All walls and ceilings including doors and windows were not kept clean and in good repair. The carpets in space 1 and space 2 were not vacuumed on Friday afternoon at closing time. Evidence of mulch, grass, and debris was present.

Children were not adequately supervised at all times. On November 17, 2022, two staff members failed to adequately supervise a three-year-old child who left the playground. A staff member spotted the child, after the child exited the fence but prior to the child leaving the premises, and chased the child across a side street and then caught up to the child in the yard of a neighboring house on the main road.

A safe indoor and outdoor environment was not provided for the children. On November 17, 2022, staff members failed to provide a safe environment for a three-year-old child. The child was able to push a broken gate open and leave the playground, placing the child at risk of harm. In addition, though a request by administration had been made for the gate to be fixed weeks prior to the incident occurring, children were still allowed to play in the area prior to the gate being fixed.
