Children were not adequately supervised at all times. On November 17, 2022, two staff members failed to adequately supervise a three-year-old child who left the playground. A staff member spotted the child, after the child exited the fence but prior to the child leaving the premises, and chased the child across a side street and then caught up to the child in the yard of a neighboring house on the main road.

A safe indoor and outdoor environment was not provided for the children. On November 17, 2022, staff members failed to provide a safe environment for a three-year-old child. The child was able to push a broken gate open and leave the playground, placing the child at risk of harm. In addition, though a request by administration had been made for the gate to be fixed weeks prior to the incident occurring, children were still allowed to play in the area prior to the gate being fixed.

Gates to the fenced outdoor play area did not remain closed while children occupied the area. On October 26, 2022, an administrator created a work order requesting a gate to a play area be repaired; however, on November 17, 2022, prior to the gate being repaired, a child was able to exit the play area by pushing open the broken gate.

Center staff did not comply with the safe sleep policy. Per the center's safe sleep policy, safe sleep checks must occur every 15 minutes. A child 5 months of age had a safe sleep check at 10:30 am and did not have another check until 11:08 am (38 minutes). Two other infants, 5 months and 9 months, had safe sleep checks at 10:45 am and did not have another check until 11:08 am (23 minutes).

Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of three years for the date of issuance). A staff member's qualification letter expired June 13, 2022 and she has not submitted the forms for requalification.

A valid qualification letter was not on file and available to review at the facility. A staff member's qualification letter expired on June 13, 2022.

The depth of the loose surfacing was not based on critical height of the equipment. The climbing structures on playground 1b and playground 2b had a substantial amount of grass and weeds growing through the mulch. Also, black weed barrier was visible at the base of the tan climbing wall and uneven bars on playground 1b and at the base of the red slide on playground 2b.
