Correction Required: Children's toys and equipment, including furniture and rest equipment, described as hazardous by the United States Consumer Product Safety Commission may not be used by children at the facility and may not be on the premises at the facility. At the time of inspection, the operator shall submit to the Department written affirmation on a form provided by the Department stating that the facility is in compliance with this requirement.

Description: Supervised at all times

Noncompliance Area: On 6-6-25 at approximately 12:20 p.m., there were three children observed sitting at a table that was behind a large pillar in the room. The staff person stated that they were sitting in a chair on the other side of the pillar. From the chair, the staff person was unable to directly see two of the three children due to the pillar obstructing their view.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Description: Age and training

Noncompliance Area: Staff person #2 has not completed the following required pre-service training within 90 days of their date of hire (see LIS code sheet): Pediatric first-aid/CPR training.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10. Until such time as the required training has been completed, staff person #2 must be supervised, when interacting with children, at a minimum by a primary staff person who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #2, staff person #2 may not work in a child-care position at the facility.

Noncompliance Area: On 6-6-25 at approximately 12:20 p.m., staff person #1 named 6 children in their group, including a young toddler, an older toddler, 3 preschoolers, and a school-age child, resulting in staff person #1 being out of ratio.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements at §3280.52(b).

Noncompliance Area: In the bathroom, there was an electrical outlet that lacked an outlet cover and was accessible to children 5 years of age and younger.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: In the kitchen, there were 6 children observed with staff person #1, and there was a stove observed with knobs that were accessible to the children.

Correction Required: Hot water pipes and other sources of heat exceeding 110° F that are accessible to children shall be equipped with protective guards or shall be insulated to prevent direct contact.

Description: Building Surfaces

Noncompliance Area: On the right front and left side of the building, the siding was cracked in multiple areas with sharp edges that were accessible to children. In the kitchen, the door leading to the back hallway of the facility had a small hole in the door.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: Small Toys and Objects

Noncompliance Area: In the main room, there was an empty plastic bag in a drawer near the front desk that was accessible to a young toddler and older toddler who are still placing objects in their mouths and were receiving care in the room.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: In the main room, there were bottles of Germ-X Hand Sanitizer and Bic Cover-it Correction Fluid that were labeled "Keep out of reach of children" and were in a drawer that was accessible to children.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: On 2-8-24 in the main room with staff person #1 supervising child #3, staff person #1 was observed leaving the main room and walking into the kitchen leaving child #3 in the room alone without a staff person present to supervise the child. On 2-8-24, staff person #1 was observed in the main room, and child #3 was observed in the infant/toddler room alone without a staff person present in the room with the child.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Noncompliance Area: On the outdoor play space, there were multiple areas on the wooden fence with splintering, sharp edges, and nails protruding out from the fence that were a visible hazard. On the outdoor play space, there was a white sink basin that was laying on its side with four legs that were protruding out with sharp edges and multiple nails with sharp edges that were accessible to children. On the outdoor play space, there were wooden steps that were accessible to children that led to a door on the second floor above the facility that had a wooden landing 5 steps up from the ground that lacked a railing and was a visible hazard. On the outdoor play space, there was a wooden picnic table with 5 screws on the table with sharp edges that were accessible to children. On the outdoor play space on the back cement wall of the facility, there were cracks in the wall with pieces of cement coming apart from the wall.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: On the outdoor play space, there were multiple areas of peeling paint on the wooden fence.

Noncompliance Area: The facility lacked a policy and procedure to identify the prevention of shaken baby syndrome, abusive head trauma, and child maltreatment to comply with 45 CFR 98.41(a)(1)(vi). The emergency plan lacked requirements for practice drills and continuity of operations according to federal requirements at 45 CFR § 98.41(a)(1)(vii).

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: The file for staff person #1, functioning as a primary staff person, had a high school diploma that upon review was not from an accredited institution and therefore was not acceptable as verification of education to qualify as a primary staff person.

Correction Required: A staff person or a substitute staff person shall meet one of the applicable staff qualifications for the position in which the person is performing. A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Description: Building Surfaces

Noncompliance Area: On the outside of the building, there were multiple areas of splintering wood with sharp edges between the top of the steps and the bottom of the door at the back exit of the building that were accessible to children. On the outdoor play space, there were multiple areas of splintering wood and loose wooden boards on the wooden fence and multiple nails protruding out of the fence in a couple areas that were a potential hazard. On the front and side of the building, the siding was cracked in multiple areas with sharp edges that were accessible to children.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: On the outside of the building, there were multiple areas of peeling paint between the top of the steps and the bottom of the door at the back exit of the building. Noncompliance Area: In the infant/toddler room, the doorway between the infant/toddler room and the kitchen was obstructed by two infant bouncer seats in front of the doorway in the infant/toddler room and a table in front of the doorway in the kitchen.

Correction Required: Stairways, hallways, exits from rooms, exits from the facility and other means of egress serving as an exit shall be unobstructed.
