Description: Outdoor equip.- protective surfacing

Noncompliance Area: A renewal inspection was conducted 7/17/26. At that time, there was only eight inches of mulch under the swings on the wood mulch side of the playground. The infant/toddler side of the playground where the swings, jungle gym with slide, and the caterpillar tunnel are embedded contains a layer of adhesive sprayed rubber mulch. The layer of rubber mulch is approximately one inch thick.

Correction Required: Outdoor equipment that requires embedded mounting must be mounted over a loose-fill or unitary playground protective surface covering that meets the recommendations of the United States Consumer Product Safety Commission. The equipment must be anchored firmly and be in good repair. TIERED LIS: 1. The swings on the mulched side of the playground must be made inaccessible and will not be used by the children. The swings, jungle gym with slide, and the caterpillar tunnel on the side of the playground with adhesive sprayed rubber mulch must be made inaccessible and will not be used by the children. This portion of the plan shall have an immediate correction date. 2. The swings on the mulched side of the playground must not be used by the children until such time as the loose-fill impact-absorbing material meets the recommendations of the United States Consumer Product Safety Commission. For this piece of equipment, there needs to be at least 9 inches of wood mulch under the equipment. The swings, jungle gym with slide, and the caterpillar tunnel on the side of the playground with adhesive sprayed rubber mulch must not be used by the children until such time as the loose-fill impact-absorbing material meets the recommendations of the United States Consumer Product Safety Commission. This portion of the plan shall have a correction date when he loose-fill impact-absorbing material meets the recommendations of the United States Consumer Product Safety Commission.

Description: Each child emergency contact person/Parent home/work address, phone

Noncompliance Area: A renewal inspection was conducted 7/17/26. At that time, the child files were reviewed. The emergency contact form for Child #3 did not include the work phone number of the child's father. The emergency contact form for Child #4 did not include the work name, address, and phone number of the child's parents or the phone number of the emergency contact person.

Correction Required: Emergency contact information is required for each enrolled child. Emergency contact information must reference who shall be contacted in an emergency. Emergency contact information must include the home and work addresses and telephone numbers of the enrolling parent.

Description: Physician name, address, phone

Noncompliance Area: A renewal inspection was conducted 7/17/26. At that time, the child files were reviewed. The emergency contact forms for the following children did not include the name, address, or phone number of the child's physician: Child #1, Child #2, Child #3, Child #4, and Child #5.

Correction Required: Emergency contact information must include the name, address and telephone number of the child's physician or source of medical care.

Description: Disposable diapers

Noncompliance Area: A renewal inspection was conducted 7/17/26. At that time, the trash can in the bathroom used for diapering was not lidded nor was it hands-free.

Correction Required: If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can.

Description: Manufacturer's instructions used

Noncompliance Area: A renewal inspection was conducted 7/17/26. At that time, there was no instruction manual for the booster seat in the van used for transportation by the facility.

Correction Required: Manufacturers' instructions for use of safety restraints shall be kept in the vehicle at all times.

Description: Emergency plan/Letter to parents

Noncompliance Area: A renewal inspection was conducted 7/17/26. At that time, the emergency plan was reviewed. The emergency plan and corresponding parent letter did not include accommodations for the infants, toddlers, and special needs children in the facility.

Correction Required: The facility shall have an emergency plan that provides for accommodations for infants, toddlers, children with disabilities, and children with chronic medical conditions. The operator shall provide to the parent of each enrolled child a letter explaining the emergency procedures. The operator shall also provide to the parent of each enrolled child a letter explaining any subsequent update to the plan.

Description: Age and Training

Noncompliance Area: A renewal inspection was conducted 7/17/26. At that time, the staff files were reviewed. Staff person #1 did not complete 12 hours of annual training during their training year from 12/19/24-12/19/25. Staff person #1 only completed 10 hours of annual training.

Correction Required: A staff person shall obtain an annual minimum of 12 clock hours of child care training. Staff person #1 must take 2 hours of professional development to fulfill requirement for training year 12/19/24-12/19/25. Hours used to fulfill training year 12/19/24-12/19/25 may not be used to fulfill current training year.

Description: Comply with CPSL/CPSL information

Noncompliance Area: A renewal inspection was conducted 7/17/26. At that time, the staff files were reviewed. Staff person #2 did not have a current DHS FBI Clearance on file. The most recent DHS FBI Clearance was dated 8/7/20, more than 60 months old. The staff did have an FBI Clearance dated 11/13/24 conducted through the Department of Education, which is not acceptable for employment in child care.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff Person #1 may not work in a child care position at the facility until a current DHS FBI Clearance is on file.

Regulation: 3270.66(b)

Description: Original container

Noncompliance Area: A renewal inspection was conducted 7/17/26. At that time, an unlabeled bottle of cleaning solution was observed in the first room on the left and second room on the right.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be stored away from food, food preparation areas and child care spaces.

