Description: Mixed Age Level

Noncompliance Area: In Room 3, at approximately 10:40am, one staff and six children of mixed ages (1 infant, 1 young toddler, 3 older toddlers and 1 older school age child) were observed. Therefore, the staff: child ratio was exceeded by two children.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Description: Insurance coverage information

Noncompliance Area: The child file for Child #2 was observed to contain a current emergency contact information form that lacked the health insurance name and policy number.

Correction Required: Emergency contact information must include health insurance coverage and policy number for a child under a family policy or Medical Assistance benefits, if applicable.

Noncompliance Area: The child file for Child #1 was observed to contain a current emergency contact information form that lacked the address for one of the designated release persons listed.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Description: Name on bottle

Noncompliance Area: In Room 4 (Toddler Room) a bottle of children's Motrin that was stored on the top shelf of a wooden bookshelf unit was observed to lack the name of the child whom the medication is intended for.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container.

Description: 12 months prior to service and every 24 months thereafter/Health assessment, TB test

Noncompliance Area: The staff file for Staff person #7, contained a current health assessment dated 9/16/25 which was conducted more than 24 months from the previously dated 6/1/23 health assessment on file. The staff file for Staff person #8, contained a current health assessment dated 6/5/25 which was conducted more than 24 months from the previously dated 5/4/23 health assessment on file.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Description: General Health and Safety

Noncompliance Area: In Room 4 (Toddler Room) in the top pink drawer of a 10-drawer rainbow rolling cart was a pair of adult scissors accessible to the toddlers in care.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Description: Comply with CPSL

Noncompliance Area: The staff file for Staff person #3 contained current mandated reporter training dated 9/4/25 which was not renewed within 60 months from the previously existing mandated reporter certificate dated 8/11/20. The staff file for Staff person #6 contained current mandated reporter training dated 8/29/25 which was not renewed within 60 months from the previously existing mandated reporter certificate dated7/25/20.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Description: Comply with CPSL/CPSL information

Noncompliance Area: The staff file for Staff person #1, Staff person #2, Staff person #6, and Staff person #9 contained a current National Sex Offender Register (NSOR) check dated 3/12/25 which was not renewed within 60 months of the previously dated 2/21/20 NSOR check expiring. The staff file for Staff person #5 contained a current NSOR check dated 3/11/25 which was not renewed within 60 months of the previously dated 2/21/20 NSOR check expiring. The staff file for Staff person #3 contained a current NSOR check dated 4/2/25 and a current Child Abuse clearance dated 9/17/25 both of which were not renewed within 60 months of the previously dated 2/21/20 NSOR check and 7/17/20 Child Abuse clearance expiring. The staff file for Staff person #4 (See IS Code Sheet) was observed to contain a disclosure statement dated 8/21/25 that was not signed at time of hire per the Child Protective Service Law (CPSL). The staff file for Staff person #9 contained a current Child Abuse clearance dated 9/7/25 and a current State Police clearance dated 9/12/25 both of which were not renewed within 60 months of the previously dated 7/30/20 Child Abuse and 7/25/20 State Police clearances expiring.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Regulation: 3270.66(a)

Description: Locked or inaccessible

Noncompliance Area: In Room 4 (Toddler Room) a Dermasil Aloe Fresh body lotion labeled, 'Keep Out of Reach of Children' was observed stored inside a canvas storage cube in the bottom right corner of shelving unit that is accessible to the toddlers in care.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Regulation: 3270.72(d)

Description: Above ground window opening restricted to 6"

Noncompliance Area: On the second floor, in the School Age room, two windows located inside the bathroom, which are accessible to children in care, were observed to not be restricted and able to open more than 6 inches.

Correction Required: Windows or doors above the ground floor that open directly to the outdoors and are accessible to children shall be constructed, modified or adapted to limit the opening to 6 or fewer inches.

Regulation: 3270.95(a)/3270.95(b)

Description: Devices must be compliant/Director or designated staff person ensure compliance

Noncompliance Area: Upon review of the facility's 30-day fire testing documentation, the following tests were observed to have been conducted more than 30 days apart: 3/5/25 to 4/5/25 (31 days), 5/30/25 to 7/3/25 (34 days), and 7/3/25 to 8/3/25 (31 days).

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Regulation: 3270.102(e)

Description: Infant/toddler - no material less than 1 inch

Noncompliance Area: The fence to the right of the outdoor playground was observed to have fallen down allowing the area of mulch to be accessible to the infants and toddler who use the outdoor play space.

Correction Required: Pea gravel and other materials with a diameter of less than 1 inch may not be used in spaces where infants or toddlers receive care.

Regulation: 3270.134(a)

Description: Child's hands washed

Noncompliance Area: At approximately 1:00pm in Room 1, after an observed diaper change, Staff person #1 failed to ensure the child's hands were washed before they returned to their resting mat.

Correction Required: A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered.

Regulation: 3270.135(a)(3)

Description: Disposable diapers

Noncompliance Area: At approximately 1:00pm in Room 1, after an observed diaper change, Staff person #1 was observed to not immediately discard the soiled pull up into a plastic-lined, hands-free covered can until completing the diaper change. The plastic lined covered can used to discard the soiled pull up was not hands free.

Correction Required: If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can.

Regulation: 3270.135(b)

Description: Surfaces cleaned

Noncompliance Area: At approximately 1:00pm in Room 1, Staff person #1 was observed changing a child's soiled pull up on the carpeted floor without a pad or surface covering.

Correction Required: Diaper changing surfaces shall be cleaned after each use by wiping the surface with a sanitizing solution or by changing a pad or other surface covering.
