Noncompliance Area: **During a complaint investigation conducted on 3/2/23, the operator offered video footage of a child who was injured in an incident that occurred on 2/24/23 at approximately 10:00am in the gross motor room. In the video, Child #1 was observed jumping up and down on a blue soft foam block, loses their footing, and falls face-first onto the floor. The fall resulted in Child #1 sustaining an injury to their nose and right arm. During the video, Staff person #1, who was responsible for supervising Child #1, was observed on the opposite side of the room, engaged in conversation with Staff person #2, with their head turned away from the play area before, during and immediately after the fall. Therefore, Staff person #1 did not see, hear, nor direct the child at the time of the fall and approximately thirteen seconds had gone by after Child #1 fell before Staff person #1 noticed and went over to assess the needs of the child. Staff person #2 and Staff person #3, who were also present and facing in the direction where Child #1 was playing, did not notice the fall.

Correction Required: The legal entity shall develop a supervision policy regarding staff positioning while in the gross motor room to ensure staff are positioned in such a way to be able to supervise all of the children at all times. This policy will be posted in the gross motor room and included in the staff handbook.

The staff person shall know the names and whereabouts of the children in his assigned group. Provider Response: (Contact the State Licensing Office for more information.)
In our recent staff meeting we reiterated that each staff person to know the names of the children in their group while in the playground and during the facility excursion. We are going to implement picture cards for each classroom and will have teachers carry them during out of classroom activities (playground and gross motor room). While outside on the playground, if a staff person has to take one or multiple children from their group inside to use the restroom, they will hand off the cards of those children who will remain outside to another staff person, and communicate to that staff person that they are now responsible for those other children until the staff person returns in order to ensure compliance with staff being physically present with their assigned group of children at all times. Once that staff and other children return to the playground they will retrieve the cards of those children who remained outside under the supervision of another staff person and resume supervising those children who they are responsible for. If there are not enough staff to cover for another staff or if ratio doesn't allow for staff to supervise other children, the staff person will take their entire group of children inside with them to ensure proper supervision of all the children in their assigned group.
