Regulation: 3270.20(a)(1)/3270.20(b)

Description: Inpatient hospitalization or ER treatment of child/Mail or deliver written report to regional office within 72 hours

Noncompliance Area: The operator did not notify the central regional office within 24 hours of child #1 receiving emergency room treatment. A written report was not provided within 72 hours after emergency room treatment.

Correction Required: The operator shall immediately notify a child's parent and shall telephone notice to the appropriate regional office within 24 hours if a child in care at the facility is hospitalized or receives emergency room treatment. The operator shall mail or deliver a written report to the appropriate regional office within 72 hours after hospitalization of a child in care, emergency room treatment of a child in care, death of a child in care, a facility fire requiring the services of a fire department. Staff person #3 and #4 will be required to attend the Central Region Existing Provider Orientation in-person training to be conducted on 10/15/2026. The owner or director shall contact the Central Regional Office to schedule the training. The hours of the training may not be counted towards the required 12 hours of annual child care training. Documentation of completed training must be submitted to the Regional Office and be kept in the facility person's file.

Regulation: 3270.52

Description: Mixed Age Level

Noncompliance Area: On 05/28/2026, staff stated that the infant classroom and young toddler classroom combined in the infant classroom during naptime. There was a mixed age group of 1 infant and 7 young toddlers in the infant classroom during naptime with 1 staff person. Staff person #1 was over ratio while staff person #2 was on their break. Naptime ratios do not double when there is an infant in care.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Regulation: 3270.113(a)

Description: Supervised at all times

Noncompliance Area: On 05/28/2026, child #1 received 1st and 2nd degree burns on their hands while at the facility. Staff person #1 did not observe how the injury occurred and did not notice the burns and blisters on the child's hands while in their care.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. TIERED LIS: 1. The legal entity must arrange for all facility staff and members of the legal entity to complete the Better Kid Care 911: Responding to Medical Emergencies Self-Learning Module. The legal entity will confirm compliance by sending a copy of the training certificate to the Central Regional Office of Child Development and Early Learning upon completion of the training. 2. The legal entity must arrange for all facility staff to complete the Active Supervision -- Infants & Toddlers through ContinuED (PA Keys). 3. The legal entity must arrange for all facility staff and members of the legal entity to receive training and technical assistance through the ELRC regarding playground safety and heat-related injuries. The legal entity must receive DHS approval of the training content prior to scheduling the training.

Description: Reports of accidents, injuries and illnesses. Original report - parent same day Copy - facility accident file. Copy - child's file

Noncompliance Area: On 05/28/2026, child #1 received 1st and 2nd degree burns on their hands while at the facility. An incident report was not completed on the date of the injury. A report was not completed until 05/29/2026 after the parent notified the operator and director of the child's injuries.

Correction Required: A child's record shall contain reports of accidents, injuries and illnesses involving a child in care at the facility. The original report shall be given to the parent on the day of the incident. The second copy of the report shall be retained at the facility in an accident file. The third copy of the report shall be retained at the facility in the child's file.

Regulation: 3270.76

Description: Building Surfaces

Noncompliance Area: On 06/02/2026 at 9:45 am, observed the exterior side of the metal door leading from the preschool classroom to the playground reached a temperature of 120 degrees Fahrenheit. The playground faces the morning sun and does not have a source of shade. Children at the facility go outside to play in the mornings between 9:00 - 10:30 creating a threat to the health and safety of the children due to surfaces on the playground reaching temperatures over 110 degrees F.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. The operator will develop a procedure which includes a process for checking and documenting the outdoor temperature and surface temperatures on the playground equipment and surfaces prior to taking the children outside. The legal entity must submit documentation in a format approved by DHS proving that the facility procedure for checking outdoor temperatures is followed at all times e.g., a checklist. The legal entity will confirm continuing compliance by sending copies of the documentation to the Regional Office of Child Development and Early Learning on a weekly basis for a period of 3 months after DHS approves the documentation format.

