Noncompliance Area: During the renewal inspection conducted on 6/26/2026 observed that the facility's emergency plan did not provide for accommodations for infants, toddlers, children with disabilities, and children with chronic medical conditions. Corrected on-site 6/26/2026.

Correction Required: The facility shall have an emergency plan that provides for accommodations for infants, toddlers, children with disabilities, and children with chronic medical conditions.

Noncompliance Area: During the renewal inspection conducted on 6/26/2026 observed staff person #1, #2, and #3's files did not include verification of childcare experience prior to service at the facility.

Correction Required: An assistant group supervisor shall have a high school diploma or a general educational development certificate and 2 years experience with children. A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Description: Supervised at all times /Staff assigned to specific children

Noncompliance Area: On 12/29/2025, during a complaint investigation, the certification representative conducted a supervision check. During naptime, the certification representative entered the Pre-K classroom and observed five preschool-aged children on cots, with some children awake. No staff person was present in the classroom at the time of entry. After the certification representative asked an awake child where their teacher was, staff person #1 appeared from an adjoining classroom holding cleaning supplies and stated they were supervising the group. The certification representative determined that staff person #1 was supervising children from an adjoining room and was unable to see, hear, direct, or assess the children in the Pre-K classroom. Additionally, during the supervision check, staff person #2 assigned to the Older Toddler group was observed in the hallway on multiple occasions, leaving the group unattended. While in the hallway, staff person #2 was unable to see, hear, direct, or assess the children in care.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in their assigned group. The staff person shall be physically present with the children in their group on the facility premises and on facility excursions off the facility premises. TIERED LIS: 1. Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in their assigned group. The staff person shall be physically present with the children in their group on the facility premises and on facility excursions off the facility premises. This portion of the plan shall have an immediate correction date. 2. The legal entity must arrange for all staff to receive a minimum of three hours of training regarding Supervision/Ratios. The training must be PQAS approved, in-person, and outside of childcare hours. The legal entity must receive DHS approval of the training content prior to scheduling the training. The legal entity must provide a date in which training will be completed.

Noncompliance Area: An unannounced monitoring was conducted on 12/29/2025. At that time, files for all staff present were reviewed for preservice trainings. Staff person #3 was observed to be caring for children unsupervised. Staff person #3 has not completed the following pre- service training required prior to caring for children unsupervised: Pediatric first aid/CPR from a PQAS approved trainer and a PQAS approved curriculum

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre- service trainings are completed, staff person #3 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #3, staff person #3 may not work in a child-care position at the facility.

Noncompliance Area: An unannounced monitoring was conducted on 12/29/2025. At that time, files for all staff present were reviewed for preservice trainings. Staff person #3 has not completed the following required pre-service training within 90 days of their date of hire (see LIS code sheet): Pediatric first-aid/CPR from a PQAS approved trainer and a PQAS approved curriculum:

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10. Until such time as the required training has been completed, staff person #3 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #3, staff person #3 may not work in a child-care position at the facility.

Description: Mixed Age Level

Noncompliance Area: An unannounced monitoring was conducted on 12/29/2025. At that time,, the certification representative conducted a ratio check. During the walkthrough, the certification representative observed staff person #4 alone in the Young Toddler room with six children: two infants and four young toddlers. No additional staff were present in the room.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level). TIERED LIS: 1. This portion of the plan shall have an immediate correction date. 2. Description: Comply with CPSL/CPSL information

Noncompliance Area: Staff person #1 did not update their NSOR clearance within 60 months. The original NSOR clearance was dated 1/16/20 and the updated clearance is dated 5/29/25.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. The CPSL was revised on 9/18/2018 to include a requirement that all clearances be updated and on file at least every 60 months. The Child Protective Services Law (CPSL) was revised to include the requirement for the National Sex Offender Registry (NSOR) Clearance effective 9/30/2019. The CPSL also states that anyone hired after 9/30/19 was required to have the NSOR clearance to work in childcare. Current staff must have the NSOR clearance no later 7/1/20. CPSL was revised to include new hires that have resided out of Pennsylvania with in the 5 previous years must obtain State Police and Child abuse clearances from the state that they have resided.

Noncompliance Area: There is no health assessment on file for Staff person #1. There is only one written non-family reference on file for Staff person #1.

Correction Required: A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis. A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person.

Noncompliance Area: The emergency contact form for Child #1 does not include the parent's work address or work telephone number; it also does not include the physician's phone number.

Correction Required: Emergency contact information must include the name, address and telephone number of the child's physician or source of medical care. Emergency contact information must include the home and work addresses and telephone numbers of the enrolling parent.

Description: Written emergency plan posted

Noncompliance Area: The facility does not have a written plan identifying the means of transporting a child to emergency care & staffing provisions in the event of an emergency.

Correction Required: A written plan identifying the means of transporting a child to emergency care and staffing provisions in the event of an emergency shall be displayed conspicuously in every child care space and shall accompany a staff person who leaves on an excursion with children.

Description: 12 months prior to service and every 24 months thereafter

Noncompliance Area: Staff person #1 did not obtain a health assessment, including TB screening prior to starting at the facility.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: Staff person #1 started at the facility on 5/20/24 and their NSOR clearance is dated 7/26/24. There is no proof that staff person #1 applied for an NSOR clearance prior to starting at the facility. The date of application for the NSOR clearance is 7/19/24. Staff person #2 does not have a completed criminal clearance. The criminal clearance on file states that it is "under review".
