Noncompliance Area: A review of facility records indicated that fire drills were conducted on 4/11/25, 6/16/25, 9/8/25,12/4/25 and 2/6/26- not every 60 days as required.

Correction Required: Fire drills are conducted at least once every 60 days. Revise and submit written fire drill policies to ensure that fire drills are completed and recorded at least every 60 days as specified in this regulation. Conduct and send a record of all fire drills completed within the next 30 days.

Description: General Health and Safety

Noncompliance Area: The facility's written policies on shaken baby syndrome, abusive head trauma, and child maltreatment did not include the identification and prevention of child maltreatment.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children. Revise and submit the facilities policies to include the identification and prevention of child maltreatment.

Description: Comply with CPSL/CPSL information

Noncompliance Area: The facility was not in compliance with the CPSL and with Chapter 3490 (relating to protective services): Staff person's record did not contain the required CPSL hiring documents. (#1, mandated reporter training and FBI more than 60 months old)

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 cannot work in a childcare position at the facility until the required CPSL documents have been obtained, completed and submitted as specified. Submit a copy of the required, completed CPSL clearance documents for the identified staff person. Ensure that all staff persons (new and existing) have the required CPSL clearance documents within the required timeframes in accordance with the CPSL

Noncompliance Area: Fire drill records contained the same hypothetical location of the fire for several consecutive fire drills.

Correction Required: The operator or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that the hypothetical locations of the fire are rotated around the facility for each drill such that the hypothetical location is never the same for consecutive drills. Noncompliance Area: On 4/25/24, it was observed that the facility lacked an interconnected system of smoke detectors in accordance with Act 62.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The operator or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in § 3290.95(a) are met. Provider must install interconnected smoke detectors and ensure that they are in compliance with Act 62.

Noncompliance Area: During renewal inspection on 3/7/19, cert rep observed no posting of emergency transportation plan at the facility.

Correction Required: A written plan shall be conspicuously posted which identifies the means of transporting a child to emergency care and the facility staffing provisions in the event of an emergency. The plan must accompany a staff person who leaves the facility on an excursion with children.

Noncompliance Area: During renewal inspection on 3/7/19, cert rep observed out of date parental signatures on child documents in the files of Child 1, Child 2, Child 3, Child 4, Child 5 and Child 6.

Correction Required: A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: During renewal inspection on 3/7/19, cert rep observed missing agreements in the files of Child 1, Child 2, Child 3, Child 4, Child 5 and Child 6.

Correction Required: A child's record must contain a copy of the initial agreement and subsequent written agreements between the parent and the operator. The parent receives the original agreement.

Noncompliance Area: During renewal inspection on 3/7/19, cert rep observed missing documentation of name, address and telephone number in the files of Staff 1 and Staff 2.

Correction Required: A facility person's record shall include the name, address and telephone number of the facility person.

Noncompliance Area: During renewal inspection on 3/7/19, cert rep observed documentation of 6 hours of childcare training missing from the files of Staff 1 and Staff 2.

Correction Required: A staff person shall obtain an biennial minimum of 12 clock hours of child care training.

Noncompliance Area: During renewal inspection on 3/7/19, cert rep observed missing Mandated Reporter training and an out of date FBI clearance in the file of Staff 2.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). SAFETY PLAN: The operator is required to submit to the Children and Youth Agency a plan of supervision or alternate arrangement as required by the Child Protective Services Law. LACKING REQUIRED HIRING DOCUMENTS: Facility Person # -- may not work in a child care position at the facility. PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee.

Noncompliance Area: During renewal inspection on 3/7/19, cert rep observed children in care being supervised by Staff 2. Staff 2 does not have current first aid training.

Correction Required: One or more persons competent in first-aid techniques shall be at the facility when day care children are in care.

Noncompliance Area: Operator has not been completing child service reports for children enrolled 6 or more months.

Correction Required: An agreement shall specify the services to be provided to the family and the child, including the Department's approved form ( Child Service Report ) to provide information to the family about the child's growth and development in the context of the services being provided. the operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information at 3290.124(e), every 6 months.

Noncompliance Area: Facility has been updating children's records once a year, not every 6 months. Operator agrees to require parents to update records every 6 months.

Correction Required: The parent shall update in writing emergency contact information once in a 6-month period or as soon as there is a change in the informationA parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: Staff person #1 does not have current first aid training.

Correction Required: One or more persons competent in first-aid techniques shall be at the facility when day care children are in care. A facility person's record shall include records of training required by the Department.

Noncompliance Area: Emergency numbers were not posted by the phone.

Correction Required: The telephone number of the nearest hospital, police department, fire department, ambulance and poison control center shall be posted by each telephone in the facility.

Noncompliance Area: On 4/11/17, a child fell on the playground. Operator notified parent who took child to the ER where he was diagnosed with a broken collarbone. Operator did not notify OCDEL within 24 hours.

Correction Required: The operator shall immediately notify a child`s parent and shall telephone notice to the appropriate regional office within 24 hours if a child in care at the facility is hospitalized or receives emergency room treatment.

Noncompliance Area: The mats used by the children for napping are not labeled.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child`s parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: Children # 3 & 6 do not have parent signatures for emergency medical care.

Correction Required: Emergency contact information must include the written consent signed by a parent for emergency medical care. A child`s record must contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission.

Noncompliance Area: Children # 1, 2, 3, 6, & 7 are missing some or all health insurance policy information.

Correction Required: Emergency contact information must include health insurance coverage and policy number for a child under a family policy or Medical Assistance benefits, if applicable.

Noncompliance Area: Children # 1, 4, & 5 only have shot records in their files, not complete physicals.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.A child`s record must contain initial and subsequent health reports.

Noncompliance Area: Children # 3 & 7 have physicals that are over 1 year old.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Noncompliance Area: Owner/operator did not have diaper-aged children during the inspection. However, she stated that in the past, she changes children on their blanket. We discussed diapering procedures and she agreed to purchase a diaper changing mat and will use new paper each time she changes when and if she diapers children.

Correction Required: Diaper changing surfaces shall be cleaned after each use by wiping the surface with a sanitizing solution or by changing a pad or other surface covering.

Noncompliance Area: Staff person # 2 does not have a physical in her record.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment on file at the facility.A facility person`s record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: Operator is not getting parents to review and update emergency contact forms and agreements in writing every 6 months.

Correction Required: A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information. Following review, a parent shall attest to the accuracy of information in the emergency contact information and the financial agreement at each review by affixing a dated signature to the record.

Noncompliance Area: Children # 3 & 6 do not have parent signatures for first aid by staff.

Correction Required: A child`s record must contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Noncompliance Area: Owner/operator does not have a copy of Chapter 3290 available at the facility.

Correction Required: The facility`s current certificate of registration and a copy of the applicable regulations under which the facility is certified shall be posted in a conspicuous location used by parents, with instructions for contacting the appropriate regional day care office posted at the same location

Noncompliance Area: Owner is not documenting in writing review of emergency plan nor staff training.

Correction Required: The operator shall review the emergency plan at least annually and update the plan as needed. The operator shall document in writing each review and update of the emergency plan. The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training.

Noncompliance Area: Neither staff persons # 1 nor 2 have documentation of training in the last two years.
