Description: Supervised at all times

Noncompliance Area: According to the facility's self-report and staff statements, on 10/22/25, Staff #1, Staff #2, and Staff #3 were transitioning 15 preschoolers from their classroom to the gym when Child #1 was left in the restroom which is located inside of the classroom. Staff person #4 walked into the classroom between 20 to 30 seconds after the class had left and found child #1 in the restroom. Staff Person #1 and Staff Person #2 reported that they realized Child #1 was not with the class when they were conducting the name to face check at the gym threshold. Staff Person #2 ran back to the classroom to get child #1. Child #1 was alone for 20 to 30 seconds before reuniting with their class in the gym.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. TIERED LIS: 1. Children must be supervised at all times. 2. The Legal Entity will arrange for all staff to attend a minimum of 2 hours of training on supervision conducted by the ELRC. Proof of training will be submitted upon completion.

Description: No physical punishment

Noncompliance Area: Based on staff interviews, it was determined that Staff Person #1 used physical discipline. Staff Person #1 was observed lifting a child in an aggressive manner that caused the child's neck to snap backward. Additionally, with the child facing Staff Person #1, Staff Person #1 lifted the child by placing their arms over the child and under the child's armpits and then forcefully placed the child down onto the floor. Correction Required: A facility person may not use any form of physical punishment, including spanking a child.

Regulation: 3270.21

Description: General Health and Safety

Noncompliance Area: The operator self-reported that Staff person #1 and #2 served a Nutrigrain bar containing oats to child #1 who has a documented oat allergy. Child #1 began vomiting after eating the bar and the parents were called to pick up the child.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Regulation: 3270.131(b)(2)

Description: Toddler/preschool: updated health report every 12 months

Noncompliance Area: The file for child #1 whom is a preschool child lacked a health report that was completed 12 months from the previous health report. The health reports in the file were dated 8/15/23 and 9/3/24.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Regulation: 3270.31(e)(4)(ii)

Description: Fire safety - 1 yr.

Noncompliance Area: The files for staff persons #1, #3, and #4 lacked firesafety training that was completed 12 months from the previous firesafety training. Staff person #1 firesafety training in the file was dated 5/11/23 and 6/18/24. Staff person #3 firesafety training in the file was dated 6/23/23 and 7/22/24. Staff person #4 firesafety training in the file was dated 7/7/23 and 8/7/24.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Noncompliance Area: The file for staff person #2 who was hired on (See LIS Code Sheet) as an assistant group supervisor lacked an NSOR verification certificate that was completed in the last 60 months. The NSOR verification certificate in the file was dated 11/7/19.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a child care position at the facility.
