Noncompliance Area: On 3/6/26, Staff #5 and Staff #8 files did not contain initial health assessments, including results of tuberculosis testing. Staff #3 and Staff #9 files did not contain initial health assessments (only tuberculosis test results were observed in the files). Staff #7 file contained a health assessment dated more than 24 months (8/24/23). Staff #1 and Staff #10 files did not contain the date in which tuberculosis testing was conducted.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: On 3/6/26, annual notification to local traffic safety authorities of the facility's safe routes was not on file.

Correction Required: An operator shall notify local traffic safety authorities annually in writing of the location of the facility and the program's use of pedestrian and vehicular routes around the child care facility.

Description: Emergency info/agreement updated 6 mos/Emergency master file updated

Noncompliance Area: On 3/6/26, emergency contact information/financial agreements were not updated at least once in a 6-month period. Additionally, emergency contact information in the childcare spaces where children were receiving care was not updated at least every 6 months.

Correction Required: A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information. If emergency information is updated in a master file, it shall be updated accordingly in other facility records.

Noncompliance Area: On 3/6/26, evidence of child accident/injury reports were not observed on file at the facility and are not issued accordance with 3270.182(7).

Correction Required: A child's record shall contain reports of accidents, injuries and illnesses involving a child in care at the facility. The original report shall be given to the parent on the day of the incident. The second copy of the report shall be retained at the facility in an accident file. The third copy of the report shall be retained at the facility in the child's file.

Regulation: 3270.27(e)

Description: Letter to parents

Noncompliance Area: On 3/6/26, at time of inspection, a parent letter explaining the facility's emergency procedures was not provided to each enrolled family.

Correction Required: The operator shall provide to the parent of each enrolled child a letter explaining the emergency procedures. The operator shall also provide to the parent of each enrolled child a letter explaining any subsequent update to the plan.

Description: Age and Training

Noncompliance Area: On 3/6/26, Staff #9 file did not contain current certification of Pediatric First Aid/CPR. (The date of the last Pediatric First Aid/CPR training was 12/13/23.)

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Noncompliance Area: On 3/6/26, Staff #4 has not completed required preservice Health & Safety training Part 1 and Part 2 within 90 days of hire.

Correction Required: A staff person or a substitute staff person shall meet one of the applicable staff qualifications for the position in which the person is performing. An aide shall have attained one of the qualification levels specified in §3270.37(b)(1)-(3).

Regulation: 3270.106(a)

Description: Clean, age appropriate

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that rest equipment in utilized for infants and toddlers was not labelled for the use of a specific child.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Description: Refrigerator

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that refrigerators used to store food in Room #1 Infants, Room #3 Crawlers, Room #5 Walkers, and multiple refrigerators in the cafeteria were not equipped with operating thermometers.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45° F or below. An operating thermometer shall be placed in the refrigerator.

Description: Services proceeded/Services considered extra

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that the Child Service Agreement for several children was not signed by the operator, did not specify services to be provided to the family and child, and did not specify which services would be considered as extra.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in § 3270.124(f) (relating to emergency contact information). An agreement shall specify the services which are to be considered as extra.

Correction Required: Emergency contact information is required for each enrolled child. Emergency contact information must reference who shall be contacted in an emergency. Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that Emergency Contact Forms for several children did not include signed parental consent for emergency medical care.

Correction Required: Emergency contact information must include the written consent signed by a parent for emergency medical care. A child's record shall contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that Emergency Contact Forms for several children were not reviewed or updated every 6 months.

Correction Required: The parent shall update in writing emergency contact information once in a 6-month period or as soon as there is a change in the information. A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that child #1 did not possess an initial health assessment in the corresponding child record.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility. A child's record shall contain initial and subsequent health reports.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that the facility did not have a written policy on file that included recognition of potential signs and symptoms of shaken baby syndrome and abusive head trauma, Strategies for coping with a crying, fussing, or distraught child, or addressing the prevention and identification of child maltreatment. Certification Staff also observed that multiple staff at the facility and had not completed the required Health and Safety trainings and 12 clock hours of annual professional development.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that multiple staff had not undergone a health assessment within 12 months prior to initial services and every 24 months thereafter. Certification staff also observed that multiple staff had not undergone a Tuberculosis screening.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.

