Noncompliance Area: A Canadian Yew was observed to the right of entrance to the family child care home. The children play to the left side of the entrance in the front yard. A restriction is not in place to restrict access to the Canadian Yew. Canadian Yew's are considered to be a toxic plant.

Correction Required: Toxic plants are not permitted in a child care space.

Noncompliance Area: The emergency contact form for Child #1 lacked the complete addresses for the release persons listed.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: At approximately 9:55AM the operator answered the front door of the facility, leaving the 5 children in care unsupervised in the kitchen.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. The requirement for supervision on and off the facility premises includes compliance with the staff:child ratio requirements in §§ 3290.51-3290.52 (relating to maximum number of children; and staff:child ratio).

Description: Services provided

Noncompliance Area: The service reports for Child #2, Child #3, are dated from 1/7/22 to 8/1/22, Child #3 and Child #4 are dated from 1/7/22 to 8/8/22 which are more than 6 months apart. Child #2 and Child #3 have a current service report dated 1/17/23, and Child #3 and Child #4 have a current service report dated 1/20/23.

Correction Required: An agreement shall specify the services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. the operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information at § 3290.124(e).

Noncompliance Area: The most recent influenza vaccination on file for Child #2, and Child #3 is dated 10/28/21. There was no documented influenza vaccinations for Child #2 and Child #3 for the year 2022.

Correction Required: A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: Child #1, Child #2, Child #3, Child #4, and Child #5 had a previous and subsequent emergency contact forms and financial agreements that were reviewed and updated with more than 6 months in between.

Correction Required: A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: The door in the hallway next to the bathroom has a hole in the middle of the surface making sharp edges and splintered wood accessible to the children.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play area, shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: One of the pack n plays in which a child was sleeping had only 2 feet on 2 sides

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Description: Supervised at all times

Noncompliance Area: At approximately 1:45 pm, the operator answered the front door of the facility, leaving the 6 children in care at the time unsupervised. Upon entering the facility there was one young toddler and one older toddler sleeping in the first room with the door closed, 2 preschoolers and 1 young school-ager lying on cots in the rear room with the door closed, and an older school-ager sitting at the kitchen table. Between 1:50 and 3:15 pm, there were several times when one or more children were moving between the kitchen and the play room independently and could not be directly supervised by the operator.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Description: Disposable diapers

Noncompliance Area: The diaper genie in the first bedroom, in which the operator stated that soiled diapers were discarded, was not hands free as there was a flap at the top of the genie through which the soiled diaper must be pushed.

Correction Required: If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can.

Noncompliance Area: The two most recent health assessments on file for staff person #1 are dated in an interval greater than 24 months.

Correction Required: A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.
