Violation Observed: Ensure the health, safety, and well-being of the children served. On the day of the inspection a child was observed in a high chair as a form of restraint. When the director designee was asked why the child was in the high chair with nothing to do, she answered because the child was new to the center and was being emotional. Staff were instructed to remove the child and not to use equipment as a form of restraint to regulate/control emotions and behavior issues.

Violation Observed: Ensure that all materials used by the children are age appropriate, non-toxic and safe for use by children. A young toddler was observed in a mega saucer. The child was too big for the piece of equipment and it is not age appropriate. Removed at the time of inspection.

Violation Observed: Ensure that children wash their hands before the intake of food. On the day of the inspection children were observed being given snack without having their hands washed.

Only some of the staff present on the day of the inspection are indicated on the center's staff records checklist. Ensure all staff are listed and that all paperwork is maintained on file.

The children shall be supervised directly by a staff member at all times, including during outdoor activities, rest and sleep, and walking through hallways. Toileting procedures shall be supervised by a staff member as appropriate for the ages and developmental needs of the children.

Violation Observed: Ensure that adequate supervision is maintained at all times throughout the center. On the day of the inspection staff were not adequately supervising children as they were observed drinking from plastic play cups when playing in the water tables. This was observed numerous times.

The center shall ensure that all staff members are trained in the method of keeping track of children and know how many children are in their care at all times.

Violation Observed: Ensure that all staff have completed training pertaining to the center's policies and procedures for tracking children and are aware of the number of children in their care at all times.

The center shall meet the following requirements for orientation training: the center shall ensure that all newly-hired staff receive orientation training within two weeks of hire and that no individual is left alone to supervise a child or group of children until orientation training is completed.

Violation Observed: Ensure that all staff who have not completed the required orientation training are directly supervised by another staff member. On the day of the inspection a named child was alone in the building with a therapist that is not have both background clearances on site. Sponsor indicated that the therapist works for the state, but this could not be verified and is not an exception to the rule. Ensure all persons being left alone with a child has both background clearances on file at the center.

For early childhood programs, the following shall apply for infants (under 18 months of age) and toddlers (18 months to 2½ years of age): a group shall consist of four infants or six toddlers to whom a primary caregiver has been assigned.
