Noncompliance Area: At the time of the inspection the toxic cleaning materials in the infant room were being stored in the unlocked cabinet beneath the sink. Noncompliance Area: On October 12, 2022 @ 12:18pm A parent texted staff person #1 asking if it would be allowed for the child's therapists to attend the daycare to conduct their session with the child, to which they responded: "We will only do one day a week at daycare because we do not want too many people coming into the building especially with the winter season and cold and flu." On another occasion, a professional social worker called the facility and spoke to staff person #2 to ask about the child receiving ABA therapy and was it possible for him to receive it at the daycare center staff person #2 responded on February 20, 2023 at 3:44pm Stating "I got in contact with staff person #1, they informed me that it is not possible to have a therapist in everyday for six hours because it is a distraction to the other children and can throw off our daily schedule."

Correction Required: The operator shall make reasonable accommodation to include a child with special needs in accordance with applicable Federal and State laws. The operator shall permit an adult individual who provides specialized services to a child with special needs to provide those services on the facility premises as specified in the child's IEP, IFSP or written behavioral plan.

The legal entity will confirm continuing compliance by sending copies of the documentation to the Southeast Region Office on a weekly basis for a period of three months after DHS approves the documentation format. Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. The legal entity must submit documentation in a format approved by DHS proving that the facility procedure for counting children is followed at all times e.g., a checklist. The legal entity will confirm continuing compliance by sending copies of the documentation to the Regional Office of Child Development and Early Learning on a weekly basis for a period of three months after DHS approves the documentation format. Noncompliance Area: At the time of the inspection the 5 one year old children in care were in high chairs for over one hour.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.

Noncompliance Area: At the time of the inspection the infant in care had fallen asleep in the swing and was left there for 15 minuets to sleep.

Correction Required: Infants shall be placed in the sleeping position recommended by the American Academy of Pediatrics unless there is a medical reason an infant should not sleep in this position. The medical reason shall be documented in a statement signed by a physician, physician's assistant or CRNP and placed in the child's record at the facility.
