Description: Age and Training

Noncompliance Area: A renewal inspection occurred at the facility on 8/29/25. A review of staff files was conducted. Regulation requires staff to update pediatric first aid and CPR training prior to the current training expiring. Staff #1 had pediatric first aid and CPR training that expired on 7/29/25.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. Until such time as the required pre- service trainings are completed, staff person #1 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #1, staff person #1 may not work in a child-care position at the facility.

Description: Comply with CPSL

Noncompliance Area: A renewal inspection occurred at the facility on 8/29/25. A review of staff files was conducted. Staff #2 has not completed mandated reporter training within the last 60 months. This is evidenced by the previously documented mandated reporter training on file being dated 1/19/20.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Until such time as the required pre- service trainings are completed, staff person #2 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #2, staff person #2 may not work in a child-care position at the facility.

Noncompliance Area: An unannounced inspection occurred at the facility. A review of staff files was conducted. See the code sheet for the date of hire. The CPSL requires staff to apply for their DHS FBI clearance prior to working in a child care role as a provisional hire. Staff #1 has worked in a child care role at the facility and did not apply for their DHS FBI clearance prior to working in a child care role.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a child care position with direct contact with children at the facility.

Regulation: 3270.95(a)/3270.95(b)

Description: Devices must be compliant/Director or designated staff person ensure compliance

Noncompliance Area: An unannounced inspection occurred at the facility. A review of the facility's fire safety system testing log was conducted. Regulation requires the fire safety system to be tested at least every 30 days. The following tests did not occur at least every 30 days: 10/22/24 12/18/24 2/12/25 4/2/25 5/2/25.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Description: Health and Safety Training

Noncompliance Area: A renewal inspection occurred at the facility. A review of staff files was conducted. Staff person #4 has not completed the following required pre-service training within 90 days of their date of hire (see LIS code sheet): pediatric first aid/CPR. Staff #4 completed pediatric first aid/CPR training on 5/6/24.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsection 3270.31(f)10.

Noncompliance Area: A renewal inspection occurred at the facility. A review of staff files was conducted. See the code sheet for dates of hire. Staff #2 completed mandated reporter training on 8/3/21 which was not within 90 days of the hire date of Staff #2.

Noncompliance Area: A renewal inspection occurred at the facility. A review of staff files was conducted. See the code sheet for the date of hire. Staff #2 did not receive their NSOR clearance until 6/9/21, which was not within the appropriate provisional hiring timeframe. Staff #3 did not receive their state police clearance until 4/21/22, which was not within the appropriate provisional hiring timeframe.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Description: 12 months prior to service and every 24 months thereafter

Noncompliance Area: While reviewing staff files on 8/25/23 the inspector observed that staff #1 and noted that the previous health assessment on 5/3/19 and then not again until 4/25/22, staff #2 began direct care with children (see LIS Code Sheet) and did not obtain a health assessment and TB until 8/1/23, staff #4 had a previous health assessment on 4/28/21 and then not again until 6/20/23.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Description: Health and Safety Training

Noncompliance Area: Staff person # 4 did not complete the required 10 hours pre-service training within 90 days of their date of hire (see LIS code sheet for date of hire)

Correction Required: Staff persons shall complete all professional development within 90 days of hire as listed in subsections (f)1-10.

Description: Health and Safety Training - Pediatric First Aid and CPR

Noncompliance Area: Staff person # 4 did not have pediatric first-aid/CPR training within the required 90 days of hire. This is evidenced by the fact that there was no proof on file at the facility (please see the LIS Code Sheet for date of hire).

Correction Required: Staff persons shall complete professional development in pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire. Staff person(s) shall complete professional development in the topics of 3270.31(f)(1 -- 10), within 90 days of hire. Staff person # 4 will have until 9/26/23 to complete the required training. Until such time as the required training has been completed, staff person # 4 must be supervised, when interacting with children, by an AGS who has completed the required training related to this citation. If there are no staff available to supervise staff person # 4, staff person # 4 may not work in a child-care position at the facility.

Regulation: 3270.32(a)/3270.192(4)

Description: Comply with CPSL/CPSL information

Noncompliance Area: While reviewing staff files on 8/25/23 the inspector observed that staff #1 obtained a Pa State Police clearance on 6/13/16 and not again until 3/23/22 and an FBI clearance on 9/26/16 and not again 4/22/22. Staff #3 obtained a Pa State Police on 4/21/17 and not again until 5/17/22, and a Pa Child Abuse on 5/5/17 and not again until 5/23/22 and did not obtain a PA Mandated Reporter training until 7/22/23, which was over 90 days after hire. All clearances must be updated every 60 months as required by the CPSL. Staff #2 was hired with only a FBI clearance on file and not a PA State Police, NSOR, and Child Abuse clearances and a disclosure clearance as are required before hire.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Regulation: 3270.131(d)(5)/3270.131(e)

Description: Immunization record/ACIP recommended immunization record

Noncompliance Area: Child number 1 date of admission 4/22 does not have a record of immunization.

