Noncompliance Area: Observed a piece of damaged pink plastic in the outdoor play area.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Regulation: 3280.103

Description: Small Toys and Objects

Noncompliance Area: Observed a small bowl of paperclips on a low shelf in the child care space, accessible to an older toddler in care.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: Observed child file #2 contained an original agreement.

Correction Required: A parent shall receive the original agreement. The facility shall retain a copy of the agreement.

Regulation: 3280.131(a)

Description: Health Information

Noncompliance Area: Observed child file #3 contained an initial health assessment which was dated more than 60 days following the first day of attendance at the facility. Observed child file #1, who has been in attendance for more than 60 days, did not contain an initial health assessment.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Description: Comply with CPSL

Noncompliance Area: Observed staff file #1 contained an updated NSOR verification letter which was dated more than 60 months following the previous valid NSOR verification letter.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Description: Toxic plants not permitted

Noncompliance Area: Observed pokeweed accessible to children near the entrance to the play area, along the fence of the play area, and inside the play area.

Correction Required: Toxic plants are not permitted in a child care space.

Regulation: 3280.77(a)

Description: No peeling paint or plaster

Noncompliance Area: Observed paint flakes on the inside of the entrance storm door threshold.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Regulation: 3280.52(c)

Description: Mixed age levels

Noncompliance Area: Observed staff person #1 providing care for a mixed age group of children which included 1 older toddler, 6 preschool children, and 3 young school age children.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements at §3280.52(b).

Description: Every 60 days

Noncompliance Area: Observed the documented fire drill log revealed the most recent fire drill dated 10/25/24 was conducted more than 60 days ago.

Correction Required: The primary staff person or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that fire drills are conducted at least once every 60 days.

Regulation: 3280.95(a)/3280.95(b)

Description: FIRE DETECTION/Staff responsibility

Noncompliance Area: Observed the documented fire alarm testing log revealed the last documented fire alarm test was conducted on 9/27/24 which is 4 months ago. Documentation of fire alarm testing is to be conducted at least every 30 days.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The primary staff person or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met.

Description: Insurance coverage information

Noncompliance Area: Observed the emergency contact form for child file #2 did not contain the health insurance coverage and policy number.

Correction Required: Emergency contact information must include health insurance coverage and policy number for a child under a family policy or Medical Assistance benefits, if applicable.

Regulation: 3280.131(a)/3280.131(e)

Description: Health Information/ACIP recommended immunization record

Noncompliance Area: Observed child file #1 (a preschool child) and #2 (a young school age child), who have both been in attendance at the facility for more than 60 days, did not contain an initial health assessment.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility. The facility may not accept or retain a preschool child at the facility for more than 60 days following the first day of attendance at the facility unless the parent provides written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of the dates (month, day and year) the child was administered immunizations in accordance with the recommendations of the ACIP. At the close of business 9/17/24, child #1 cannot attend the facility until a valid immunization record or letter of exemption is obtained.

Regulation: 3280.151(a)

Description: 12 months prior to service and every 24 months thereafter

Noncompliance Area: Observed staff file #1 had an updated health assessment which was dated more than 24 months after the previous valid health assessment.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Regulation: 3280.26(a)(6)

Description: Emergency plan

Noncompliance Area: Observed the documented emergency drill, did not contain all of the required information pertaining to the emergency drill completed on the OCDEL provided form.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Regulation: 3280.76

Description: Building Surfaces

Noncompliance Area: Observed in the outdoor play area, an end post which was missing a post cap.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Regulation: 3280.115(a)(3)

Description: Above-ground pool inaccessible

Noncompliance Area: Observed an above ground pool adjacent to the fenced in outdoor play space. The gate which separated the pool from the play space lacked a lock. Therefore, was not inaccessible to the children.

Correction Required: An aboveground swimming pool which is not in use must be made inaccessible to children in accordance with the swimming pool barrier guidelines of the United States Consumer Product Safety Commission.
