Findings: The Surveyor and Team Leader observed that Staff 2 was not supervising the enrolled children while in the outdoor activity area. Staff 2 was not aware and not accountable for the children who were playing on the North side of the playground behind the wall. Staff 2 was sitting at the table. The Surveyor and Team Leader also observed Child 1 sitting in the middle of the teeter totter upon arrival. Staff 2 reported that she did see the child but did not intervene because she was watching other children. Child 2 was observed playing with a Lego in the middle of the teeter totter. Staff 2 did not intervene. The Surveyor had to ask Staff 2 to move the child for their safety.

Findings: Per the allegations and based on staff and children's interviews the following allegation was substantiated: Staff 1 was found to not model orderly conduct and personal control. Interviews and review of the Director's notes regarding the internal investigation revealed Staff 1 kicked, pinched and grabbed children in a rough manner. Staff 1 was reported to speak rude to the children, and tap them with her shoe.

Findings: Per the allegations and based on the Surveyor's interviews and investigation the following allegation was substantiated: Three children reported that they do not get a snack if they misbehave. Child 1 stated, "The teachers tell the kids if they are not good they do not get their food". Child 6 stated, "Only get a pop-scicle if you behave. You can't go outside or get a pop-scicle". Child 3 stated, "You can't get a snack until your done with your fit". Child 2 stated, "When (Staff 1) was here she pinches us right here when we don't nap she pinches us".
