Noncompliance Area: Cert Rep observed a bottle identified to belong to an infant in the Infant Room. The bottle did not contain a label to identify to whom it was intended to be fed.

Correction Required: Disposable nursers and bottles shall be labeled with the child's name.

Noncompliance Area: The file for Staff #1 contained a National Sex Offender Certificate (NSOR) at the time of inspection, it was observed that the file for Staff #1 lacked a National Sex Offender Certificate (NSOR) dated prior to the date that Staff #1 began working with children.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Description: Locked or inaccessible

Noncompliance Area: In Room 3, 12 bottles of sunscreen and a can of spray air freshener/deodorizer labeled, "Keep out of reach of children" were observed in an unlocked changing table that was accessible to children in care.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Description: No peeling paint or plaster

Noncompliance Area: In the Gross Motor Space, there was peeling blue paint on the right wall when entering the space.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Description: Different times of day

Noncompliance Area: Based on Fire Drill Log documentation, all of the fire drills conducted within the last year 6/2025--6/2026 occurred in the morning between the times 8:25 AM-11:15 AM.

Correction Required: The Director or designated staff person who is responsible for compliance with this chapter ensure fire drills are conducted at different times of the day or night, or both, if applicable.

Noncompliance Area: Staff person #1 was observed to be caring for children unsupervised. Staff person #1 has not completed the following pre- service training required prior to caring for children unsupervised: Pediatric First Aid/CPR.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre- service trainings are completed, staff person #1 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #1, staff person #1 may not work in a child-care position at the facility.

Description: Exceeding Capacity

Noncompliance Area: At 7:50 AM, 15 children were observed receiving care in the Young Toddler Classroom childcare space that has a designated maximum capacity of 10.

Correction Required: The capacity established for an indoor space may not be exceeded except in situations described in § 3270.61(h)(1-3)

Regulation: 3270.52

Description: Mixed Age Level

Noncompliance Area: 1.9.26: At approximately 7:50 AM two staff were present with 15 children: including 3 Preschool Aged Children, 8 Older Toddlers, and 4 Young Toddlers.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Description: 110º F or less

Noncompliance Area: In the Infant Room, water temperature at the sink in the classroom measured at 121 degrees.

Correction Required: Hot water temperature, in areas accessible to children, may not exceed 110° F.

Regulation: 3270.103

Description: Small Toys and Objects

Noncompliance Area: In the Infant Room there was an Infant toy that had individual separate beads that were less than an inch in diameter. In the Outdoor PlaySpace there was mulch, and small rocks in an area where toddlers were playing. The Outdoor PlaySpace also had small pieces of the squishy material that had become loose and posed a choking hazard. These items were accessible to children still placing objects in their mouths.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Regulation: 3270.106(f)

Description: 2 feet apart

Noncompliance Area: Observed rest equipment in Room 2 and Room 3 that lacked 2 feet of space on three sides while in use. A crib in the Infant Room was observed to lack 2 feet on 3 sides while an infant was sleeping in the crib

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Regulation: 3270.107

Description: Refrigerator

Noncompliance Area: The refrigerator in Room 1 contained a thermometer that was reading 53 degrees.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45° F or below. An operating thermometer shall be placed in the refrigerator.

Regulation: 3270.113(a)(1)

Description: Staff assigned to specific children

Noncompliance Area: At approximately 10:00 AM, Staff #9 and #10 were observed in the Outdoor PlaySpace with 10 children including 8 Older Toddlers and 2 Preschool Aged Children. Staff#10 named four children as being in their assigned group including 1 Preschool Aged Child, and three Older Toddlers. Staff #9 named five children in their assigned group including 1 Preschool Aged Child and four Older Toddlers, therefore leaving Child #2 not identified as being in an assigned primary group.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.
