Noncompliance Area: The following items were observed in a pack n play where an infant had been sleeping: a blanket with a stuffed animal head on it, two small soft toys and a plastic identification key tag hooked onto the child's blanket.

Correction Required: Toys, bumper pads, or pillows may not be present in a crib while an infant is sleeping in the crib.

Noncompliance Area: The emergency contact information in the file for child #1 did not include an address for the child's physician. The file for child #3 did not include any information for the child's physician.

Correction Required: Emergency contact information must include the name, address and telephone number of the child's physician or source of medical care.

Noncompliance Area: The emergency contact information in the file for child #1 did not include a complete work address for the child's mother.

Correction Required: Emergency contact information must include the home and work addresses and telephone numbers of the enrolling parent.

Noncompliance Area: There was not a written and posted plan identifying the means of transporting a child to emergency care and staffing provisions in the event of an emergency in the child care space on the 2nd floor.

Correction Required: A written plan identifying the means of transporting a child to emergency care and staffing provisions in the event of an emergency shall be displayed conspicuously in every child care space and shall accompany a staff person who leaves on an excursion with children.

Noncompliance Area: The last update in writing by a parent on the emergency contact form and the agreement form in the file for child #2 was more than 6 months ago.

Correction Required: The parent shall update in writing emergency contact information once in a 6-month period or as soon as there is a change in the informationA parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: The last health report in the file for child #2, a preschooler, was dated more than 12 months ago.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Noncompliance Area: The health report in the file for child #3 did not include a statement that the child is able to participate in child care and appears to be free from contagious or communicable disease.

Correction Required: A health report shall include a statement that the child is able to participate in child care and appears to be free from contagious or communicable disease.

Noncompliance Area: The last flu shot in the file for child #1 was dated more than 12 months ago and there was no evidence of a flu shot in the file for child #2. Neither files included a written statement of exemption from the child's parent.

Correction Required: Exemption from immunization for religious belief or strong personal objection equated to a religious belief shall be documented by a written, signed and dated statement from the child's parent or guardian. The statement shall be kept in the child's record.

Noncompliance Area: The file for staff person #1 contained 3 hours of child care training in their last anniversary year.

Correction Required: A staff person shall obtain an annual minimum of 6 clock hours of child care training.

Noncompliance Area: One of the refrigerators in the facility's kitchen was preventing the door to exit from the kitchen from being opened all of the way. Based on conversation with the Pittsburgh Fire Marshall, who reviewed a picture of the exit, this would be considered an obstruction. There was also furniture blocking one of the two doors leading from the front child care space to the hallway.

Correction Required: Stairways, hallways, exits from rooms, exits from the facility and other means of egress serving as an exit shall be unobstructed.

Noncompliance Area: The last two child service reports in the file for child #1 and #3 were dated more than 6 months apart.

Correction Required: An agreement shall specify the services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information at 3280.124(f).

Noncompliance Area: The emergency contact information in the file for child #2 did not include the address of the child's physician.

Correction Required: Emergency contact information must include the name, address and telephone number of the child's physician or source of medical care.

Noncompliance Area: The emergency contact information in the file for child #2 did not include the health insurance policy number for the child.

Correction Required: Emergency contact information must include health insurance coverage and policy number for a child under a family policy or Medical Assistance benefits, if applicable.

Noncompliance Area: The last update in writing by a parent on the emergency contact information in the file for child #1 was dated more than 6 months ago. The last two updates in writing by a parent on the agreement form in the file for child #1 were dated more than 6 months apart.

Correction Required: The facility's current certificate of compliance and a copy of the applicable regulations under which the facility is certified shall be posted in a conspicuous location used by parents, with instructions for contacting the appropriate regional day care office posted at the same location.

Noncompliance Area: The paneling on the back side of the facility's bathroom door was peeling in several areas.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: The last fire drill conducted at the facility was more than 60 days ago.

Correction Required: A fire drill shall be held at least every 60 days. Staff persons, volunteers and children in attendance shall participate in the fire drill and shall exit the facility, weather permitting.

Noncompliance Area: The last 2 child service reports in the file for child #3 were dated more than 6 months apart.

Correction Required: An agreement shall specify the services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information at 3280.124(f).

Noncompliance Area: The file for child #4 did not include written parenal consent for administration of teething gel at the facility.

Correction Required: A parent shall provide written consent for administration of medication or a special diet.

Noncompliance Area: The garbage can next to the diapering table was not hands-free.

Correction Required: If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can.

Noncompliance Area: The last two health assessments in the file for staff person #1 were dated more than 24 months apart.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: Upon entering the facility, furniture was observed being used as a barrier between the front and back of the child care space, preventing staff and children from accessing the exit in the back of the room.

The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information at 3280.124(f).

Noncompliance Area: The operator had a sign communicating the pick-up and drop-off points, but it was not posted in the facility

Correction Required: Safe pedestrian crossways, pick-up and drop-off points and bike routes shall be appropriately determined in the vicinity of the facility and communicated to the children and parents in writing.

Noncompliance Area: The last fire drill documented on the fire drill log was dated more than 60 days ago.

Correction Required: A fire drill shall be held at least every 60 days. Staff persons, volunteers and children in attendance shall participate in the fire drill and shall exit the facility, weather permitting.
