All indoor and outdoor areas used by the children were not kept clean, orderly, and free of items which are potentially hazardous to children including removal of items a child can swallow; the removal of loose nails or screws and splinters on inside; and use of outdoor equipment that is too hot to touch. The playhouse beside the storage shed in the back corner of the yard had standing water in the window box. Mold and mildew were growing in the bottom. Mildew was also growing on the outside of the structure and on the chairs inside. Two swings had “S” hooks holding the seat. The posts and lattice on the older stationary climbing structure have become weathered and rough and could cause injury to a child.

Equipment and toys were not in good repair and developmentally appropriate. In the outdoor space the chains and bars on the swing set are rusty and need to be painted or replaced. There was one play lawn mower that had a 2 inch crack with sharp edges. The silver paint on the tricycles was peeling and rusty. There was mildew on the balls, slide, and swing seats. There was a metal storage cabinet, next to the back door that was rusty and had mildew. On the older climbing structure, there was a bolt protruding 2 inches from a board on the side of the landing deck which could injure a child.

Corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, and products under pressure in an aerosol dispenser and any substance that may be hazardous to a child if ingested, inhaled, or handled were not kept in locked storage when children were in care. A bottle of fingernail polish remover was located in an unlocked cabinet over the sink in the bathroom used by the children.
