Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment on file at the facility. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Noncompliance Area: At the time of renewal inspection verification that provider emailed a copy of the emergency plan to the local emergency management agency was not observed.

Correction Required: The operator shall send a copy of the emergency plan and subsequent plan updates to the local municipality and to the county emergency management agency.

Noncompliance Area: At the time of renewal inspection, staff person #1 Pediatric First aid and CPR expired in March 2025. No staff with current Pediatric First aid and CPR was observed at the facility.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and CPR. All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. One or more facility persons competent in pediatric first-aid and pediatric cardiopulmonary resuscitation techniques shall be at the facility when one or more children are in care.

Description: Comply with CPSL/CPSL information

Noncompliance Area: At the time of renewal inspection, file of staff person #1 did not include a current state criminal history check and state child abuse and NSOR certificate, mandated reporter and Disclosure statement. Pa State police clearance, Pa child abuse clearance, NSOR and mandated reporter training were conducted more than 60 months ago.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a child care position at the facility.

Noncompliance Area: At the time of renewal inspection, verification that fire drill is conducted at least every 60 days was not observed. The last fire drill logged on file was dated 6/20/25.

Correction Required: Fire drills are conducted at least once every 60 days.

Description: System in compliance/Operator or designated staff responsibility

Noncompliance Area: At the time of renewal inspection documentation of smoke detector testing of every 30 days was not observed. Last testing was on 6/20/25.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The operator or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met.

Description: Updated toddler/preschool health report: every 12 months

Noncompliance Area: At the time of renewal inspection file of child #1 did not include an updated child health report. Child health report on file was from 12/4/23

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Noncompliance Area: At the time of renewal inspection, file of staff person #1 did not include 12 hours of annual training. Staff person #1 had only 1 hour of annual training.

Correction Required: A staff person shall obtain an annual minimum of 12 clock hours of child care training. A facility person's record shall include records of training required by the Department.

Regulation: 3290.18

Description: General Health and Safety

Noncompliance Area: At the time of renewal inspection, a policy and procedure to identify the potential signs and symptoms of baby shaken syndrome and abusive head trauma, strategies for coping with a crying, fussing, or distraught child, and the prevention and identification of child maltreatment were not observed. In addition, the emergency plan did not contain a statement regarding volunteers participating in emergency plan training and emergency drills, continuity of operations in the event of an emergency that includes backing up or retrieving health and other key records/files and managing financial issues such as paying employees and bills during the aftermath of the disaster. At the time of renewal inspection, file of staff person #1 did not include Pennsylvania Health and Safety Update 2022 1 hour professional development training required by OCDEL within the prescribed timeframe which is by December 30, 2022.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.
