Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: On 2/10/22, at approximately 3:25 PM, two young schoolagers entered the preschool room after school dismissal. There was no staff present in the preschool room to supervise the children. An adult employed by the school observed this from the hallway, and stepped into the classroom to be present with the children while child care staff were alerted and until Facility Person #3 went into to the classroom to supervise the children. The children were unsupervised by child care staff for approximately 1-2 minutes.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30.

Noncompliance Area: At approximately 3:20 PM in the Pre-K room, Facility Persons #1 and #2 were supervising 10 preschoolers. Facility Person #1 claimed responsibility for 5 of the children. Facility Person #2 stated she was unsure of which children were in her group at the time.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Noncompliance Area: The fire drill log indicates fire drills were conducted on 1/24/19 and 3/29/19, with no fire drill in between.

Correction Required: A fire drill shall be held at least every 60 days. Facility persons and children in attendance shall participate in the fire drill. Facility persons and children shall exit the building, weather permitting.

Noncompliance Area: The agreements on file for children #1 and #2 did not specify the admission dates.

Correction Required: An agreement shall specify the date of the child's admission.

Noncompliance Area: On the afternoon of 8/31/18, Facility Persons #1 and #2 were supervising a mixed age group of 17 preschoolers and young schoolagers. According to staff statements, while Facility Person #1 was talking with a parent at pick-up and Facility Person #2 was working with a small group of children at a table, Facility Person #1 noticed Child #1, a young schoolager, and Child #2, a preschooler, standing behind a shelf, approximately 2 feet in height. The wheeled shelving unit had been turned towards a wall and a large pillow had been placed on the shelf. Facility Person #1 approached the children and saw that Child #2's hand was in the waistband of Child #1.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Noncompliance Area: There were two unlabeled medications in the preschool room - an ibuprofen and an allergy medication.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container.

Noncompliance Area: There were three children that were observed eating snack without washing their hands prior.

Correction Required: A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered.

Noncompliance Area: The health assessments for Facility Person #2 and #3 and the TB tests for Facility Persons #1, #2 and #3 were completed after their start dates

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.

The child file for child #3 and #5 contained a financial agreement form that was not reviewed and updated by the parents every 6 months. The dates on the financial agreement form for child #3 were 8/18/15 and 4/8/16. The dates on the financial agreement form for child #5 were 8/16/15 and 3/30/16. The child file for child #4 contained an emergency contact information form that was not reviewed and updated by the parents every 6 months. The dates on the emergency contact information form for child #4 were 8/11/15 and 4/11/16.

Correction Required: A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: The staff file for staff person #1 lacked a valid State Police clearance. Only the invoice was on file.
