Description: Locked or inaccessible

Noncompliance Area: At the time of the inspection, there was a can of aerosol Barbasol shaving cream that was accessible to children on the counter in the toddler room.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Regulation: 3270.102(a)

Description: Clean and good repair

Noncompliance Area: At the time of the inspection on 7/9/25, a yellow plastic-molded seat for the table used in the infant room was cracked and posed a pinch point.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Regulation: 3270.113(a)(1)/3270.113(a)(2)

Description: Staff assigned to specific children/Supervision on and facility premises

Noncompliance Area: At the time of the inspection on 7/9/25, the certification representative asked staff person #5 who was in their care. Staff person #5 then named 12 preschool aged children that were assigned to them. Staff person #5 acknowledged that they should have only been assigned ten children, based upon the age and staff:child ratios.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. The requirement for supervision on and off the facility premises includes compliance with the staff:child ratio requirements in §§ 3270.51--3270.55. Tiered LIS: 1.) Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. The requirement for supervision on and off the facility premises includes compliance with the staff:child ratio requirements in §§ 3270.51--3270.55. This portion of the plan requires an immediate correction date. 2.) The legal entity must develop or update written supervision policy and ratio procedures to be implemented in the facility. The written policy/procedures must address the requirements for 3270.113(a)(1) and 3270.113(a)(2) as follows: 1. Procedures for assigning children to individual staff in the classroom. 2. Procedures to include that the maximum number of children assigned to an individual staff person will not exceed the appropriate staff:child ratios based on the youngest child in the assigned group. 3. Procedures to be followed when the ratio for a supervision group is about to be exceeded, such as designating children to other staff in the room or bringing in other staff members so all children can be assigned appropriately within the staff:child ratios. The legal entity will submit the updated policy/procedures to the Northeast Regional Office for approval. Once approved, all existing staff and new hires must be trained on the approved policies and procedures and it must be documented at the facility. This date of correction will be when acceptable updated policies and procedures are submitted.

Regulation: 3270.134(a)/3270.152

Description: Child's hands washed/Adult Hygiene

Noncompliance Area: At the time of the inspection on 7/9/25, staff person #4 did not wash their hands or the hands after child #1 was diapered. The child was placed directly into a pack and play after diapering.

Correction Required: A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered. A facility person shall wash his hands before meals and snacks, and after toileting and after diapering a child.

Regulation: 3270.14/3270.21

Description: Pertinent Laws & Regulations/General Health and Safety

Noncompliance Area: During the inspection on 7/9/25, staff person #1 was observed to be caring for children unsupervised. Staff person #1 has not completed the following pre- service training required prior to caring for children unsupervised: Pediatric First Aid/CPR training and health and safety training.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre- service trainings are completed, staff person #1 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #1, staff person #1 may not work in a child-care position at the facility.

Regulation: 3270.21/3270.104(a)

Description: General Health and Safety/Clean, good repair, proper size

Noncompliance Area: At the time of the inspection on 7/9/25, an infant was observed in a Fisher Price Infant to Toddler Rocker, which was placed on top of a table, in the infant room. The manufacturer warnings for this piece of equipment state: "Fall Hazard: Always place rocker on floor. Never use on any elevated surface."

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children. Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

Regulation: 3270.25(a)

Description: Availability of certificate of compliance and applicable regulations

Noncompliance Area: At the time of the inspection on 7/9/25, the facility's current certificate of compliance was not posted. The certificate of compliance that was posted had an expiration date of 3/12/25.

Correction Required: The facility's current certificate of compliance shall be posted in a conspicuous location used by parents. The operator shall provide the parent of each child enrolled with information on how to access the regulations in this chapter electronically and with instructions for contacting the appropriate regional child care office.

Regulation: 3270.31(f)

Description: Health and Safety Training

Noncompliance Area: At the time of the inspection, staff person #2 has not completed the following required pre- service training within 90 days of their date of hire (see LIS code sheet): health and safety training requirements.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-9. Until such time as the required training has been completed, staff person #2 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #2, staff person #2 may not work in a child-care position at the facility

Regulation: 3270.32(a)/3270.192(4)

Description: Comply with CPSL/CPSL information

Noncompliance Area: At the time of the inspection, staff persons #1, #2 and #3 did not have a signed disclosure statement on file. Staff person #3 was not hired correctly as a provisional hire and did not have a completed NSOR on file. Staff person #3 has had direct contact and routine interaction with children (see LIS code sheet for date of hire).

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff person #3 will not work in a child care position with direct contact and routine interaction with children until the NSOR certificate is on file at the facility.

Regulation: 3270.37(c)

Description: Aides supervised all times

Noncompliance Area: At the time of the inspection on 7/9/25, staff person #1, an aide, was observed working unsupervised in the school-age room with 4 school-aged children.

Correction Required: An aide or a combination of aides shall be supervised at all times by a staff person qualified at minimum as an assistant group supervisor.

Regulation: 3270.52

Description: Mixed Age Level

Noncompliance Area: At the time of the inspection on 7/9/25, at 9:40am, staff person #4 was the only staff person in the room with 5 children (3 infants, 1 young toddler and one older toddler). The ages and number of children requires there to be two staff present at all times.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level). Tiered LIS: 1.) The required staff:child ratios must be maintained at all times. This portion of the plan shall have an immediate correction date. 2.) The legal entity must arrange for all facility staff to receive a minimum of three hours of PQAS-approved in-person training regarding Ratios and Supervision of Children. This training must be completed as a live training or in-person training. All staff employed by the date of the training shall take the training. The legal entity must receive DHS approval of the training content prior to scheduling the training. The operator shall provide a date for when the training will be completed.

Regulation: 3270.67(d)

Description: Contaminated trash in closed plastic-lined receptacle

Noncompliance Area: At the time of the inspection on 7/9/25, the trash can in the preschool room did not contain a lid and used tissues were observed in the can.

Correction Required: Trash that has been contaminated by human secretions or excrement shall be contained in closed, plastic-lined receptacles.

Regulation: 3270.76

Description: Building Surfaces

Noncompliance Area: At the time of the inspection on 7/9/25, in the play space's poured in place surfacing, the surfacing was cracked and flaking away causing divots where it posed a tripping hazard to both staff and children.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.
