Description: On file at facility

Noncompliance Area: During the renewal inspection, certification representative reviewed the facility files, and the liability insurance policy expired 3/27/25 to 3/27/26.

Correction Required: The legal entity shall have comprehensive general liability insurance to cover the persons who are on the premises. A current copy of the insurance policy shall be on file at the facility.

Regulation: 3270.27(a)(6)

Description: Emergency plan

Noncompliance Area: During the renewal inspection, certification representative reviewed the facility files, and the file did not include an annual emergency drill log.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Regulation: 3270.95(a)

Description: Devices must be compliant

Noncompliance Area: During the renewal inspection, certification representative reviewed the facility paperwork and there was no updated documentation of fire alarm systems annual testing from a fire safety professional. (Last documentation 7/2025) The current documentation that was available had two different dates on the signature line (7/2025 and 8/2026)

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)).

Regulation: 3270.124(c)

Description: Each child care space

Noncompliance Area: During the unannounced monitoring, certification representative conducted a facility walkthrough of the outdoor play space, older toddler #1, older toddler #2, young toddler #1, young toddler #2 and the infant extension rooms staff did not have the emergency contact information specific to each child with them in the outdoor play space.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.

Noncompliance Area: During the complaint investigation, certification representative conducted an interview with staff #1 who stated she did not complete an incident report after accidentally dropping an Alexa speaker on a child.

Correction Required: A child's record shall contain reports of accidents, injuries and illnesses involving a child in care at the facility. The original report shall be given to the parent on the day of the incident. The second copy of the report shall be retained at the facility in an accident file. The third copy of the report shall be retained at the facility in the child's file.

Regulation: 3270.75(a)

Description: In child care spaces

Noncompliance Area: During the unannounced monitoring, certification representative conducted a facility walkthrough and in the outdoor play space 2 classrooms, Young Toddler #2 and Infant extension did not have an emergency bag that included a first aid kit including a water bottle with them in the outdoor play space.

Correction Required: A first-aid kit shall be in a child care space.

Regulation: 3270.113(a)

Description: Supervised at all times

Noncompliance Area: During the complaint investigation certification representative viewed the facility camera footage via text message and interviewed the staff as to what they were doing and how they were positioned during naptime staff #1, staff #2, staff #3 and staff #4 were not properly positioned in a way that allowed proper supervision of all the children.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Regulation: 3270.113(a)(1)

Description: Staff assigned to specific children

Noncompliance Area: During an unannounced monitoring, certification representative conducted a facility walkthrough, in room #5 staff #1 and staff #2 were unable to identify their specific children in their assigned group.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Regulation: 3270.113(c)

Description: No ridicule or threaten harm

Noncompliance Area: During the complaint investigation, certification representative interviewed 6 staff members and per the investigation it was determined that staff #1 singled out a child by saying "If you wake him/her up I'm going to put you in the dark closet to sleep." "Scare tactic."

Correction Required: A facility person may not single out the child for ridicule, threaten harm to the child or the child's family and may not specifically aim to degrade the child or the child's family.

Regulation: 3270.51

Description: Similar Age Level

Noncompliance Area: During an unannounced monitoring, certification representative conducted a facility walkthrough, and staff #1 and staff #2 in room #5 were out of ratio. The youngest child in the room was 2 years old and there were 13 children with 2 staff. (Older toddlers 1:6 with a maximum group size of 12)

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30.

Regulation: 3270.134(a)

Description: Child's hands washed

Noncompliance Area: During the unannounced monitoring, certification representative conducted a facility walkthrough and watched an active diaper changing. After diaper changing staff #1 did not assist in washing the hands of a child.

Correction Required: A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered.

Regulation: 3270.176(f)

Description: Prohibition using an 11-15 passenger vans

Noncompliance Area: During the unannounced monitoring, certification representative reviewed the facility vehicle, and the vehicle is a 12-passenger van which the facility may not transport a child in an 11-15 passenger van.

Correction Required: In accordance with the requirements of 67 Pa. Code Chapter 171 (relating to school buses and school vehicles), the facility may not transport a child in an 11-15 passenger van.

Regulation: 3270.151(a)

Description: 12 months prior to service and every 24 months thereafter

Noncompliance Area: During the renewal inspection, certification representative reviewed 10 staff files and the file for staff #1 did not include an updated health assessment. last date8/4/2023

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Regulation: 3270.113(b)

Description: No physical punishment

Noncompliance Area: During the complaint investigation, certification representative viewed the facilities camera footage and observed staff #1 in the infant room aggressively handling the child and forcefully putting the child face down on the mat causing the child to bite its lip and bleed.

Correction Required: A facility person may not use any form of physical punishment, including spanking a child.

Regulation: 3270.113(e)

Description: Restraints prohibited

Noncompliance Area: During the allocated unannounced monitoring, certification representative viewed the facilities camera footage for a complaint investigation and observed in the infant room during naptime a child awake and actively playing while in the crib, as well as staff #1 restraining and pinning a child down with their leg across the child's back to keep the child from moving for approximately 6 minutes until child went to sleep. Video footage 14:06:20 to 14:12:08.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.
