Outdoor play space used by the facility is considered part of the facility premises. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30.

Correction Required: Emergency contact information must include the written consent signed by a parent for emergency medical care. A child's record shall contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Noncompliance Area: The emergency contact information on file for child #2 did not include addresses for listed release persons. The emergency contact information on file for child #3 did not include a complete address for a listed release person.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Description: Written instructions/Written consent

Noncompliance Area: A medication was on site for child #1. Facility staff were unable to provide written instructions from the individual that prescribed the medication. The prescription label stated "please see attached for detailed directions") and there was no attachment included. In addition, the facility staff were unable to provide documentation that the parent provided written consent for the administration of the medication.

Correction Required: A staff person shall administer a prescription medication only if written instructions are provided from the individual who prescribed the medicine. Instructions for administration contained on a prescription label are acceptable. A parent shall provide written consent for administration of medication or a special diet.

Description: Pertinent Laws & Regulations/General Health and Safety

Noncompliance Area: Spray bottles filled with cleaning products were observed on a shelf within reach of the children receiving care in the space. The facility did not have a closed, plastic lined receptacle to dispose of trash that been contaminated by human secretions or excrements.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. Conditions at the facility may not pose a threat to the health or safety of the children. All DHS certified child care programs providing care exclusively to school-age children must maintain compliance with the requirements for the handling, storage, and disposal of hazardous material and biological contaminants in accordance with 45 CFR § 98.41(a)(1)(viii). Cleaning and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. Trash that has been contaminated by human secretions or excrement shall be contained in closed, plastic-lined receptacles.

Noncompliance Area: The most recent health assessment on file for staff person #4 was more than 24 months old (dated in June of 2023) and was past due to be updated.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Correction Required: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person.

Description: Training regarding plan

Noncompliance Area: The operator was unable to provide documentation that staff person #1 had been trained on the emergency plan in the past year. The previous training was dated more than 12 months ago, in August of 2024.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Regulation: 3270.31(e)(4)(ii)

Description: Fire safety - 1 yr.

Noncompliance Area: The operator was unable to provide documentation that staff person #1 has completed fire safety training in the past year. The previous training was dated more than 12 months ago, in August of 2024.

Correction Required: Staff persons shall participate, at least annually, in fire safety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Noncompliance Area: The record for staff person #3 included documentation of 4 annual training hours from the previous year (12/2023-12/2024). The remaining 8 hours have since been completed. The record for staff person #4 included documentation of 4 annual training hours from the previous training year (12/2023-12/2024). The record for staff person #6 included documentation of 10 annual training hours from the previous training year (8/2024-8/2025). The remaining 2 hours have since been completed.

Correction Required: A staff person shall obtain an annual minimum of 12 clock hours of child care training. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Description: Comply with CPSL

Noncompliance Area: The record for staff person #4 did not include a valid DHS FBI clearance. The most recent DHS FBI clearance on file was dated 7/29/2020 and therefore expired 7/29/2025. The staff person has worked in a child care position with an expired clearance on file. Staff person #4 has not completed an approved DHS mandated reporter training within the last 60 months. This is evidenced by the previously documented mandated reporter training on file being dated 6/15/2020. Another training has since been completed, however the mandated reporter training is not intended for an appropriate target audience).

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Staff Person #4 may not work in a child care position at the facility until complete clearances are on file.

Description: Assistant Group Supervisor qualifications/Exp, educ., training prior to facility

Noncompliance Area: Staff person #5 is serving as an assistant group supervisor at the facility. The staff person's file included documentation of an unrelated associate's degree, but did not include documentation of 2 years of child care experience.

Correction Required: An assistant group supervisor shall have attained one of the qualification levels specified at § 3270.36(b)(1-5). (1) A high school diploma or a general educational development certificate and 30 credit hours from an accredited college or university in early childhood education, child development, special education, elementary education or the human services field. (2) A high school diploma or a general educational development certificate, including 600 or more hours of secondary training described in § 3270.31(c) (relating to age and training). (3) A high school diploma or a general educational development certificate, 15 credit hours from an accredited college or university in early childhood education, child development, special education, elementary education or the human services field and 1 year of experience with children. (4) A high school diploma or a general education development certificate and completion of a post-secondary training curriculum described in § 3270.31(c). (5) A high school diploma or a general educational development certificate and 2 years experience with children. A facility person's record shall include verification of child care experience, education and training prior to service at the facility.
