Regulation: 3270.113(b)/3270.113(d) Description: No physical punishment /No harsh language Noncompliance Area: Upon review of video footage from 4/8/2026 and interviewing staff present in the classroom at the time the incident occurred it was verified that child #1 (DOB see LIS code sheet) was climbing on nap time cots in the corner of the Monkey's classroom. At 11:49:06 staff person #1 (DOH see LIS code sheet) is observed to walk across the classroom to the cots, grab child #1 by the arm and pull the child down off of the cots. Staff person #1 was observed to be bent over close to the child #1 face. Other staff confirmed that staff person #1 was yelling in child #1's face. At 11:49:13 child #1 swung their arm and hit staff person #1 on the leg. At 11:49:15 staff person #1 grabbed child #1 by the forearms and used physical force to move child #1, with their feet dragging on the floor, to the other corner of the classroom and tossed the child backwards onto a cushioned chair. Staff person #1 was observed to be bent over close to child #1's face. At 11:49:22 child #1 attempted to get up and staff person #1 pushed child #1 back down onto the chair and staff person #1 walked away. At 11:49:47 child #1 was observed in the book corner of the classroom pushing over a cushioned chair. At 11:50:52 staff person #1 was observed to walk over to the child in the book corner, pick up the cushioned chair to it's upright position all the while grabbing child #1 by the upper arm and tossed the child onto the chair. Correction Required: A facility person may not use any form of physical punishment, including spanking a child. A facility person may not use harsh, demeaning or abusive language in the presence of children. |