Description: Building Surfaces

Noncompliance Area: A renewal inspection was conducted 7/17/26. At that time, the boardwalk on the playground is showing signs of deterioration, with splintering wood along the edges. Sharp nettles were observed growing up through the mulch on the playground and covering a large portion of the mulched area.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: Devices must be compliant/Director or designated staff person ensure compliance

Noncompliance Area: A renewal inspection was conducted 7/17/26. At that time, the thirty day testing log of the fire detection system was reviewed. The testing was not completed at least every 30 days on 7 occasions in the past year. The dates of the testing were 7/7/25, 8/13/25, 9/10/25, 10/17/25, 11/18/25, 12/23/25, 1/27/26, 2/10/26, 3/17/26, 4/22/26, 5/20/26, and 6/19/26.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Description: Locked or inaccessible

Noncompliance Area: During an allocated unannounced monitoring visit, there was Desitin diaper cream in an unlocked cabinet under the changing table in the Toddler room.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Description: No portable space heaters

Noncompliance Area: During an allocated unannounced visit, there was a space heater in an empty classroom and in the office.

Correction Required: Portable space heaters are not permitted.

Regulation: 3270.32(a)/3270.192(4)

Description: Comply with CPSL/CPSL information

Noncompliance Area: Staff person #1 has not updated their clearances in the last 60 months. Their child abuse clearance is dated 6/23/20. Their criminal clearance is dated 6/16.20. Their FBI clearance is dated 6/27/20. Their NSOR clearance is 1/17/20. Staff person #2 and staff person #2 did not update their NSOR clearances within 60 months. The original NSOR clearance for staff person #1 is dated 1/16/20 and it was not updated until 7/1/25. The original NSOR clearance for staff person #2 is dated 1/16/20 and it was not updated until 6/30/25.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. Facility person #1 will not work at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. The CPSL was revised on 9/18/2018 to include a requirement that all clearances be updated and on file at least every 60 months. The Child Protective Services Law (CPSL) was revised to include the requirement for the National Sex Offender Registry (NSOR) Clearance effective 9/30/2019. The CPSL also states that anyone hired after 9/30/19 was required to have the NSOR clearance to work in childcare. Current staff must have the NSOR clearance no later 7/1/20. CPSL was revised to include new hires that have resided out of Pennsylvania with in the 5 previous years must obtain State Police and Child abuse clearances from the state that they have resided. Facility person #1 will not work at the facility.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Noncompliance Area: Only one staff member completed the 2022 one-hour health and safety training update by 12/30/22. All other staff members completed it between 2/1/23 and 3/1/23.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10.

Noncompliance Area: Child #1 has was enrolled more than 60 days before the facility had a health report on file.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Noncompliance Area: There is no daily schedule posted in the Infant Room

Correction Required: The written plan of daily activities shall be posted in the group space.

Noncompliance Area: Staff person #1 did not have her child abuse or state police clearances updated within 60 months as required by the CPSL. The previous state police clearance for staff person #1 was dated3/24/15 and it wasn't updated until 6/15/20 The previous child abuse clearance for staff person #1 was dated 3/16/15, and it was not updated until 6/23/15..

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). .A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: Staff person #1 has one written, non-family reference

Correction Required: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person

Noncompliance Area: The nap mats in the young toddler room and the toddler room are torn, resulting in exposed foam

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: There isn't two feet of space on three sides of the cribs in the infant room while they are in use

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Noncompliance Area: Child #1 had a prescription medication, Cetrizine, in her pocket. Staff was not aware that child had the medication.

Correction Required: Medication shall be stored in a locked area of the facility or in an area that is out of the reach of children.

Noncompliance Area: There is no medication log for Child#1's Cetirizine.

Correction Required: An operator is responsible to establish and maintain a medication log if prescription or nonprescription medication is administered.

Noncompliance Area: There are two water stained ceiling tiles and peeling wallpaper in the toddler room. There is a water stained ceiling tile in the school age #1 bathroom as well as two small holes in the wall. There is a water stained ceiling tile in the school age #2 room. There are water stained ceiling tiles at the bottom of the stairs to the lower level of the facility.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: There is peeling plaster & damaged plaster to the left of the emergency exit in the school age room. There is peeling paint to the right of the vent in the preschool room.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: There are two small holes in in the wall behind the toilet in the Toddler bathroom. There are ceiling tiles that are stained from previous water damage in the Toddler Room. The carpet is frayed in the Preschool room.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: In the preschool room, there was plastic bin containing crayons that was broken, causing sharp edges.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: One of the mats in the in the preschool room was torn.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child`s parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: In the 1st room on the left across from the office, there was a small hole in the bathroom wall from the door knob hitting it.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility`s outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.
