Noncompliance Area: During the renewal inspection, certification representative reviewed the facility files, and the liability insurance policy expired 3/27/25 to 3/27/26.

Correction Required: The legal entity shall have comprehensive general liability insurance to cover the persons who are on the premises. A current copy of the insurance policy shall be on file at the facility.

Description: Emergency plan

Noncompliance Area: During the renewal inspection, certification representative reviewed the facility files, and the file did not include an annual emergency drill log.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Description: Devices must be compliant

Noncompliance Area: During the renewal inspection, certification representative reviewed the facility paperwork and there was no updated documentation of fire alarm systems annual testing from a fire safety professional. (Last documentation 7/2025) The current documentation that was available had two different dates on the signature line (7/2025 and 8/2026)

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)).

Regulation: 3270.124(c)

Description: Each child care space

Noncompliance Area: During the unannounced monitoring, certification representative conducted a facility walkthrough of the outdoor play space, older toddler #1, older toddler #2, young toddler #1, young toddler #2 and the infant extension rooms staff did not have the emergency contact information specific to each child with them in the outdoor play space.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.

Noncompliance Area: During the complaint investigation, certification representative conducted an interview with staff #1 who stated she did not complete an incident report after accidentally dropping an Alexa speaker on a child.

Correction Required: A child's record shall contain reports of accidents, injuries and illnesses involving a child in care at the facility. The original report shall be given to the parent on the day of the incident. The second copy of the report shall be retained at the facility in an accident file. The third copy of the report shall be retained at the facility in the child's file.

Regulation: 3270.75(a)

Description: In child care spaces

Noncompliance Area: During the unannounced monitoring, certification representative conducted a facility walkthrough and in the outdoor play space 2 classrooms, Young Toddler #2 and Infant extension did not have an emergency bag that included a first aid kit including a water bottle with them in the outdoor play space.

Correction Required: A first-aid kit shall be in a child care space.

Regulation: 3270.113(a)

Description: Supervised at all times

Noncompliance Area: During the complaint investigation certification representative viewed the facility camera footage via text message and interviewed the staff as to what they were doing and how they were positioned during naptime staff #1, staff #2, staff #3 and staff #4 were not properly positioned in a way that allowed proper supervision of all the children.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Regulation: 3270.113(a)(1)

Description: Staff assigned to specific children

Noncompliance Area: During an unannounced monitoring, certification representative conducted a facility walkthrough, in room #5 staff #1 and staff #2 were unable to identify their specific children in their assigned group.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Regulation: 3270.113(c)

Description: No ridicule or threaten harm

Noncompliance Area: During the complaint investigation, certification representative interviewed 6 staff members and per the investigation it was determined that staff #1 singled out a child by saying "If you wake him/her up I'm going to put you in the dark closet to sleep." "Scare tactic."

Correction Required: A facility person may not single out the child for ridicule, threaten harm to the child or the child's family and may not specifically aim to degrade the child or the child's family.

Regulation: 3270.51

Description: Similar Age Level

Noncompliance Area: During an unannounced monitoring, certification representative conducted a facility walkthrough, and staff #1 and staff #2 in room #5 were out of ratio. The youngest child in the room was 2 years old and there were 13 children with 2 staff. (Older toddlers 1:6 with a maximum group size of 12)

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30.

Regulation: 3270.134(a)

Description: Child's hands washed

Noncompliance Area: During the unannounced monitoring, certification representative conducted a facility walkthrough and watched an active diaper changing. After diaper changing staff #1 did not assist in washing the hands of a child.

Correction Required: A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered.

Regulation: 3270.176(f)

Description: Prohibition using an 11-15 passenger vans

Noncompliance Area: During the unannounced monitoring, certification representative reviewed the facility vehicle, and the vehicle is a 12-passenger van which the facility may not transport a child in an 11-15 passenger van.

Correction Required: In accordance with the requirements of 67 Pa. Code Chapter 171 (relating to school buses and school vehicles), the facility may not transport a child in an 11-15 passenger van.

Regulation: 3270.151(a)

Description: 12 months prior to service and every 24 months thereafter

Noncompliance Area: During the renewal inspection, certification representative reviewed 10 staff files and the file for staff #1 did not include an updated health assessment. last date8/4/2023

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Regulation: 3270.113(b)

Description: No physical punishment

Noncompliance Area: During the complaint investigation, certification representative viewed the facilities camera footage and observed staff #1 in the infant room aggressively handling the child and forcefully putting the child face down on the mat causing the child to bite its lip and bleed.

Correction Required: A facility person may not use any form of physical punishment, including spanking a child.

Regulation: 3270.113(e)

Description: Restraints prohibited

Noncompliance Area: During the allocated unannounced monitoring, certification representative viewed the facilities camera footage for a complaint investigation and observed in the infant room during naptime a child awake and actively playing while in the crib, as well as staff #1 restraining and pinning a child down with their leg across the child's back to keep the child from moving for approximately 6 minutes until child went to sleep. Video footage 14:06:20 to 14:12:08.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.

Description: Promote development/Infant/Toddler Stimulation

Noncompliance Area: During the renewal inspection, certification representative conducted a facility walkthrough and staff #1, staff #2 and staff #3 were not interacting with the infants and there were infants laying down with bottles in their mouths.

Correction Required: Daily activities shall promote the development of skills, social competence and self-esteem. Daily experiences shall recognize the child as an individual and give some choice of activities that respect personal privacy, lifestyle and cultural background. Infants and toddlers shall be provided stimulation by being held, rocked, talked to, played with and carried.

