Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Description: Supervised at all times

Noncompliance Area: On 4/22/26 at approximately 2:05pm, Staff #1 was observed caring for 7 children (4 PS and 3 OT) independently. No other staff was present at the facility at the time. A preschool child was observed alone in the infant room. No staff was present with the child in the infant room. At approximately 2:15pm, Staff #1 left the toddler room and went into the kitchen leaving the 7 children unattended with no staff person present. At approximately 2:20pm, Staff #1 left the toddler room and went into the infant room leaving the 7 children unattended with no staff person present. At approximately 2:25pm, Staff #1 was observed talking on a cell phone while supervising 6 children on cots and 1 child moving about the toddler room.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Noncompliance Area: The file for Staff #1 (See LIS Code Sheet) lacked a valid FBI clearance.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff Person #1 may not work in a child care position at the facility.

Correction Required: TIERED LIS: 1. When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements at §3280.52(b) This portion of the plan shall have an immediate correction date. 2. The legal entity will require all staff persons at the facility to complete a training regarding Supervision and Ratio in a Group Child Care Home. The training must be offered by ELRC 5, in-person and a minimum of 2 hours. The training must be completed within 3 months of the approval of this plan of correction. The training must be approved by the Department prior to implementation. Upon completion of the training, staff training documentation will be provided to the OCDEL-DHS representative by email. The training may count towards the mandatory 12 training hours required by the Department. The operator shall provide a date for when this training will be complete.

Description: Small Toys and Objects

Noncompliance Area: There was exposed styrofoam and packaging bubbles accessible to children in a box in the infant room.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: The emergency contact form for Child #1 lacked the telephone number of the child's physician.

Correction Required: Emergency contact information must include the name, address and telephone number of the child's physician or source of medical care.

Description: Infant: updated health report every 6 months/Initial and subsequent health assessments

Noncompliance Area: The current health report on file for Child #2, a young toddler, dated 11/12/25 was obtained more than 6 months from the previous health report dated 4/7/25.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler. A child's record must contain initial and subsequent health reports.

Description: Pertinent Laws & Regulations/General Health and Safety

Noncompliance Area: On 3/18/26 at approximately 10:30am, Staff person #1 was observed to be caring for children unsupervised. Staff person #1 has completed Pediatric first aid and CPR training, however the trainer has not provided documentation that they are PQAS-certified in that training curriculum.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required training has been completed, staff person #1 must be supervised, when interacting with children at a minimum by, an primary staff person who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #1, staff person #1 may not work in a child-care position at the facility.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Noncompliance Area: The water temperature at the sink in the infant room was 130.3°F. The water temperature in the main restroom was 125.9°F. The water temperature in the upstairs restroom was 127°F.

Correction Required: Hot water temperature, in areas accessible to children, may not exceed 110° F.

Description: Building Surfaces

Noncompliance Area: The white board in the toddler room is chipping along the bottom base. The ceiling above the white board in the preschool room was cracked and needs repaired.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.