Correction Required: A child's record shall contain signed parental consent for administration of medications or special dietary needs. A child's record shall contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that multiple staff at the facility did not have a home address stored within their corresponding staff file.

Correction Required: A facility person's record shall include the name, address and telephone number of the facility person.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that multiple staff at the facility did not have 2 written, nonfamily references stored in their corresponding staff file.

Correction Required: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person.

Description: Availability of certificate of compliance and applicable regulations

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that contact information for OCDEL was not posted in a conspicuous location used by parents. Certification staff also observed that information on how to access the regulation in Chapter 3270 was also not posted.

Correction Required: The facility's current certificate of compliance shall be posted in a conspicuous location used by parents. The operator shall provide the parent of each child enrolled with information on how to access the regulations in this chapter electronically and with instructions for contacting the appropriate regional child care office.

Regulation: 3270.27(a)(5)/3270.27(d)

Description: Emergency plan/Plan posted

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff Certification staff reviewed the facility's emergency plan and determined that it did not provide specific accommodations for infants, toddlers, children with disabilities, and children with chronic medical conditions. Certification Staff also observed that the facility's emergency plan was not posted in the facility in a conspicuous location accessible by parents.

Correction Required: The facility shall have an emergency plan that provides for accommodations for infants, toddlers, children with disabilities, and children with chronic medical conditions. The operator shall post the emergency plan in the facility at a conspicuous location.

Regulation: 3270.27(c)

Description: Training regarding plan

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that multiple staff did not receive training regarding the emergency plan at the time of initial employment or on the annual basis.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Description: Comply with CPSL/CPSL information

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff reviewed multiple staff files and observed that Facility Person #15 did not complete a disclosure statement. Certification Staff observed that Facility Persons #18, #24, and #28 did not complete Mandated Reporter trainings. Certification staff observed that Facility Person #22 possessed an expired Child Abuse Registry Clearance, an expired FBI Background Clearance, and an expired NSOR Clearance. Certification staff observed that Facility Person #26 did not possess a NSOR Clearance.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #22 may not work in a child care position at the facility.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that multiple staff at the facility did not possess Pediatric First Aid and CPR training or possessed expired Pediatric First Aid and CPR training credentials in their corresponding staff file.

Correction Required: One or more facility persons competent in pediatric first-aid and pediatric cardiopulmonary resuscitation techniques shall be at the facility when one or more children are in care. A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that multiple Group Supervisors at the facility did not have verification of education or previous child care experience within their corresponding staff file.

Correction Required: A group supervisor shall have a bachelor's degree from an accredited college or university in early childhood education, child development, special education, elementary education or the human services field. A facility person's record shall include acceptable verification of experience, education or training is a transcript or a diploma or a letter signed by a representative of the experiential, educational or training entity.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that multiple Assistant Group Supervisors at the facility did not have verification of education or previous child care experience within their corresponding staff file.

Correction Required: An assistant group supervisor shall have a high school diploma or a general educational development certificate and 30 credit hours from an accredited college or university in early childhood education, child development, special education, elementary education or the human services field. A facility person's record shall include acceptable verification of experience, education or training is a transcript or a diploma or a letter signed by a representative of the experiential, educational or training entity.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that electrical outlets in Room #3 Crawlers and the cafeteria lacked protective covers.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed toxic cleaning materials in multiple classrooms and child care spaces that were accessible to children, including Room #3 Crawlers, K1A, K2A, K2B, K3A, K3B, K4B, and the cafeteria.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that first aid kits in multiple classrooms lacked tweezers and soap.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.

Description: Handwashing signs/Lidded waste receptacles

Noncompliance Area: During Initial Inspection on 08/11/2025, Certification Staff observed that the required handwashing signage stating that staff and able children must perform handwashing after toileting and before eating was not posted in the required areas. Certification Staff also observed that trash cans in diapering and toileting areas of the facility were not lidded.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility. A toilet area, training chair area, diapering area and sink area shall be equipped with a clean, lidded waste receptacle.