Description: Age appropriate

Noncompliance Area: Observed child #1, a young toddler (see LIS code sheet), in the infant classroom using a Bright Starts Cute Critters Activity Jumper. The recommended age range for use is 6 - 12 months. The manufacturer's instructions warning includes the following statement, "DO NOT allow children who can stand or walk on their own to use the activity jumper."

Correction Required: Play equipment and materials appropriate to the developmental needs, individual interests and ages of the children shall be provided in sufficient amount and variety to preclude long waits for use.

Regulation: 3270.112

Description: Infant/Toddler Stimulation

Noncompliance Area: During diaper changing, observed 3 young toddlers sitting in highchairs watching a video on a small tablet placed on a nearby shelf in lieu of the children being engaged in an age-appropriate activity with staff interacting with the children.

Correction Required: Infants and toddlers shall be provided stimulation by being held, rocked, talked to, played with and carried.

Regulation: 3270.113(a)

Description: Supervised at all times

Noncompliance Area: Observed staff person #2 standing with their back to the infants and toddlers in the infant classroom. Staff person #2 was unable to supervise a young toddler asleep in a crib on the far side of the room. The crib was placed behind another crib and a Pack N Play which were blocking visibility. *Corrected at the time of the inspection.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Description: Pertinent Laws & Regulations/General Health and Safety

Noncompliance Area: Staff person #1 was observed to be caring for children unsupervised. Staff person #1 has not completed Pediatric first aid and CPR training through a Pennsylvania Quality Assurance System (PQAS) approved curriculum and the trainer has not provided documentation that they are PQAS-certified in that training curriculum.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required training has been completed, staff person #1 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #1, staff person #1 may not work in a child-care position at the facility.

Description: Infant/toddler - no bottle in mouth to sleep

Noncompliance Area: Observed a bottle with milk or formula in the crib with child #2, a young toddler (see LIS code sheet), while the child was sleeping. *Corrected at the time of the inspection.

Correction Required: Neither an infant nor a toddler is permitted to sleep with a bottle in his mouth.

Description: Two written references

Noncompliance Area: The file for staff person #1 did not include a second written, nonfamily reference from individuals attesting to the person's suitability to serve as a facility person.

Regulation: 3270.31(f)

Description: Health and Safety Training

Noncompliance Area: Staff person #1 has completed Pediatric first aid and CPR training, however the training was not completed through a Pennsylvania Quality Assurance System (PQAS) approved curriculum and the trainer has not provided documentation that they are PQAS-certified in that training curriculum. Staff person #1 had documentation of Standard First Aid dated 04/01/2025 through the American CPR CARE Association which is not an approved Pediatric First Aid and Pediatric CPR Provider and Curriculum.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10. Until such time as the required training has been completed, staff person #1 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #1, staff person #1 may not work in a child-care position at the facility.

Description: Comply with CPSL/CPSL information

Noncompliance Area: The file for staff person #1 did not include a PA State Police Clearance for employment; a volunteer clearance dated 04/12/2026 was on file. Staff person #1 was observed to be caring for children unsupervised.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person #1 may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Regulation: 3270.72(c)/3270.76

Description: Good repair/Building Surfaces

Noncompliance Area: Observed 2 windows open in the preschool classroom next to the door leading to the outside play space. The window on the right had a screen which was damaged creating gaps along the windowsill and frame. The window on the left had damaged wood on the lower right corner of the bottom rail of the window which created a hole and rough splintering wood.

Correction Required: Screens shall be in good repair. Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Regulation: 3270.123(b)/3270.182(8)

Description: Parent receives original/Copy of initial and subsequent agreements. Parent receives original.

Noncompliance Area: The original agreement is not provided to the parent, the parent is provided a copy and the original is placed in the child's file. The files for child #1, #2, #3, #4 and #5 included the original agreement.

Correction Required: A parent shall receive the original agreement. The facility shall retain a copy of the agreement. A child's record shall contain a copy of the initial agreement and subsequent written agreements between the parent and the operator. The parent receives the original agreement.
