Noncompliance Area: The files for Child #1 and #2 were lacking documentation of the annual flu shot.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: The file for Staff #1 and #2 were lacking the NSOR clearances, and they both contained state police clearances that were more than 60 months old. And Staff #3 had a child abuse clearance that was more than 60 months old.

Correction Required: .LACKING REQUIRED HIRING DOCUMENTS: Facility Person #1 and 2 -- may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 and 2--- may not work in a child care position at the facility.

Noncompliance Area: A protective receptacle cover was missing in a plug in the far room.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: There was a wax warmer that was accessible to the children.

Correction Required: Hot water pipes and other sources of heat exceeding 110 F that are accessible to children shall be equipped with protective guards or shall be insulated to prevent direct contact.

Noncompliance Area: At approximately 10AM on January 23, 2020 an unannounced inspection was conducted, when Certification Representative entered the facility, Staff #1 was alone in the facility with 7 preschool age children and 1 Older Toddler Age Child.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements at 3280.52(b). IF USING TIERED LIS: The required staff:child ratios must be maintained at all times. The legal entity must submit documentation in a format approved by DHS proving that the facility is maintaining the required staff:child ratios at all times. The legal entity will confirm continuing compliance by sending copies of the documentation to the Western Region Office on a weekly basis for a period of three months after DHS approves the documentation format.

Noncompliance Area: The file for Child #1 contained an agreement that was lacking the date of the child's admission.

Correction Required: An agreement shall specify the date of the child's admission.A child's record must contain the dates of application, admission and withdrawal of the child.

Noncompliance Area: The file for Child #3 contained an emergency contact form that was lacking the address of the people designated by the parent to whom the child may be released.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: The files for Child #1 and #2 contained immunization records that were lacking the influenza vaccine.

Correction Required: The facility may not accept or retain an infant 2 months of age or older, a toddler or a preschool child at the facility for more than 60 days following the first day of attendance at the facility unless the parent provides written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of the dates (month, day and year) the child was administered immunizations in accordance with the recommendations of the ACIP.

Noncompliance Area: The file for Staff #1 contained a Child Abuse Clearance dated 4/8/14, making it more than 60 months old.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Noncompliance Area: There were toxic materials in the bottom of the long cupboard in the kitchen. These included windex and dog shampoo.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Noncompliance Area: The written plan of daily activities was not posted in the facility at the time of the visit.

Correction Required: The written plan of daily activities and routines shall be posted in a traffic area used by parents.

Noncompliance Area: While at the facility for over an hour, the children were made to sit and watch tv.

Correction Required: Daily activities shall promote the development of skills, social competence and self-esteem. Daily experiences shall recognize the child as an individual and give some choice of activities that respect personal privacy, lifestyle and cultural background.

Noncompliance Area: While at the facility on March 21, 2019 the two dogs in the house were observed growling and snapping at the children. It was reported that at least one child has been bit by the dogs as well.

Correction Required: A pet or animal present at the facility, indoors or outdoors, shall be in good health and known to be friendly to children.

Noncompliance Area: A child in the facility had been bitten by one of the operators dogs and there were no incident reports completed.

Correction Required: A child's record must contain reports of accidents, injuries and illnesses involving a child in care at the facility. The original report shall be given to the parent on the day of the incident. The second copy of the report shall be retained at the facility in an accident file. The third copy of the report shall be retained at the facility in the child's file.

Noncompliance Area: When Certification Representative entered the facility at 8 am on March 21, 2019, there were 2 staff people with 5 school age children, 5 preschool age children, and 3 young toddlers. This would make it a 1-5 ratio.
