State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre-service training is completed, Staff Person #1 must be supervised, when interacting with children, by an AGS who has completed the required training related to this citation. If there are no staff persons available to supervise Staff Person #1, Staff Person #1 may not work in a child-care position at the facility.

Noncompliance Area: On April 30, 2026, at approximately 11:10 a.m., Staff Person #1 was observed supervising 17 preschool-age children alone in the PS Side A room, resulting in the staff person not in compliance with the staff-to-child ratio requirements. According to staff statements, it was reported that on multiple occasions, 2 staff persons supervised 21 to 22 preschool-age children in the PS Side A room between 8:30 a.m. and 11:30 a.m., resulting in the staff persons not in compliance with the staff-to-child ratio requirements.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30.

Noncompliance Area: In Preschool A, a broken corner was observed on the lid of a storage box containing stencils and paper. In Preschool B, the legs of a gray child sized table were observed to be loose creating pinch points. In Room 1 a white storage tub containing toy trucks was broken.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Description: Clean and good repair/Small Toys and Objects

Noncompliance Area: Torn areas were observed on the diaper changing pads in Room 3 and Room 6 (infant and young toddler rooms) resulting in the inner foam filling being accessible to children.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts. Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: In the older toddler area, a broken area with sharp plastic was observed on the tall gray storage cabinet on the lock loop. In Room 3, a broken pedestal fan was observed behind the rocking chair. The post of the fan was not secured in the base creating a tipping hazard.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

Description: 2 feet apart

Noncompliance Area: In Room 3, children were observed sleeping in cribs which lacked 2 feet of space on three sides on two separate occasions during the inspection. Each time, one of the three sides were blocked by another crib.

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Noncompliance Area: The refrigerator thermometers in Room 3 and Room 5 were not operating at the time of the inspection.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45° F or below. An operating thermometer shall be placed in the refrigerator.

Noncompliance Area: The file for child #1 contained consecutive child service reports shared with the parents more than 6 months apart; 2/11/25 and 12/10/25. The file for child #2, enrolled since 2/05/24 contained documentation of only one service report dated 12/2025. Both files now contain current child service reports shared with the parents.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in § 3270.124(f) (relating to emergency contact information).

Correction Required: The parent shall update in writing emergency contact information once in a 6-month period or as soon as there is a change in the information. A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: The files for children #3 and #4, both young toddlers, do not contain current health reports. The most recent health reports on file are dated more than 6 months ago.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: The file for staff #2 contained clearances which were not renewed within 60 months. The previous child abuse clearance was dated 5/19/20 and was renewed on 11/03/25. The previous FBI clearance was dated 5/29/20 and was renewed on 2/26/26. Current clearances are now on file for staff #2. The file for staff #5 contained a state police clearance indicating a charge that lacked a disposition, therefore the clearance was invalid.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff #5 may not work in a child care position at the facility.

Noncompliance Area: The file for staff #7, designated as an assistant group supervisor on the staff data sheet, did not contain documentation of the qualifications required for the position. The file lacked verified child care experience.

Correction Required: A staff person or a substitute staff person shall meet one of the applicable staff qualifications for the position in which the person is performing. A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: The files for staff #1, #3, and #4 contained evaluations dated more than 12 months apart. The file for staff #2 contained an initial evaluation dated more than 12 months after their start in a child care position. Current evaluations for staff 1-4 are now on file.

Correction Required: A director is responsible for written evaluation of staff persons on a regular basis, a minimum of one evaluation every 12 months.

Description: Protective Outlet Covers 5 yrs. or less

Noncompliance Area: Three electrical outlets accessible to children 5 years of age or younger lacked protective covers in the following areas; the blue preschool restroom and in Preschool A on an extension cord and on an outlet adapter, both were plugged into an outlet at the time of the observation.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: A reusable spray bottle containing cleaning materials was not labeled with the contents and was observed in a storage cabinet in Preschool A.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be stored away from food, food preparation areas and child care spaces.

Noncompliance Area: Two cans of shaving foam were observed in the art storage cabinet in Preschool B. Based on statements made by staff, the shaving foam has been used by children during art activities. The cans were labeled keep out of reach of children.

Correction Required: Arts and crafts materials shall be nontoxic.

Description: No insects or rodents

Noncompliance Area: Rodent feces was observed in the rear vent area of a mini refrigerator in Room 4. The refrigerator was positioned backward on the floor leaving the rear of the appliance accessible to children. Room 4 was not in use by children at the time of the observation.

Correction Required: Evidence of infestation of insects or rodents in the facility is not permitted.

Noncompliance Area: The first aid kit in Preschool A lacked tape. The first aid kit in Preschool B lacked gauze and tweezers.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.

Noncompliance Area: The second stall in the pink preschool restroom lacked a handwashing sign posted at the toilet.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility.

Noncompliance Area: On 02/13/2026, interviews with staff #1 and staff #3 verified that a child was left alone, separated from assigned staff. Staff #2 took the assigned group to the bathroom on 02/04/2026 after nap and before snack at approximately 3:00pm. Staff #2 put child #1 on the toilet. Staff #2 took the children back to the PS classroom for snack. Child #1 was left in the bathroom alone without an assigned supervisor for approximately 7 minutes. Staff #3 found child #1 alone in the bathroom on the toilet. Staff #3 brought child #1 out of the bathroom and returned child # 1 to assigned supervisor and group.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Correction Required: When the number of older toddler, preschool or school-age children participating in a program activity exceeds the capacity of the child care space the space may not be occupied by children of the infant or young toddler age levels.

Noncompliance Area: The file for staff #3 contained documentation of completing fire safety training more than 90 days after initial employment. Current training is on file.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Noncompliance Area: Staff #6 and #7 did not renew pediatric CPR and first aid certification on or before the expiration of their previous certification. This is evidenced by the previous certification for both staff being dated 9/08/22 and the renewed certification being dated 10/23/24. Current training for both staff is now on file.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Additionally, two ceiling tiles were observed to be warped leaving large gaps in the drop ceilings of the PS restroom and the kitchen.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Child #1 must be dismissed from care by close of business on 5/7/24 and may only return to care when the immunization record is updated or when a parent provides a written, signed exemption letter.

Correction Required: A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.
