in the wrong way. |
