Description: Infant/Toddler Stimulation

Noncompliance Area: During the complaint investigation conducted on July 2, 2026, Staff Person #1 acknowledged that no activities were being maintained or facilitated for the child during the time of the reported injuries involving other children. Staff Person #1 also acknowledged that no activities were provided while the child was confined to the highchair. The staff member stated that the child would cry and eventually calm herself without additional stimulation or interaction, including being held, rocked, talked to, played with, or carried.

Correction Required: Infants and toddlers shall be provided stimulation by being held, rocked, talked to, played with and carried.

Description: Supervised at all times

Noncompliance Area: During the complaint investigation conducted on July 2, 2026, Staff Person #1 acknowledged that although the children were supervised, staff members were not positioned at the children's level engaging in play during the times when the child sustained injuries, including incidents in which the child was reportedly repeatedly harmed by other children. Staff Person #1 also acknowledged that staff were not aware of some of the injuries as they occurred and stated that some incidents happened quickly.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Description: Restraints prohibited

Noncompliance Area: During the complaint investigation conducted on July 2, 2026, Staff Person #1 acknowledged that the child was placed in a high chair after each injury to allow the child to calm down, to prevent other children from continuing to harm the child, and to prevent the child from tripping and reinjuring themselves.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.

Description: Inpatient hospitalization or ER treatment of child

Noncompliance Area: During the complaint investigation conducted on July 2, 2026, Staff Person #1 acknowledged that the parents did not receive incident reports, phone calls, or information regarding their child's injuries sustained on May 19, 2026, and May 20, 2026. The parents were informed to return to the facility at a later date to pick up the incident report, which had been completed after the initial incidents.

Correction Required: The operator shall immediately notify a child's parent and shall telephone notice to the appropriate regional office within 24 hours if a child in care at the facility is hospitalized or receives emergency room treatment.

Description: Clean and good repair

Noncompliance Area: On 3/24/26, during the renewal inspection, staff and the director acknowledged that there was no outdoor play equipment available for the children.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Description: Services proceeded

Noncompliance Area: On 3/24/26, during the renewal inspection, children #1, #2, #3, and #4 did not have evidence of a child service report in the individual children records.

Correction Required: An agreement shall specify the services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information at § 3280.124(f).

Description: Menus

Noncompliance Area: On 3/24/26, during the renewal inspection, staff acknowledged that snacks are served. There was no evidence of a posted menu, and staff further acknowledged that the snacks provided are not communicated to families on a daily basis.

Correction Required: The operator shall discuss the general menu plan with the parent so that the daily nutritional needs of the child can be met.

Description: Liability Insurance

Noncompliance Area: On 3/24/826, during the renewal inspection, a copy of the comprehensive general liability insurance covering all persons on the premises was not available for the certification representative to verify.

Correction Required: The legal entity shall have comprehensive general liability insurance to cover all persons who are on the premises. A current copy of the insurance policy shall be on file at the facility.

Noncompliance Area: On 3/24/26, during the renewal inspection, children #3 and #4 did not have an updated financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Correction Required: A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Description: Consent for administration of minor first-aid required prior to admission

Noncompliance Area: On 3/24/26, during the renewal inspection, child #4 did not have a signed parental consent for administration of minor first-aid procedures by facility staff on the emergency contact form.

Correction Required: A child's record must contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Noncompliance Area: On 3/24/26, during the renewal inspection, staff person#1 did not have evidence of a two written references in the individual staff records.

Correction Required: A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: On 3/24/26, during the renewal inspection, Staff Person #1 and Staff Person #2 did not have documentation of completed CPR and pediatric first aid certification in their individual staff records

Correction Required: Competence is the completion of training by a professional in the field of first-aid and CPR. All staff persons shall renew their certification in pediatric first-aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. Staff persons shall complete professional development in the topic of pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire.

Noncompliance Area: On 3/24/26, during the renewal inspection, staff person #2 did not have evidence of a DHS FBI clearance in the staff records.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #2 may not work in a childcare position at the facility.

Description: Building Surfaces

Noncompliance Area: On 3/24/26, during the renewal inspection, the certification representative observed that the window frame in the outdoor play space was in a state of disrepair, with components coming apart.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.
