Description: Mixed Age Level

Noncompliance Area: Staff #1 took six children into the nap room, 3 preschool aged children, 2 older toddler aged children and 1 younger toddler aged child making the ratio 1:5.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Noncompliance Area: In the kitchen on top of the refrigerator there were two spray bottles that were not labeled with the contents of the bottles.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be stored away from food, food preparation areas and child care spaces.

Noncompliance Area: The last documented testing of the fire detection system was on 10.9.24 which is more than 30 days ago. One of the smoke detectors was beeping because of what seemed like a low battery.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Correction Required: Emergency contact information must include the name, address and telephone number of the child's physician or source of medical care.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Noncompliance Area: The file for Child #3 contains an immunization record that is lacking 1-2 doses of the rotavirus immmunization.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: The file for Staff #1 and #2 both contain two fire safety trainings that are more than 12 months apart.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Noncompliance Area: At approximately 11:52 am during lunchtime, Staff #2 and #3 both walked into the kitchen leaving Staff #4, who is a 16 year old volunteer and Staff #5 in the big room with 18 children ranging in age from infant to school age.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Noncompliance Area: The file of child #3, identified as a young toddler (see coded LIS sheet), contained a health assessment dated 12/27/2022 but did not contain an updated health assessment within 6 months from the prior. The file of child #4 (see coded LIS sheet), contained health assessments dated 3/1/2022 and an updated health assessment dated 5/4/2023, exceeding 6 months between assessments.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler.

Description: Toddler/preschool: updated health report every 12 months

Noncompliance Area: The health assessments of child #1, identified as a preschool age child, were dated more than 12 months apart (dated 1/25/2022 and 5/16/2023). The health assessments of child #2, identified as a preschool age child, were also dated more than 12 months apart (4/7/2021 and 5/4/2023). The file of child #5 contained a health assessment dated 7/27/2021 but did not contain documentation of an updated or current health assessment.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Description: Immunization record/Dismissal policy

Noncompliance Area: The file of child #2 contained an immunization record which did not contain documentation of an influenza vaccination in 2022 but did contain one in 2023. The immunization record of child #3 did not contain the recommended doses of the DTaP vaccination as recommended by the ACIP for the child's age or an acceptable exemption. The file of child #5 did not contain documentation of a current influenza vaccination or acceptable exemption.

Correction Required: A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in child care group settings).

Noncompliance Area: The files of facility persons #1, #5 and #8, all who completed the health and safety pre-service training modules prior to 10/4/2022, completed the required "Pennsylvania Health and Safety Update 2022" after 12/30/2022. The file of facility person #4 and 7, who completed the health and safety topics prior to 10/4/2022, did not contain documentation of the "Pennsylvania Health and Safety Update 2022."

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.
