Noncompliance Area: In the outdoor child care space there is a large wooden embedded play structure. The structure is built on dirt and grass and there is no approved protective surface ground covering as required by the Consumer Product Safety Commission for embedded play equipment. There are swings, climbing ropes and hammocks hanging from the structure. The ladder to the structure platform has been removed to prevent access however there is a large tunnel slide with a height of greater than 6 feet that is still accessible to children who could climb onto the exterior of the slide and fall off.

Correction Required: Outdoor equipment that requires embedded mounting must be mounted over a loose-fill or unitary playground protective surface covering that meets the recommendations of the United States Consumer Product Safety Commission. The equipment must be anchored firmly and be in good repair.

The swings have been removed from the play area and the play yard gate will surround the slide to prevent children from being able to have access to it. In the future the play yard will stay around the slide.

Noncompliance Area: A portable swimming pool with a depth of 30 inches is located in the providers back yard in the area identified as the family's space. A ladder was observed on the wall of the pool for access and there was water in the pool. The provider states that the enrolled children do not go swimming and do not go in that part of the yard. The family's space with the swimming pool is separated from the child care play space with large Rubbermaid storage units, planter boxes and a 26 inch tall free standing child safety gate. This barrier does not meet the safety requirements of the CPSC for above ground pools which is a minimum of a 4 foot tall fence that securely closes . Children could climb over the child safety gate or push between the gate and the planter boxes since they are not secured and access the swimming pool posing a drowning hazard.

Correction Required: An aboveground swimming pool which is not in use must be made inaccessible to children in accordance with the swimming pool barrier guidelines of the United States Consumer Product Safety Commission.

Items have been purchased from Lowe's to build a wooden gate. This will be a permanent structure to prevent access to the home yard and swimming pool. The items are on back order until August 13, 2020. In the meantime we have added a 4 foot tall mesh fence attached to the planter boxes and attached to the child safety gate to prevent the children from having access. In the future a secure 10' x 4' wooden gate will remain in place to prevent access to the swimming pool this will remain locked during daycare hours by a slide latch and a ground pipe on both gates.
