Noncompliance Area: In the main room, there was a 4moms baby swing that had been recalled by the United States Consumer Product Safety Commission.

Correction Required: Children's toys and equipment, including furniture and rest equipment, described as hazardous by the United States Consumer Product Safety Commission may not be used by children at the facility and may not be on the premises at the facility. At the time of inspection, the operator shall submit to the Department written affirmation on a form provided by the Department stating that the facility is in compliance with this requirement.

Description: Health Information/Initial and subsequent health assessments

Noncompliance Area: The file for child #1 had an initial health assessment that was dated over 60 days after the child's first day of attendance at the facility.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility. A child's record must contain initial and subsequent health reports.

Noncompliance Area: The file for staff person #1 lacked a current health assessment updated within the last 24 months.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Description: Age and training

Noncompliance Area: The file for staff person #1 lacked 5 of the 12 required hours of annual child care training.

Correction Required: A staff person shall obtain an annual 12 clock hours of child care training.

Regulation: 3280.113(a)

Description: Supervised at all times

Noncompliance Area: On 6-6-25 at approximately 12:20 p.m., there were three children observed sitting at a table that was behind a large pillar in the room. The staff person stated that they were sitting in a chair on the other side of the pillar. From the chair, the staff person was unable to directly see two of the three children due to the pillar obstructing their view.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Description: Age and training

Noncompliance Area: Staff person #2 has not completed the following required pre-service training within 90 days of their date of hire (see LIS code sheet): Pediatric first-aid/CPR training.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10. Until such time as the required training has been completed, staff person #2 must be supervised, when interacting with children, at a minimum by a primary staff person who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #2, staff person #2 may not work in a child-care position at the facility.

Description: Mixed age levels

Noncompliance Area: On 6-6-25 at approximately 12:20 p.m., staff person #1 named 6 children in their group, including a young toddler, an older toddler, 3 preschoolers, and a school-age child, resulting in staff person #1 being out of ratio.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements at §3280.52(b).

Description: Protective Outlet Covers 5 yrs. or less

Noncompliance Area: In the bathroom, there was an electrical outlet that lacked an outlet cover and was accessible to children 5 years of age and younger.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Description: Heat Source

Noncompliance Area: In the kitchen, there were 6 children observed with staff person #1, and there was a stove observed with knobs that were accessible to the children.

Correction Required: Hot water pipes and other sources of heat exceeding 110° F that are accessible to children shall be equipped with protective guards or shall be insulated to prevent direct contact.

Description: Building Surfaces

Noncompliance Area: On the right front and left side of the building, the siding was cracked in multiple areas with sharp edges that were accessible to children. In the kitchen, the door leading to the back hallway of the facility had a small hole in the door.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: Small Toys and Objects

Noncompliance Area: In the main room, there was an empty plastic bag in a drawer near the front desk that was accessible to a young toddler and older toddler who are still placing objects in their mouths and were receiving care in the room.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: The file for staff person #1 had a health assessment and tuberculosis screening by the Mantoux method that were dated after providing initial service in a child care setting at the facility.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.
