Noncompliance Area: The covering on the soft furnishings in the toddler area on the lower floor were split exposing the foam. The paint on the crib in the young toddler room was scraped off exposing the bare wood.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: Staff #1 did not complete Pediatric 1st Aid/CPR prior to the expiration of the previous training. Staff #1 completed Pediatric 1st Aid/CPR on 2/26/23 with an expiration date of 2/2025. The next Pediatric 1st Aid/CPR was taken 8/30/25.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Description: Building Surfaces

Noncompliance Area: The fence between the big playground and the small playground was not attached and sitting in the play area. There were exposed screws in the wall above the children's soft sofa in the library area of the second floor classroom.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: Supervised at all times /Staff assigned to specific children

Noncompliance Area: On 4/29/26 at approximately 10:00am, Staff #1 arrived to take over the child care duties in the classroom. Shortly after arriving, Staff #1 began lining the children up to take them outside. At that time, it was discovered that child #1, who was now being supervised by staff #1, opened the gate of the second-floor classroom, went down the stairs, and exited the door to the driveway and attached parking lot of the business next door. The child ran onto Penn Ave before a customer at the store next door retrieved him and returned him to the facility.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. TIERED LIS: 1. Children must be supervised at all times and staff shall be physically present with the children in their group on the facility premises and on facility excursions off the facility premises. This portion of the plan must have an immediate correction date. 2. The legal entity must arrange for all facility staff to receive a minimum of two hours of training regarding supervision of children. The legal entity must receive DHS approval of the training content prior to scheduling the training. The operator shall provide a date for when this training will be completed. 3. The Certification Representative will conduct unannounced monitoring visits over the next three months. During this time period the facility shall have no occurrences of non-compliance relating to supervision. The correction date for this portion of the plan shall be no sooner than 8/7/26.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Description: Pick-up and drop-off at specified areas

Noncompliance Area: Parents were observed dropping children off by pulling up to the side of the school age building, letting kids out of the car to ring the facility doorbell to be let into the building. This is in conflict with the stated policy for parents to park and bring the children into the facility.

Correction Required: Children shall be picked up and discharged only at locations specified by the facility as safe locations.

Description: Towels labeled and laundered

Noncompliance Area: It was observed in the bathroom used by room 7 that a towel was hanging on the handrail in that bathroom. When staff was questioned on the use of that towel, staff in that room stated that this single towel is shared and used to dry the hands of all the children present in that classroom space after they wash their hands.

Correction Required: Cloth towels and washcloths shall be labeled with the child's name, used by only the named child and laundered weekly. The director shall arrange a laundry schedule with the parent.

Noncompliance Area: It was observed and stated that the facility did not have a continuity of operations plan created as a component of the facility's emergency plan as outlined in 45 CFR § 98.41, which is a federal government requirement.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Certified child care facilities are required to have all components of emergency preparedness and response planning as outlined in 45 CFR § 98.41, including the Robert T. Stafford Disaster Relief and Emergency Assistance Act. The Act includes procedures for evacuation, relocation, shelter-in-place and lock down, staff and volunteer emergency preparedness training and practice drills, communication and reunification with families, continuity of operations, and accommodations of infants and toddlers, children with disabilities, and children with chronic medical conditions.

Noncompliance Area: File for staff person #1, see code sheet for hire date, contained two FBI clearances one dated 5/8/17, and an updated clearance dated 1/24/23. These dates that were observed on file show that the updated FBI clearance was completed more than 60 months from the previous clearance on file. Although this was corrected immediately at the time of inspection file for staff person #2, see code sheet for hire date, did not contain a complete PA state police clearance as required. The clearance showed that the record results were pending.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Description: Each staff person meets quals/Associate's, 30 + 3 yrs

Noncompliance Area: It was stated by director at the time of inspection that staff person #1 and #3 were qualified to work in the position of a group supervisor at the facility. However, neither staff person #1 nor staff person #3 had the minimum educational requirements on file that would be needed in order to qualify either of them to be a group supervisor.

Correction Required: A staff person or a substitute staff person shall meet one of the applicable staff qualifications for the position in which the person is performing. A group supervisor shall have an associate's degree from an accredited college or university, including 30 credit hours in early childhood education, child development, special education, elementary education or the human services field and 3 years of experience with children.

Noncompliance Area: It was observed and stated that the daily attendance of children is more than 45 but less than 90 and the only group supervisor qualified staff person is the director.

In a facility in which more than 45 children are enrolled, a group supervisor is required for the first group of 45 enrolled children and for each group or partial group of 45 additional enrolled children.

Noncompliance Area: It was observed that towels were hung on the handrail next to the toilet areas in the front building accessible to children. When staff were asked why the towels were present, it was stated they are used to clean the toilet areas and are stored/hung there after each use.

Correction Required: Cleaning materials and other toxic materials shall be used in a way that does not contaminate play surfaces, food, food preparation areas and does not constitute a hazard to the children.

