Noncompliance Area: Staff 1 did perform a diaper change during the renewal inspection. Staff 1 did not wash the child's hands after diapering. Staff 1 did express concerns about being able to appropriately supervise the children during handwashing due to the sink being out of sight of the children and she was by herself with the children.

Correction Required: A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered. Legal entity will develop a handwashing policy and review the policy will all staff.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in child care group settings). Child #1 must be dismissed from care by close of business 4/8/2024 and may only return to care when the immunization record is updated or when a parent provides a written, signed exemption letter.

Noncompliance Area: During renewal inspection, health assessment on file for staff person #1 was dated 12/20/2023. Physician's office was contacted using the phone number on the health assessment. Health assessment was sent to the physician's office. Physician listed on form states that the signature on the form is not theirs. Furthermore, staff person #1 was not seen at the office listed on the date listed on health assessment.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Staff person #2 identified 6 children as being in their group. Certification representative asked that staff persons figure out their groups, as one child is unaccounted for. It was then determined that staff person #1 had 5 children in their group and staff person #2 had 6 children in their group.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre-service trainings are completed, staff person #1 must be supervised, when interacting with children, by an AGS who has completed the required training related to this citation. If there are no staff person(s) available to supervise staff person #1, staff person #1 may not work in a child-care position at the facility.

It was then decided that staff person #1 had the two children she originally named, totaling 8 young-school aged children, and staff person #2 had 10 preschool-aged children in her group. Prior to rep departing, both staff members were able to correctly name their groups.

Noncompliance Area: On date of investigation, there were 41 children present in the facility. There were 16 combination of younger- and older-school-age children, 10 preschool-aged children, 5 younger toddlers, 6 older toddlers, and 4 infants. Facility ordered 6 pizzas, totaling 48 slices of pizza. Facility served one slice of pizza and a milk to each child for lunch. Based on the number of children present in the facility and the ages of the children, meal servings were not appropriate.

Correction Required: Food servings shall be portioned suitably for the size and age of the children in care. Additional food in reasonable amounts shall be made available to children upon the request of the parent or child.

Description: Mixed Age Level

Noncompliance Area: During unannounced monitoring conducted 8/2/2023, facility person #3 left a group of 8 older school aged children in the multipurpose room with 18 other children, ranging from preschool-aged to young school aged children and two staff members, totaling 26 children with two staff members present in the multipurpose room.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

When certification representative returned for verification visit on 4/11/2023, fabric freshener, Ajax, and room spray labeled "Keep out of reach of children" were observed in an unlocked cabinet in the bathroom used by children between the Cocoon and Caterpillar rooms.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Noncompliance Area: Staff person #4 pled guilty to a crime of criminal conspiracy robbery for an offense that took place on May 17, 2021. This crime is a felony with a grade of F1.

Correction Required: A staff person who has been convicted of a felony/felonies may not work in the facility. The Department will review and may deny, refuse to renew or revoke a certificate of compliance if a legal entity, owner, operator or staff person has been convicted of a felony. The operator may not allow an individual to enter the facility if the operator knows that the individual has been convicted or is awaiting trial on charges involving a crime of child abuse, child neglect, physical violence or moral corruptness. Staff person #4. who has been convicted of a felony, may not work in or enter the facility.

Child # 3 DOB 7/17/15 has attended the facility since 3/20/17 and only has 1 child service report on file from 10/30/19.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in 3270.124(f) (relating to emergency contact information).

Noncompliance Area: There is unlabeled, expired Parents choice diaper rash ointment in the caterpillar classroom changing table basket. The ointment expired 11/2019.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container. Medication shall be stored in accordance with the manufacturer's or health professional's instructions on the original label.
