Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child. A child's record shall contain initial and subsequent health reports.

Noncompliance Area: In the Young Toddler Room one Pack n Play Playard was observed to lack the child's name. In the 3's and 4's Room, four mats were observed to lack the names the children who use them.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Noncompliance Area: In the downstairs bathroom 3 ceiling tiles near the light fixture were observed to not be kept clean as evidence by having water spots from a previous leak that has since been repaired.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Correction Required: A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in child care group settings). Child(ren) #2 must be dismissed from care by close of business and may only return to care when the immunization record is updated or when a parent provides a written, signed exemption letter.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: At approximately 11:00 am, there were two staff present in the Upstairs classroom with 18 preschool aged children. Staff stated there were two groups of children. The first group of 10 preschool children were all named. The second group of 8 were in the assigned group of Staff #5. Staff #5 stated that she did have 8 children in her assigned group, but was only able to name 7 children, leaving one children unnamed.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Correction Required: Staff persons shall complete professional development in the following topics within 90 days of hire: (1) Prevention and control of infectious diseases (including immunization); (2) Prevention of Sudden Infant Death Syndrome and use of safe sleep practices; (3) Administration of medication, consistent with standards for parental consent; (4) Prevention of and response to emergencies due to food and allergic reactions; (5) Building and physical premises safety, including identification of and protection from hazards that can cause bodily injury such as electrical hazards, bodies of water, and vehicular traffic; (6) Prevention of shaken baby syndrome and abusive head trauma; (7) Emergency preparedness and response planning for emergencies resulting from a natural disaster or a man-caused event (such as violence at a child care facility); (8) Handling and storage of hazardous materials and appropriate disposal of bio contaminants; (9) Precautions when transporting children.

Noncompliance Area: The file for Staff #2 contained mandated reporter training that was not completed within 60 months of the previous training; 6/3/15 and 7/16/20.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Noncompliance Area: The file for Staff #4 lacked FBI fingerprinting request prior to their first day caring for children and therefore was incorrectly provisionally hired.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: Observed the documented smoke detection log revealed that the facility has not been testing the system regularly every 30 days. There were gaps in testing including 12/2/20-1/4/21, 5/20/21-6/21/21, and 7/2/21-8/17/21.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)).The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Noncompliance Area: Child file #1 lacked written verification of Hepatitis B, MMR, Varicella and Hepatitis A vaccinations according to the ACIP.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: Staff file #1 contained health assessments dated 9/26/16 and 12/3/18 which exceeded the required 24 months of service at the facility.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: The emergency plan did not provide for a method to notify parents when an emergency arises and when the emergency has ended.

Correction Required: The facility shall have an emergency plan that provides for a method for facility persons to contact parents as soon as reasonably possible when an emergency situation arises. The facility shall have an emergency plan that provides for a method for facility persons to inform parents that the emergency has ended and to provide instruction as to how parents can safely be reunited with their children.

Noncompliance Area: The first aid kit in the nap room downstairs lacked assorted band aids. The first aid kit in the middle room downstairs and the preschool room upstairs both lacked tweezers.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.

Noncompliance Area: Observed three infant toys which contained objects with diameters of less that one inch with lids that were not permanently sealed and which were accessible to children n the infant room.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: Observed an unlabeled Pack n Play in the infant room. The Pack n Play is used by a child in care.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: The file for child #1 contains health reports which were updated in an interval greater than 12 months. Child #1 is a preschool aged child.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Noncompliance Area: The file for staff person #1, #2 and #3 contains health assessments which were updated in an interval which exceeds 24 months.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: Observed a loose-fitting crib sheet on a crib mattress used by children in care in the infant room which poses a suffocation hazard.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: A play kitchen located in the upstairs Pre-school Room was missing a door leaving two exposed hinges, that were very sharp, The cubbies located on the wall where the fishbowl is painted are not anchored making them unsteady. There were two sharp L brackets sticking out from a shelving unit, located in the Pre-school room, that were sharp, posing a hazard to the children.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: During naptime one child was moved to the far end of the room, out of the vision of the staff.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Noncompliance Area: A bottle of apple juice, located in a Doggie Lunch bag, was not kept in the refrigerator per manufacturer's suggestion.

Correction Required: Food stored, prepared or served shall be clean, wholesome, free from spoilage, free from adulteration and safe for human consumption.