Noncompliance Area: It was observed in the back building that the single bathroom sink used by staff and children had a measured water temperature of 130 degrees Fahrenheit.

Noncompliance Area: It was observed and stated that the cleaning solution used in the rear building was only soap and water which did not have the capability to sanitize surfaces, and there were no pad coverings observed in or around the changing table at the time of inspection.

Correction Required: Diaper changing surfaces shall be cleaned after each use by wiping the surface with a sanitizing solution or by changing a pad or other surface covering.

Until such time as the required trainings are completed, staff person #4 must be supervised, when interacting with children, by a AGS or GS who has completed the required training related to this citation. Noncompliance Area: It was observed that the facility's emergency plan did not include written procedures explaining accommodations made for infants and toddlers and infants and toddlers were observed in care the day of inspection.

Correction Required: The facility shall have an emergency plan that provides for accommodations for infants, toddlers, children with disabilities, and children with chronic medical conditions.

Noncompliance Area: It was observed and stated that the facility did not forward their most recently updated emergency plan to the local municipality.

Correction Required: The operator shall send a copy of the emergency plan and subsequent plan updates to the local municipality and to the county emergency management agency.

Noncompliance Area: Staff person #1 has not completed the following required pre-service training within 90 days of their date of hire (see LIS code sheet): Health and Safety Topics completed after 9/30/16.

Correction Required: Staff person(s) shall complete professional development in the topics of 3270.31(f)(1 -- 10) within 90 days of hire. Staff person #1 will have until 3/29/23 to complete the required training. Until such time as the required training has been completed, staff person #1 must be supervised, when interacting with children, by an AGS or GS who has completed the required training related to this citation. If there are no staff available to supervise staff person #1, then staff person #1 may not work in a child-care position at the facility.

Description: Comply with CPSL

Noncompliance Area: Staff person #4 has not completed mandated reporter training within the last 60 months. This is evidenced by the previously documented mandated reporter training on file being dated 2/15/18.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to Child Protective Services). Staff person #4 will have until 3/29/23 to complete the mandated reporter training. Until such time as the required training has been completed, staff person #4 must be supervised, when interacting with children, by an AGS or GS who has completed the required training related to this citation. If there are no staff available to supervise staff person #4, then staff person #4 may not work in a child-care position at the facility.

Noncompliance Area: File for staff person #2 contained a FBI clearance dated 1/24/23; this clearance was not updated within a 60 month period as required. This is evidenced by the previously documented FBI clearance on file being dated 5/8/17. File for staff person #3 did not contain a signed disclosure statement.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: It was observed that the outlets in the upstairs bathroom were left uncovered and accessible to children under 5 years of age.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: It was observed that a spray bottle of cleaner stored above the changing table in the front building did not contain a label specifying its contents.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be stored away from food, food preparation areas and child care spaces.

Description: Emergency Numbers Posted

Noncompliance Area: It was observed in the front building, lower level, that the emergency numbers were not posted by the telephone in that space and none of the posted emergency numbers throughout the facility contained the number for the local ambulance.

Correction Required: The telephone number of the nearest hospital, police department, fire department, ambulance and poison control center shall be posted by each telephone in the facility.

Noncompliance Area: It was observed in the outdoor play space that the building's siding was cracked and broken allowing for sharp sections to be accessible to children.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: During the renewal inspection on 3/8/23, it was observed that the front building, lower level, fire alarm testing log showed the last documented test completed on 1/31/23; therefore documentation of an alarm test completed within the last 30 days was not found on file. It was observed that the facility has two sets of fire alarms in each building - both interconnected but one set is hardwired and one set is not. The alarms that were being tested and logged every 30 days in the rear building and the lower level of the front building were the older, hard wired, interconnected alarms. The alarms being tested every 30 days did not have the proof of purchase maintained on file.

Correction Required: The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Noncompliance Area: It was observed in the front building in room 1 that the thermometer in the facility's refrigerator was measuring the temperature inside that refrigerator to be between 46-50 degrees Fahrenheit.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45° F or below. An operating thermometer shall be placed in the refrigerator.

Noncompliance Area: It was observed in the front building in rooms 2 and 4 that paint was chipped and peeling under the windows in these child care spaces.

Noncompliance Area: It was observed in child care spaces located on the second floor, that approximately 11 windows were observed not having been modified or adapted to limit the openings of those windows to 6 inches or fewer.

Correction Required: Windows or doors above the ground floor that open directly to the outdoors and are accessible to children shall be constructed, modified or adapted to limit the opening to 6 or fewer inches.

Noncompliance Area: It was observed that the two bathrooms and classroom sink, located on the second floor of the childcare space, did not contain a lidded garbage can or hand washing sign at any of these individual locations.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility. A toilet area, training chair area, diapering area and sink area shall be equipped with a clean, lidded waste receptacle.
