Description: Supervision of children

Noncompliance Area: There is only one operator present in the facility, yet there is no system to properly supervise the children if the operator is using the restroom or preparing snacks.

Correction Required: When there is only one operator present in the family child care home and the operator is unable to be physically present with the children because the operator is preparing snacks or meals for children in care or the operator is using the restroom, the operator may comply with the supervision requirement in subsection (a) through the use of an electronic monitor, camera, mirror, or other device or method so the operator can see, hear, direct and assess the children in real time at all times.

Regulation: 3290.63

Description: Protective Outlet Covers 5 yrs. or less

Noncompliance Area: It was observed that there were missing protective outlet covers: 3 missing in outlet strip on front wall and 2 wall outlets on front wall.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Regulation: 3290.95(b)

Description: Operator or designated staff responsibility

Noncompliance Area: It was observed that the fire detection device in the basement was not working in an interconnected manner with the device on the main floor. Additionally, there were no fire detection devices on the second and third floors.

Correction Required: The operator or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met.

Regulation: 3290.131(b)(1)/3290.182(1)

Description: Updated infant health report: every 6 months/Initial and subsequent health assessments

Noncompliance Area: Upon inspection of children's files, it was found that Child #1 most recent health assessment was completed on 4.12.24 [expired 10.31.24].

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler. A child's record must contain initial and subsequent health reports.

Regulation: 3290.95(a)/3290.95(b)

Description: System in compliance/Operator or designated staff responsibility

Noncompliance Area: Upon inspection of the facility fire system testing logs, it was found that the required tests had exceeded the maximum of 30 days between required drills on the following dates: 1.2.24/2.2.24 [31 days]; 3.1.24/4.4.24 [34 days]; 5.3.24/6.4.24 [32 days]; 6.4.24/7.5.24 [31 days]; 10.3.24/11.3.24 [31 days].

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The operator or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in § 3290.95(a) are met.

Regulation: 3290.18

Description: General Health and Safety

Noncompliance Area: Upon inspection of the facility emergency plan, it was found that specific plans for continuity of operations was not included.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Regulation: 3290.131(b)(1)

Description: Updated infant health report: every 6 months

Noncompliance Area: Upon inspection of the children's files, it was found that the health report on file for child #1 was dated 7.11.22 and would have therefore expired on 1.11.23.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler.

Regulation: 3290.151(a)/3290.192(2)

Description: Within 3 months, then 12 months/Health assessment, TB test

Noncompliance Area: Upon onsite inspection of the facility, it was observed that facility person #1 was preparing food and had entered the childcare space. No health assessment or TB test result was on file for this person.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment on file at the facility. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Description: Comply with CPSL/CPSL information

Noncompliance Area: Facility person #1 was observed preparing food in the facility, as well as in the childcare space. The file for facility person # 1 does not contain a current DHS required FBI clearance [previous copy is dated 4.28.16].

Correction Required: Facility employee #1 may not be in the childcare facility when children are in care by close of business. All required clearances must be obtained before facility person#1 may return to preparing meals and entering the childcare space.