Correction Required: A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility may not accept or retain an infant 2 months of age or older, a toddler or a preschool child at the facility for more than 60 days following the first day of attendance at the facility unless the parent provides written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of the dates (month, day and year) the child was administered immunizations in accordance with the recommendations of the ACIP.

Noncompliance Area: The emergency contact forms on file for children # 1, 2, 3, and 4 do not have the addresses listed for the release persons.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: According to CPSL announcement issued 9/18/2018, all staff hired prior to 9/30/2019 are required to have an NSOR verification on file no later than 7/1/20. The NSOR certificates on file for staff # 1, 2, 3, and 4 are all dated 8/13/20. The FBI clearance on file for staff #4 is not a DHS clearance and therefore is not valid.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff # 4 may not work in a child care position at the facility.

Noncompliance Area: There is a bike on the outdoor play area with a broken wheel.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: The emergency contact form on file for child # 1 does not have the address for the child's physician or the health insurance policy number.

Correction Required: Emergency contact information must include the name, address and telephone number of the child's physician or source of medical care. Emergency contact information must include health insurance coverage and policy number for a child under a family policy or Medical Assistance benefits, if applicable.

Noncompliance Area: The emergency contact forms on file for children # 1 and # 2 do not have the address listed for the release persons.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: More than 24 months passed between health assessments for staff person # 1; health assessments are dated 6/20/2017 and 7/13/2019. More than 24 months passed between health assessments for staff person # 4; health assessments were dated 4/28/2017 and 6/26/2019.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: Staff person # 3 started on 6/18/19. There is a state police clearance receipt dated 2/8/18 but no state police clearance. Staff person # 2 started on 10/1/18 and did not complete mandated reporter training until 5/6/2019.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Staff person # 3 may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff person # 3 may not work in a child care position at the facility.

Noncompliance Area: On 2/6/19, Facility person # 1 reported to the regional office that on 2/5/19, facility person # 2 pushed child # 1 while at the facility. On 2/13/19, staff interviews confirmed that facility person # 2 pushed child # 1 while the child was waiting in the bathroom line.

Correction Required: A facility person may not use any form of physical punishment, including spanking a child.

Noncompliance Area: There is a plastic police car with a hole in the plastic causing a sharp edge and pinch point in the outdoor play space. There is also a pink and purple car with a broken piece that has a pinch point in the outdoor play space.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: The agreements on file for children # 1, 2, 3, 4, and 5 do not have release persons listed on them.

Correction Required: An agreement shall specify the persons designated by a parent to whom the child may be released.

Noncompliance Area: Staff person # 1 was hired as an Assistant Group Supervisor; there is no proof of education or training on file.

Correction Required: An assistant group supervisor shall have a high school diploma or a general educational development certificate and 2 years experience with children.A facility person's record shall include acceptable verification of experience, education or training is a transcript or a diploma or a letter signed by a representative of the experiential, educational or training entity.

Noncompliance Area: A COMPLAINT INVESTIGATION WAS HELD ON 8/1/18 REGARDING AN INJURY TO CHILD # 1. THE PARENT NOTIFIED THE OPEATOR THAT CHILD # 1 RECEIVED EMERGENCY MEDICAL CARE ON 7/30/2018 AS A RESULT OF THE INJURY. STAFF PERSON # 1 STATED THEY WERE UNAWARE THAT THEY NEEDED TO CONTACT THE REGIONAL OFFICE AND ADMITTED THE REGIONAL OFFICE WAS NOT CONTACTED WITHIN 24 HOURS.

Correction Required: The operator shall immediately notify a child's parent and shall telephone notice to the appropriate regional office within 24 hours if a child in care at the facility is hospitalized or receives emergency room treatment.

Noncompliance Area: TWO PACK & PLAYS IN THE INFANT ROOM ARE NOT LABELED FOR USE BY A SPECIFIC CHILD.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child`s parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: THERE IS LOTRIMIN & DESITIN IN THE INFANT ROOM THAT ARE NOT LABELED.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container.

Noncompliance Area: STAFF PERSON #2 DID NOT HAVE A HEALTH ASSESSMENT OR TB SCREENING PRIOR TO STARTING AT FACILITY; STAFF #2 STARTED AT FACILITY ON 9/16/16 & HAS STILL NOT HAD A TB SCREENING

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.

Facility Person #01 may not work in a child care position at the facility.

Noncompliance Area: THERE IS DESITIN IN A CUBICLE OUTSIDE THE PRESCHOOL ROOM WHICH IS ACCESSIBLE TO CHILDREN.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. Medication shall be stored in a locked area of the facility or in an area that is out of the reach of children.

Noncompliance Area: OPERATOR DID NOT REVIEW DISMISSAL POLICY WITH PARENT AT ANY TIME

Correction Required: The operator shall review with the parent, at the time of application, the facility's general daily schedule, hours for which care is provided, fees, responsibilities for meals, clothing, health policies, supervision policies, night care policies, dismissal policies, transportation and pick-up arrangements.
