Noncompliance Area: Staff person #1 was observed to be caring for children unsupervised. Staff person #1 has not completed the following pre-service training required prior to caring for children unsupervised: Pediatric First Aid/CPR.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre-service training is completed, Staff Person #1 must be supervised, when interacting with children, by an AGS who has completed the required training related to this citation. If there are no staff persons available to supervise Staff Person #1, Staff Person #1 may not work in a child-care position at the facility.

Description: Similar Age Level

Noncompliance Area: On April 30, 2026, at approximately 11:10 a.m., Staff Person #1 was observed supervising 17 preschool-age children alone in the PS Side A room, resulting in the staff person not in compliance with the staff-to-child ratio requirements. According to staff statements, it was reported that on multiple occasions, 2 staff persons supervised 21 to 22 preschool-age children in the PS Side A room between 8:30 a.m. and 11:30 a.m., resulting in the staff persons not in compliance with the staff-to-child ratio requirements.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30.

Description: Clean and good repair

Noncompliance Area: In Preschool A, a broken corner was observed on the lid of a storage box containing stencils and paper. In Preschool B, the legs of a gray child sized table were observed to be loose creating pinch points. In Room 1 a white storage tub containing toy trucks was broken.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Description: Clean and good repair/Small Toys and Objects

Noncompliance Area: Torn areas were observed on the diaper changing pads in Room 3 and Room 6 (infant and young toddler rooms) resulting in the inner foam filling being accessible to children.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts. Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Description: Clean, good repair, proper size

Noncompliance Area: In the older toddler area, a broken area with sharp plastic was observed on the tall gray storage cabinet on the lock loop. In Room 3, a broken pedestal fan was observed behind the rocking chair. The post of the fan was not secured in the base creating a tipping hazard.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

Regulation: 3270.106(f)

Description: 2 feet apart

Noncompliance Area: In Room 3, children were observed sleeping in cribs which lacked 2 feet of space on three sides on two separate occasions during the inspection. Each time, one of the three sides were blocked by another crib.

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Regulation: 3270.107

Description: Refrigerator

Noncompliance Area: The refrigerator thermometers in Room 3 and Room 5 were not operating at the time of the inspection.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45° F or below. An operating thermometer shall be placed in the refrigerator.

Description: Posted in group space

Noncompliance Area: Room 1 and Room 4 lacked posted written plans of daily activities.

Correction Required: The written plan of daily activities shall be posted in the group space.

Regulation: 3270.123(a)(3)

Description: Services proceeded

Noncompliance Area: The file for child #1 contained consecutive child service reports shared with the parents more than 6 months apart; 2/11/25 and 12/10/25. The file for child #2, enrolled since 2/05/24 contained documentation of only one service report dated 12/2025. Both files now contain current child service reports shared with the parents.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in § 3270.124(f) (relating to emergency contact information).

Noncompliance Area: Emergency contact information for child #5 was not present in Room 3 where the child was observed in care.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.

Noncompliance Area: The file for child #2 contained emergency contact information which was not reviewed and signed by the parent at least every 6 months, but are now current. The forms were reviewed and signed 2/2025 and again 2/2026.

Correction Required: The parent shall update in writing emergency contact information once in a 6-month period or as soon as there is a change in the information. A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Description: Infant: updated health report every 6 months/Initial and subsequent health reports

Noncompliance Area: The files for children #3 and #4, both young toddlers, do not contain current health reports. The most recent health reports on file are dated more than 6 months ago.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler. A child's record shall contain initial and subsequent health reports.

Noncompliance Area: The file for staff #6 contained an initial health assessment dated 1/22/26 which was after their documented first day in a child care position.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Description: Comply with CPSL/CPSL information

Noncompliance Area: The file for staff #2 contained clearances which were not renewed within 60 months. The previous child abuse clearance was dated 5/19/20 and was renewed on 11/03/25. The previous FBI clearance was dated 5/29/20 and was renewed on 2/26/26. Current clearances are now on file for staff #2. The file for staff #5 contained a state police clearance indicating a charge that lacked a disposition, therefore the clearance was invalid.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff #5 may not work in a child care position at the facility.

Description: Each staff person meets quals/Exp, educ., training prior to facility

Noncompliance Area: The file for staff #7, designated as an assistant group supervisor on the staff data sheet, did not contain documentation of the qualifications required for the position. The file lacked verified child care experience.

Correction Required: A staff person or a substitute staff person shall meet one of the applicable staff qualifications for the position in which the person is performing. A facility person's record shall include verification of child care experience, education and training prior to service at the facility.
