Noncompliance Area: A renewal inspection occurred at the facility and a review of staff files was conducted. The Child Protective Services Law (CPSL) requires that mandated reporter training is updated every 60 months. Staff # 1 had mandated reporter training dated for 1/30/15 and Staff # 1 did not update this training until 3/2/20. Staff # 2 had mandated report training dated for 1/28/15 and Staff # 2 did not update this training until 3/2/20. Staff # 1 and Staff # 2 did not update their mandated reporter every 60 months as required by CPSL. Staff # 3 had a start date in child care of 8/10/20. Staff # 3 was hired using a volunteer child abuse clearance dated for 5/26/20. CPSL states that a volunteer child abuse clearance is not an acceptable clearance. Staff # 3 worked with children using the volunteer clearance. Staff # 3 received the appropriate child abuse clearance on 10/20/20.

In the future, mandated reporter training will be taken and updated as appropriate to CPSL. Also in the future, all staff will be hired with all appropriate clearances per CPSL prior to working with children.

Noncompliance Area: A video at the facility was viewed on 10/15/18 of the date of the incident of 10/10/18. This video showed Staff # 1 with a group of 8 school age children, including Child # 1. At 7:35am, Staff # 1 was viewed sitting at the table taking morning attendance and Child # 1 was standing at the table with another child. Staff # 1 was viewed standing up, walking over to Child # 1, picking Child # 1 up and taking him back to the table with him. Staff # 1 then placed Child # 1 on his lap, both in a seated position on a chair at the table and Staff # 1 then placed his left arm round the waist of Child # 1. The video showed Child # 1 attempting to get out of the hold that Staff # 1 had on him several times without success. At 7:38am, Staff # 1 released Child # 1. Child # 1 then proceeded to hit Staff # 1. Staff # 1 can be seen placing an arm out attempting to block the hit and talking to the child. Staff # 1 can be see during this time standing up and over the child the in an aggressive manner and yelling "leave me alone" twice as reported by Staff # 2 and Staff # 3 as the video did not have sound. Staff # 2 and # 3 stated this was spoken in an aggressive and harsh manner that caught both of their attention to see what was going on. Staff # 3 stated that when they viewed the child, the child was standing at the cubbies and appeared extremely scared of Staff # 1 standing over him.

Correction Required: A facility person may not use harsh, demeaning or abusive language in the presence of children.A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs. The Legal Entity / Director will schedule Staff # 1 to participate in training regarding appropriate ways to redirect children with challenging behaviors. The training must be PQAS approved. The training must also be approved by the Northeast Region Office of Child Development before Staff # 1 is scheduled and participates in the training.

Plan: To prevent future occurrences management will continue to carry out initial employment and conduct monthly staff meetings in which we will refer staff to a variety of guidance techniques/ behavior and classroom management. Staff are and will continue to be trained during these meetings to follow all state regulations including to never restrain a child/children by using bonds, ties, straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. Plan: To prevent this from happening again staff will continue to be trained both on initial employment and during monthly staff meeting to follow all state regulations including to not use harsh, demeaning or abuse language in the presence of children. We will continue to train staff on a variety of ways to handle extreme emotional outbursts from children. We set up our environment to allow the children to be successful, allow children freedom to make their own decisions, use positive guidance techniques, teach self-regulations, conflict resolution and talking through big emotions.