Regulation: 3270.65

Description: Protective Outlet Covers 5 yrs. or less

Noncompliance Area: During the renewal inspection, certification representative conducted a facility walkthrough and there was a broken electrical receptacle.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Description: Written consent/Consent for emergency medical care required prior to admission

Noncompliance Area: During the renewal inspection, certification representative reviewed 5 children's file and the emergency contact forms for child #1, child #2, child #3, child and child #4 didn't have written consent for emergency medical care.

Correction Required: Emergency contact information must include the written consent signed by a parent for emergency medical care. A child's record shall contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission.

Description: Information re: special needs

Noncompliance Area: During the renewal inspection, certification representative reviewed 5 children's file and the emergency contact forms for child #1 and child #3 didn't have an address for the release person.

Correction Required: Emergency contact information must include information on the child's special needs, as specified by the child's parent, physician, physician's assistant or CRNP, which is needed in an emergency situation.

Noncompliance Area: During the renewal inspection, certification representative reviewed 5 children's file and the file for child #1 doesn't include their health insurance policy or policy number on the emergency contact form.

Correction Required: Emergency contact information must include health insurance coverage and policy number for a child under a family policy or Medical Assistance benefits, if applicable.

Description: Immunization record/Exemption documentation from parent/guardian

Noncompliance Area: During the renewal inspection, certification representative reviewed 5 children's file and the files for child #1 and child #2 did not include written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of a flu immunization in accordance with the schedule recommended by the ACIP.

Correction Required: A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: During the renewal inspection, certification representative reviewed 12 staff files and the files for staff #7 and staff #8 did not contain a health assessment.

Correction Required: An adult health assessment must include a physical examination. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: During the renewal inspection, certification representative reviewed 12 staff files and the files for staff #7 and staff #8 did not have TB results.

Correction Required: An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.

Correction Required: A child's record shall contain signed parental consent for administration of medications or special dietary needs. A child's record shall contain signed parental consent for transportation, walking excursions, swimming and wading.

Description: Consent for administration of minor first-aid required prior to admission

Noncompliance Area: During the renewal inspection, certification representative reviewed 5 children's files and the emergency contact forms for child #1, child #2, child #3, and child #4 didn't have a signed parental consent for minor first aid.

Correction Required: A child's record shall contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Regulation: 3270.192(2)(ii)/3270.192(2)(iv)

Description: Exp, educ., training prior to facility/Transcript, diploma and letters

Noncompliance Area: During the renewal inspection, certification representative reviewed 12 staff files and the files of staff #1 and staff #4 did not include a verification of childcare experience. The files of staff # 5 and staff #6 did not have a verification of education and the files for staff # 7 and staff #8 was missing verification for education and childcare experience.

Correction Required: A facility person's record shall include verification of child care experience, education and training prior to service at the facility. A facility person's record shall include acceptable verification of experience, education or training is a transcript or a diploma or a letter signed by a representative of the experiential, educational or training entity.

Regulation: 3270.192(5)

Description: Two written references

Noncompliance Area: During the renewal inspection, certification representative reviewed 12 staff files and the file for staff #7 and staff #8 did not contain 2 written nonfamily references.

Correction Required: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person.

Regulation: 3270.27(c)

Description: Training regarding plan

Noncompliance Area: During the renewal inspection, certification representative reviewed 12 staff files and the files for staff #7, staff #8, and staff #9 did not contain a record of emergency plan training.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Description: Age and Training/Health and Safety Training - Pediatric First Aid and CPR

Noncompliance Area: During the renewal inspection, certification representative reviewed 12 staff file and the files for staff #3, staff #4, staff #5, staff # 6, staff #8 and staff #9 did not contain a pqas certified pediatric cpr/first aid certification from an approved provider /approved course.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. Staff persons shall complete professional development in pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire.

Description: Professional development certificate/Health and Safety Training

Noncompliance Area: During the renewal inspection, certification representative reviewed 12 staff files and the files for staff #6, staff #7 and staff #8 did not contain the 10-hr. health and safety training.

Correction Required: Completion of professional development shall be documented by the signature and title of a representative of the professional development entity and include the date professional development was completed. Documentation shall be retained in the facility person's file or maintained in an electronic system as designated by the Department. Documentation of the completion of the professional development under subsection (f) taken from September 30, 2016, forward satisfies this requirement. All staff persons shall complete the professional development under subsection (f).

Description: Comply with CPSL/CPSL information

Noncompliance Area: During the renewal inspection, certification representative reviewed 12 staff files and the files for staff #1, staff #3, staff #4 are missing NSOR clearances and staff #7 is missing a signed disclosure form, mandated reporter training, child abuse, criminal, FBI and NSOR clearances. Staff # 8 is missing a disclosure form and mandated reporter training, staff # 2 and staff #9 are missing are missing a disclosure form

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). SAFETY PLAN: The operator is required to submit to the Children and Youth Agency a plan of supervision or alternate arrangement as required by the Child Protective Services Law. LACKING REQUIRED HIRING DOCUMENTS: Facility Person #1,#2,#3 ,#4 AND #47 may not work in a child care position at the facility. PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #--- may not work in a child care position at the facility.

Regulation: 3270.27(a)(2)

Description: Emergency plan

Noncompliance Area: On the day of visit the facility relocation was the local CVS which is not appropriate for a daycare center that size.

Correction Required: The facility shall have an emergency plan that provides for accommodations for evacuation of children from the facility building and evacuation of children to a location away from the facility premises. The evacuation routes and evacuation plan to exit the building may be the same as those required by §3270.94 (relating to fire drills). THIS MUST BE COMPLETED PRIOR TO OPENING THE FACILITY.
